John Harrington, photog in Washington DC is the most knowledgeable person on the planet with regards to the business of photography. Took his classes at the NPPA Southern Short Course years ago… all still relevant

B&H and Mr. Tony Gale, this has been a very interesting Part 1 and I'm very interested in watching as well as hearing Part 2 & 3 for very good reason. I'll start with I'm not just a photographer, but a fashion designer/retailer and business owner. Like Mr. Gale, I learned in high school back in the late '80s, took a pause to start another very successful business, and by Fate, I was FORCED back into photography in the late '90s and early 2000s. It blows my mind not just how far we have come since the days of film, but why no one teaches business. You don't need to be a lawyer or an accountant to understand the basics! This totally pisses me off and I will explain why. There are so many that are misguiding new photogs each year and today, with the advances in technology where cameras like Sony (which I have) have so many A.!. features. When it comes to business, any business, if you plan on charging anything, then forget what Mr. Gale says until later You need to consider a business structure. There is a Sole Proprietor, Partnership, LLC, S-Corp. and a Corp. Each has its advantages which the best place to start is the Small Business Administration (wwwiSBA.gov) The Second thing you need to do is look up your state's Secretary of State. This is where you register a business, business name, trade name, etc. as we as see if the name you plan on using like John Doe Photography or John Doe Studios is taken or not. Here is the first thing that pisses me off! You can do this online and IF you decide to be a "FOR PROFIT" entity, registering can be from $25 to a few hundred. 85% of MOST photographers are NOT registered! At a minimum, if you plan on charging, you need to register with your County Auditor. Generally, one or the other or both will apply for most U.S. states and counties. Third, you then need to visit your State's Dept. of Taxation or Revenue. This is where you find out if you need a license and what license you need. I.E. I'm in Ohio and have a Wholesaler's and Reseller's license. IT IS ALSO THE LAW Ohio Rev. Code §1345.02(G) "...the failure of a supplier to obtain or maintain any registration, license, bond, or insurance required by state law or local ordinance for the supplier to engage in the supplier's trade or profession is an unfair or deceptive act or practice." Here is the second thing that pisses me off! When a "For Profit" photographer calls him/herself "an Artist". You are NOT! You are indeed a "Supplier" under Ohio law, which many states have what is called "the Uniform Code", which simply means that although the language may vary state to state based on need, the intent is the same! Normally I get "I'm a photog or an Artist" so that does not apply to me!' Keep believing that non-sense! "Supplier" means a seller, lessor, assignor, franchisor, or other person engaged in the business of effecting or soliciting consumer transactions, whether or not the person deals directly with the consumer. Ohio Rev. Code §1345.01(C) ""Supplier" means a seller, lessor, assignor, franchisor, or other person engaged in the business of effecting or soliciting consumer transactions, whether or not the person deals directly with the consumer. " Therefore, B&H and Mr. Gale, let's please do your best NOT to mislead people As Mr. Gale pointed out a few times, there are those who are not following the law and therefore he recommended talking to an accountant, an attorney or both. Let me share a quick story and I will point out where and why Mr. Gale is misleading anyone who watches this video! In 2002 I bought a failed fashion design business retail store. It went under thank in part to 2 shady photogs who contended they were "artists" There was a successor contract to do 2 shoots a month, every other week. I knew nothing about fashion design, but I knew all about business. There was a 4 hr shoot with 2 photogs at $300 an hour which they have a "Creative Fee" of $5000 each. There were also 2 models in this scam at $250 an hour. Just in doing the shoot, they violate the law in so many ways! If you did the math you're at $14400. We shot 25 outfits where I needed a front, side, back, and closeup as well as maybe a glamour shot. That is 5 shots per outfit and I wanted 3 of each pose to pick from.... 3 X 5 X 25 = 375 images. Instead, I was given a CD of 25 images for an additional $5000 because it was deemed "Commercial" which is $200 per image. Pay attention. I had one week to use the photos. After that, I was forced to pay additional licensing and usage fees. Only 7 images were good enough to use to market the outfits. The rest were glamour. So that I'm clear the problem is older photogs like Mr. Gale promoting photogs to Do Not Show a client any unedited images, outtakes or even the whole set and let them pick which ones they want and want to be edited. Mr. Gale then contradicts himself to promote a truthful statement that you need to remember you are