The issue is the KZfaq copyright strike process. The accuser should prove the accusation or KZfaq should investigate to determine the validity of the accusation. Instead KZfaq flips it on its head and takes action immediately while essentially making the accused prove their innocence.

I have no problem with the process IF there were a follow up. Make a bad faith copyright strike and then Google starts investigating all of your claims and if they find another you need to prove every strike from that point forward.

Lean on the side of the one owning the copyright. That must be YT’s safe/lazy stance as well, but it makes sense in theory. They most likely don’t have the staff to review every single strike, so this is their way of managing it

I was an IP attorney for 14 years before becoming a full time content creator. Copyright strike has nothing to do with third party tools. It's logos, art, music, etc from the game that is protected by copyright. The art you used in the background for this video is technically infringing Plariums copyrights on their art and logo. A copyright owner can choose to let it go and not do anything when it's in their favor (ie content creators making a positive video that helps the game)... And technically they can tell you to take it down if they want. There is a fair use exception to copyright that allows people to use copyright content for reviews, critiques, parodies etc. I would argue that your video would fall squarely in this exception. If you fought I think you'd have a good chance of winning... This exception exists in part to prevent copyrights from being abused in order to quash dissent and silence criticism. It's bad PR that plarium would try to abuse their copyrights to silence someone who is saying something negative about them... They were within their right to do this but if you fought I think they would lose...

I'm glad you're rid of the strike, MacChan! And you're 100% right; it was an inappropriate move. No, a stupid move. Because as you say, they can scare CCs with strikes because of KZfaq's policy. But the more they do that, the more they demoralize the community into no longer wanting to cover their game. It's short-sighted.

MacChan, stay strong and remember before putting any money in any company that said company will always treat you without any consideration for the time and passion and money you invested in said company or any other. There's no real relationship with the players devoted to these games. Each player to them, independently of how much money they put into the game or not, is only an irrelevant number. All they want is money, they don't want to know your opinion, they don't want to know anything. There'd be too much to say about the future of this game, but talking to a person that doesn't want to hear isn't worth it. In the future, don't invest yourself so much in any one company, they're like those toxic bosses that want everything from you and give nothing back. Good luck MacChan. I'll watch your videos in other games.

Plarium did not want to resolve this peacefully, they went for "shoot first, talk later". The only reason they came around was the unexpectedly big backlash they received for it. It's totally understandable that you obliged to remove the video and Plarium wins there, albeit with the help of KZfaq's sketchy TOS. Otherwise they'd have sought some other nuke and used it - in the end they again showed their ugly face and helped everybody on the fence to understand this company is a hopeless case of greed.

I'm glad they did what should have been done in the 1st place here. Raid is a bully to it's players and to it's CC, that's how they roll. I may end up doing a video on the very subjects that got you the strike. I seriously thought about a channel called Raid Fails. It may happen yet. If I got a strike or removed from the game it really would have no bearing on my life. Someone comes up with an antigreed strategy and they can't accept the fact that they themselves are stealing by setting the odds so deeply in the house's failure. More power to ya Mac and as always, you are so respectful in your view on this.

I'm glad things got resolved. KZfaq's copyright rules are too easy to abuse and Plarium took advantage of it. In the future I hope Plarium does reach out before trying to ruin the channel. And not even Plarium can claim everything to be copyrightable because there is the legal right of fair use. Anyway goodluck, hope there is no more drama of the bad kind for you.

Plarium community manager should reach out to you first before giving you the copyright strike to your channel. If Plarium is serious about this issue, they should address it rather than silencing content creators with this method. You have raised many good points on Plarium Raid weaknesses, but they are not resolving them with the highest priority. You can come join us at Watcher of Realms, a much better game compared to Raid 🙂

People said the same thing about EE probably you as well. We can all se how great EE is doing right now. Wor is a good game but offers nothing new other than the tower defense aspect but it will be more annoying the more you play than enjoyable. I just can't imagine it will have the same longevity as RSL. When the new game factor is over it will be a chore to play much earlier than RSL.

@@Devourd EE never had a huge following and did not have as much crossover with Raid as Watchers does. EE was more of a casual approach to gatchas. There isn't any gameplay besides collecting in that game essentially. Also if you are gonna be 100% closed off to alternatives like a grumpy old man who refuses to buy a different coffee brand because it wasn't what you drank in your house when you grew up then you never broaden your horizons from a game design aspect to understand how these games work and identify which ones have promise or good key qualities (which creates competition and and makes other existing games hopefully reevaluate their features and game modes. Majority of gatcha games are stolen features from other games, for example Raid 95% of it is stolen years later from summoner wars, no different than when Apple says we are releasing USB C cords when USB C has been around for like 10 years already. I would directly counter your comments about complexity making a game worse, usually complexity makes a game either stand out or increase player commitment. If a game is hollow no one wants to play it. No one wants to login, collect login rewards, and quit especially when you are supposed to play for years. Thats one of Raids downfalls is for a majority of players there isn't anything to do except events and fusions which is no different than logging in because they are constantly happening. Players need a reason to login for some thats collecting, for some thats pvp, for some thats tower defense, ect. Anyways, I'm not even a fan of WOTR, but your point makes no sense from any aspect you look at it except from a grumpy "I dont like change" aspect. Also people gotta eat and make money. Raid is on a decline atm, why complain about other people looking into other games?

