You are 100% correct. NO ONE has the right to trespass on your property.

I would 100% pursue it. The government will just do whatever they want if you dont stand up for your rights. It's your right to not have them tearing up your private property.

So many comments here that you may never see this. I am a Registered Professional Forester in California. I have lived, worked, and went to college in Michigan, Indiana, Ohio, Wisconsin, and Oregon. I have not worked in Oklahoma and do not claim to know the laws and customs there. You don't seem to know what governmental agency did this or what agency controls the land. You need to know that. It makes a difference. It appears that the burn got away from them and they ran a dozer land at a flat area that just turned out to be an existing road. From that line, they tried to backfire with varying amounts of success. It does not appear that they ran vehicles to the creek for water. If it was a client of mine (or on my land), I would write a formal letter to the agency. It would specify that there was concern that there was no post fire notification or attempt to remediate damage. It also might be noticed that the dozer work opened up unwanted access to your parcel. For you, I make the following recommendation. Contact a forestry supplier such as Nelson Paint Co, or Forestry Suppliers and obtain PURPLE boundary paint. Mark trees on your line such that there is no doubt that there is a property line. This will reinforce your postings and make sure all comers know they are entering restricted property. On a final note, had positions been reversed and a fire on your land gone on to "public land", there would be hell to pay.

Your property and your rights have been violated. Someone should be held accountable for this totally inappropriate action.

If anyone came on my 54 wooded acres that I live on and did anything, I would be mad as heck and would be pursuing charges and restitution for any damage, including damage to trees! You need to make a legal stand - if you do not - you are inviting further intrusion. You are now the man to take the stand. People here will help fund your legal fees, just say the word.

There have been multiple cases where failing to contest a trespass resulted in a decision that the property owner had voluntarily granted a public easement. It's sort of the flip side of "adverse possession", if you don't defend it you eventually discover it is no longer yours.

They work for us and they have NO right to trespass in your property for ANY reason. Sue them for everything you can get. They tried to destroy it. No! You are so right! It is your property and you pay the taxes on it. No one should be on your property with out letting you know first. I would not like anyone just come on my property with out giving us a heads up first.

Suggestion: find a retired Stop sign at the scrap yard or talk to the local public works (they are constantly replacing & scraping damaged signs). Mount it to a tree next to where the fire break crosses your property line, 6-8 feet high and put no trespassing and private land signs below it

Now have more opportunity for trespassers on your property with having easy access. Need them to fix fence and I’d spray purple paint on trees around there to show private property. Love your videos

Don't let it go. Charge them for your time to repair the fence, and also make a complaint for trespassing and unlawful damage to your property.

Yeah but they need to be put on notice for not asking or telling you it was happening. It is yours, they busted thru fences, uncool. If you did it to public or private land that's not yours, they'd sue or charge you with a crime....

I live in Montana and when they do controlled burns here it is on Forest Service land not on private property. Now during a forest fire emergency they will go on to private property and cut a fire break but they do their best to notify property owners.

When a controlled burn starts to burn into areas which were not planned to burn, it creates an exigent circumstance. That exigency creates a situation where they are allowed to not only come onto your property, they may perform any tasks necessary in order to control the exigent circumstance, in this case the controlled burn fire which likely began off your property.

You never let a government agency on your property because they will make up any reason to take it from you or not let you use it. All they have to say is they saw a spotted owl without proof of anything, and then you can't log or build.

I have a feeling that it was possibly a controlled burn that went out of bounds. That they had to get control of.. I am a former wild land firefighter with cal- fire formerly known as California department of forestry and fire protection. I have a degree in prescribed burn. I'm not 100% familiar. With your area of the country. But I know that usfs (US Forest service) does partner with land owners to do prescription burns. It's actually good for the environment. It eliminates invasive plant species and helps other plants germinate because their seeds cannot germinate without fire. And the carbon is good for the land . But what do I know. I only have 3 masters degrees one in para medicine. Masters of fire science. Forestry management and prescribed burn.

They should have notified you.

I would definitely contact an attorney to find out the right they may have, or think they have. Doing nothing just invites further intrusions.

Just my opinion…… it was not a controlled burn. On a controlled burn , they advise the landowner and if they do a controlled burn, a lot more of it would have been burnt. Dutch, I don’t believe they just leave a note! I believe they have to contact you in case the burn gets out of control! It is a huge deal! I agree with you! Protect your family. If you don’t, no one else will! I could go on and on.

I 100% agree with you. Your ownership should be respected! You should have been notified. The destruction of your fence should absolutely be their responsibility to fix. You know if the table was turned things would most likely be a whole different thing.

The State/Federal Government CANNOT take your land under the Constitution's Taking Clause without proper compensation. 'Taking' is not just using your land for Public Use, but also accounts for the taking of your Use of the land. Not only did they trespass they damaged the land affecting how you can use the land. Reach out to the Institute of Justice as they just won a very similar case against the state of TX

I'm 1/6, owner of 320 acres . ( hunting club). It's fully fenced and posted. We let the person we bought the land from run a maple syrup operation on the property. He keeps the trails open and keeps a close eye out for trespassers. I would call and have them replace the fences .

I use to work for forestry & we had to have paperwork & look at property map before doing any controlled live burn & no they can't come on your properties without a emergency, they can't burn on u.

You absolutely cannot be too careful these days. Any agency, govt or not should contact you if needing to access your property.

I would first check to see if they made any public announcements like a newspaper ad, road signs, PSA on the radio, etc. if they didn’t, I’d be pretty angry. Private property rights are fundamental to our freedoms as Americans! Good luck!

You can force them to fix the fences

Was it a State Agency? County? Forest Service? It is all different. The only way a fire should be on your land is if a burn get out of control, they were sloppy about this or it was a mistake. This was a mistake because there is way too much liability starting a fire on your property without permission. When you find out who exactly did this, be sure to at least send a registered letter , them follow up in person and meet with the head of the agency. They need to at least reimburse for fence damage or if access needed for fire fighting Federal land, they should put in gates, that can be locked with a combination lock. They can contact you for access or by agreement so no one who shouldnt have combination won't. Id worry about creek access from the clearing . That is going to give you issues.

Unless the main forester was there then I'd say someone gave the ground crew the address or told them where to go into the property at,but there's no excuse for tearing down fence or going past 'no trespassing' signs without permission or it being an emergency.

Here in Texas, the weather conditions (temperature, humidity, wind speed, amount of rain fall, etc.) are so difficult to meet that controlled burns are darn near impossible to do! We had a government biologist work with us for several years, and at NO TIME did we meet the criteria to do a controlled burn.

I agree with you Dutch! They shouldn’t be allowed without permission. But I thought there is something about landowners not having the rights to the minerals underground. Check that out as well. Maybe it’s for certain states but I’ve been hearing that as well

As they took down your fence, if you had livestock escape, they possibly could be held responsible if they were injured or not recovered.

They should have contacted you about the burn etc.