working for the client so give them what THEY WANT, NOT WHAT YOU WANT! So why is that dangerous to not let a client see the whole set or any unedited images? Because he doesn't know the law! But he will tell you copyright law in Part 2 or 3 I'm sure. Here is what happened. After getting the CD and refusing to pay these Con-Artists, they and their attorney sent me a Cease & Desist letter as well as called threatening to sue me for copyright infringement. You hardcore con-artist will say Hell Yes! (hahaha) Well, little did they know when I took over the business, I dissolved the former business name and entity while applying for a new one. This means my business DID NOT have any contract with them! I further told them let's make a date in court so I could put them out of business! They did and we ended up in court. The judge went to order me to pay until I presented my case and my countersuit. I took screenshots of their websites and Domain Registration. That info was handed over to the Dept. of Taxation and the IRS for tax evasion as well as the Attorney General's Office. I also showed the court that they did not have a legal and binding contract with my business and even if I did, Ohio Rev. Code §1345.03 (B)(1) "Whether the supplier has knowingly taken advantage of the inability of the consumer reasonably to protect the consumer's interests because of the consumer's physical or mental infirmities, ignorance, illiteracy, or inability to understand the language of an agreement;" So if you think your agreements or contracts are ironclad, you're dead wrong! Moreover, the court agreed that 7 days to use the images were deceptive and at minimum, it should be 30. FOr those of you who want to follow Mr. Gale's guidance on price, be super careful! Ohio Rev. Code §1345.03 (B)(2) "Whether the supplier knew at the time the consumer transaction was entered into that the price was substantially in excess of the price at which similar property or services were readily obtainable in similar consumer transactions by like consumers;" Was it EXCESSIVE? You bet! I could do it for $1000 and I had all of my numbers to prove it! Additionally, this is where Mr. Gale's advice along with tons like him can get you into serious trouble with NOT SHOWING A CLIENT THE WHOLE SET or OUTTAKES or UNEDITED IMAGES! Ohio Rev. Code §1345.03 (B)(3) "Whether the supplier knew at the time the consumer transaction was entered into of the inability of the consumer to receive a substantial benefit from the subject of the consumer transaction;" If you are charging a client or especially a wedding client thousands and you take 2000 and get them 500 as Mr. Gale pointed out as no one takes 100% great shots each time, IS THAT A SUBSTANTIAL BENEFIT? No! In my case I was given 25 for the total cost and the "usage fee" was $2500 per image, per use! (hahaha) Now comes my favorite ones. WIth them contending to be "Artists" Ohio Rev. Code §1345.03 (B)(6) "Whether the supplier knowingly made a misleading statement of opinion on which the consumer was likely to rely to the consumer's detriment;" and Ohio Rev. Code §1345.03 (B)(5) Whether the supplier required the consumer to enter into a consumer transaction on terms the supplier knew were substantially one-sided in favor of the supplier;" So was that ONE-SIDED IN FAVOR OF THE SUPPLIER (the Photogs)? You bet! Long story short, The State (Attorney General & Dept. of Taxation) seized their homes, cars, camera gear... everything for tax evasion as well not being a licensed business! My countersuit was for Deceptive Business Practices, which after all the evidence was presented to the court, they threw the photogs' case out I was awarded $125,000 which I had the court give $100000 back to the former owner, a single mom with 2 little girls trying to supplement her income to care for them. Their wives both divorced them and each was sentenced to 3 years in prison!

Model MU-PC2TOK/WW I was advised at B&H to purchase this Samsung SSD Touch for my BlackMagic Pocket 6K (also, purchased at B&H). After months of trying to get the rig put together, I discovered that the external drive was not compatible with the camera. I called to to enquire and was told by B&H that the drive was wrong and needed to purchase the T5 instead of the T7. I purchased the T5, but they would not refund me for the T7 based on the time lapsed from the date of purchase. Who's fault is that? B&H advise they customers to purchase the wrong items and then make them pay for the wrong advice. Someone in there management department has got to be out of their freaking minds if they think we as clients are going to continue to do business with a company that practices such unethical behaviour!

Re Web No: 1064141205 Raymond: Thank you for your order and this feedback. We regret your dissatisfaction. The T7 was purchased on 06/26/20, shipped to you on 06/30/20, and delivered on 07/02/20. That's ten months ago. Our return policy time limit is thirty days. I'm not sure why you waited ten months to ask for return authorization but after this much time has elapsed issuing the return authorization is impossible.