I would say Skratch has very little idea what is was talking about... if you want to know what was/is your situation in this case, talk to a lawyer that specializes in a copyright law, but I'm pretty sure, you would have won this case on a fair use grounds :) but this would mean war :) and they could strike all the other videos with actual gameplay...

Fair use would not be applicable in this situation. The Consumer Review Freedom Act would though. That law makes it illegal to put anything in the ToS that prohibits users from giving negative reviews.

Sure they may own the copyright and thats the law but Fair Use is the law too. If you really felt some kind of way take them to court. I just took my copyright strike and waited the 90 days before I put up more content. And mine was for free to Use Green Screen effects. Literally says free to use and copyright free in the title of the video and the user owner still hit me with a Copyright strike. I emailed the person and asked for them to remove the strike and they never responded. If I werent already rich and value my time I would def drag them into court.

Don't know how you can say Raid is one of the better ones after playing other Gacha (not exactly sure which ones you've played) must have not played the right ones or you don't care for story or fun events in your gacha games. In my opinion Raid is one of the worst (I've played gachas for 11 years) it's just a grind with minimum effort and maximum monetization put into everything except the art. It would be tolerable if the game was good and the company was bad but the truth is the game is mediocre and the company is horrible. Either way glad you got the strike removed.

That you had to have it *explained* to you that the rules of the game are made by corporations (including KZfaq), and all those rules favor THEM, and they can crush you anytime they choose. This sandbox in which you're playing is neither yours, nor fair. You are absolutely correct in your epiphany, though: that to depend on KZfaq for your main income is *incredibly* risky. RSL/Plarium needs the community/customer way more than the community/customer needs RSL/Plarium. Imagine all the “CC” telling their audience to boycott RSL-stop playing. Play something else. While RSL would still hold control of their game, they’d pump the brakes a little more often on much of their foolery.

Nothing you said has anything to do with a copyright strike. You 100% would have won it. This was complete and absolute bs. Any lawyer off the street could have won this for you since they didn't have a leg to stand on. What's more, you live in Canada and you do have government protection who could have stepped in if you asked. Also, even if Skratch were correct and if playing a game could result in a copyright strike, the video that you showed didn't have gameplay. What's more, Skratch is full of bs on this one. The dude has zero idea what he's talking about. All that happened here is a big corporation lied to another corporation and made you scared of the money they could spend on lawyers. It is the sort of bullying that big corporations and rich people due that has an almost 0% win rate if people actually take them to court because it is a scare tactic through and through. An abusive one too which is why your government would have your back. In the US it is a bit more state dependent on whether or not you have a decent AGs office but you'd be fine in Canada.

Copyright strike is an umbrella term meaning that you broke some rule either the game or the platform you're publishing on has. It isn't necessarily a copyright strike in the literal sense.

No it isn't. Copyright strike actually means exactly what it said: you violated copyright LAW and therefore the video is being taken down. Absolutely nothing MacChan did had anything to do with copyright law. Now maybe he broke the terms of service (although you cannot ban negative reviews in a terms of service). He probably did break the content creator program agreement. What remedies would raid have though if MacChan broke both? They could kick him out of the content creator program and they could ban his account. Heck, they could ban him from playing. And that is the absolute extent of their authority. They can do nothing more than that.

Nope. Copyright strike actually has to do with copyright law. Plarium lied to youtube. Which actually probably does violate youtube's ToS. If MacChan violated Raid's ToS the extent of their power is banning him from playing Raid. That's it. He didn't violate KZfaq's ToS.

it wasnt for no reason You were basically talking about how you did insider trading to get offers at lower rates and how to do it . Lol, they had to remove the copyright strike because the video didn't break any copyright law. If MacChan was going to fight them on it, they would have lost 100%. What's more, he lives in Canada where they don't take particularly kindly to a corporation lying to intimidate someone by threatening their income.

The funny thing is, they should have banned your Raid account but instead kept it up because maybe the new owner keeps spending . You obviously admitted giving your credentials to various services to log in for you and buy packs at cheaper prices .

You were promoting account selling, which is breaking the terms of service of Raid. So it's no wonder they copyright striked your video. Copyright strike in youtube terms is just general strike meaning that you broke some rules of t&s of the platform.

@@JohnDoe-mk1qu Raid cannot Copyright someone's face, voice or opinions. There was nothing in his video that anyone can Copyright. Nowhere in KZfaq's ToS does it say "Don't talk about selling Raid accounts" and Raid's ToS does not extend to OTHER platforms.

Ok , this is embarassing & just shows you DO NOT KNOW THE LEGAL SYSTEM. They OWN THE GAME you played called Raid Shadow Legends. Everytime , every second you were on "your" technically, their servers is logged. Every transaction especially. timestamped ;). Someone with a nice suit & smile will come for your money & will win. Real Lawyers aren't known to ughh just come for random money & if they do , they quickly get a rep. Luckily this was resolved peacefully. -_- So , now that we know you & RSL have a equal size PP.
