I became a naturalized citizen in 2012 I decided to change my name and received my certificate with my new name but never updated any other documents and went to Mexico. After almost 8 years I came back and want to revert the name on my certificate back to the original. All my documents have my original name except my certificate and my driver license is expired since 2013.

HI @Jorge - Courts can vacate orders entered for good cause but 8 years is a long time and that might not work. It would probably be easier, cheaper and faster to go through the process again to change it since there is an order changing it the first time- Check with an attorney in your area if you want to try the vacation method. Thanks and I appreciate all this info it sounds 🤔 like it’s a very long process to correct or change a name how long does it usually take to correct the name change on a 🧾 birth certificate I live in Colorado and my first name on my birth certificate is not my name that a head all my life and I don’t want to us the first name that I recently found out is on my birth certificate because is not my name and I wanna do all this before my NM driver license expires 💆‍♀️ please let me know How long do you think all this process usually takes to correct . Hi @Diane - Very good question! The time from start to fully changing your drivers license depends upon each step and the processes and time each agency/court takes. It's not a big deal to change the drivers license after it's renewed - a name change is a valid reason to get a new one so don't get hung up on that.

...I understand all of what you said. But how do I go about getting a court hearing to do the name change? I live in Pennsylvania, I can fill out the SSA name change form, no problem. But I just walk into the court house with that and request a hearing to see the judge? should there be any specific form for my state to fill out or just the SSA form?

Hi Lizz. The easiest way is for you to hire an attorney to do it all for you. Some hearings are now done remotely which also saves travel time. Formal pleadings need to be prepared, filing fee paid and publication requirements, if any satisfied. Hearings are scheduled with either the division where it will be heard or by the clerk. Hi so I went through the court to change my name full name and now I’m having second thoughts and only want to change the last name today I just got done the judge said I’m good but do I have to go to the social security place to confirm the name change all the way? Cause of so could I just not do anything and still have my birth name

HI @Gamer Judgments can be modified or amended within certain time periods after they are entered- it requires a Motion to correct, modify or amend - each court uses a different name. To prevent future problems you should decide on the name and have this order show the name you want. If you wait too long you will hve to go through the whole thing again. Good luck!

Hi @Unknown - court fees and payment are upt to hte clerk fo the court so you have to ask them. Because there is a publication notice also required to be made that likely will not be waived but that is up to the publisher of the newspaper..

HI @Anthony the process is the same- you provide the information on your current name and then provide the name you want to change into. Then the court order is used to change your documents. Please check with your immigration attorney to be sure that you cover any other matters that might apply. Good luck!

I would like to change my sons first name only he is 17 and agrees to the name change because he has been bullied since middle school on the name. He wants his name change before graduating so all documents are correct. I have full custody of my son and his father has not been involved since he was only 3 months old. He has paid child support only in the last 5 years but never any contact with my son due to family violence. My son wants to join military and feels like his name is not appropriate either for military in usa. I live in Texas and once again we are only concerned about changing first name and middle name only. Will court more likely allow me to change it or not since its not the last name? Please let me know I feel as if it in his best interest to have name changed

Hi - very good info. I have a question though. My birth certificate has my first name spelled phonetically, (the way it sounds) but my real first name is spelled quite differently which is the way I have spelled it since as long as I can remember. (my parents are no longer alive) My SS#, current DL and any and all I.d.'s have my first name spelled correctly. I am married now, so my last name is different. I applied for the Real id, but was denied because my first name on the Birth Cert. does match all the other i.d.'s that it asks for in the real i.d. application. I am now trying to change my FIRST name only...with the CA court - myself, and on the application I can't tell what name(s) I am supposed to give for the questions that say: Petitioner..... and then Present name (is this my correct spelling of my first name with my married last name,) or ? is it the way it is listed on my birth certificate (incorrect first name and maiden name) and then for Proposed name: Do I list my full name as it is now,(correct spelling of first name and married last name? I hope you can clear this up for me.

Can a vital records department deny accepting a legal name change order that was done in 1986? I was born in NYC but my mother had the name change in NJ but the original birth certificate was not updated. I am dealing with getting my license renewed but need the birth certificate.

The Court order should be able to be sent in from the original court and also registered with the new state and followed up that way. If a court had jurisdiction over the person and the thing they were doing then it is valid. The lapse of time would be the only issue there could be. Check with a lawyer in NJ first.

HI @Zahraa Check the rules where you live- if you are a citizen or otherwise eligible to get relief from the local courts and they allow for a change of name then you should be able to do it!

HI @Ariana That is a good question. The general rule is that parties who have a joint interest can bring an action together. As you are a family it would make sense to file it together- Depending on the rules where you live- could be "in re the change of names of the Jones family." Then set each person's request in a separate section or count. The worst that would happen is they say come back and do them separately.

Hi @xSimplyNoahx 18 years old to do it on your own unless you are emancipated. Under 18 can be changed by a parent.

Is there a way to keep the people you live with from finding out that you changed your name? I’m in an abusive situation that I am trying to get out of and I plan to change my name when I turn 18 but I don’t want my family finding out.

Hi @Star All court filings are public record unless they are sealed- but people have to go and find the filings to learn about them unless you tell them. Publication is usually required for these but again if the people do not know which paper - they won't likely learn.

Hi @Venture The costs depend on the paper and how many issues the notice is required to be published. The factors on what they charge per notice is the size of the notice which is determined by the letters or word count. You can just call them and ask.

Take your information with you to court- it would be best to have an attorney represent you who you can meet with in advance so that you have everything you need.

Apologies, I have one more question. I am ONLY trying to "CHANGE" my name on my Social Security Card. All of my other documents are in the name that I want. I have filled out the SS5 form (social security form), reason for change, Affidavit signed and recorded in county clerks office and so on. And I have been denied and was told that I MUST go to court to change it back to my original name. Any info will be greatly appreciated!😁

You may need to ask for clarification from the SS office. If you have already changed your name then you are just asking for your card from them to be made to match. Perhaps they have misunderstood.

It will depend on the local rules- they want to be sure you are not changing a name to hide from someone. The worst that could happen is that the name change may be delayed until any active cases are finished.

Hi same here I plan on changing my name due to it being passed down from horrible family members ( generational trauma ) my name never ever fit with me it always felt like damn lable when I was little I always put a gamertag name even on my private accounts like this one cause I just never liked my name here to say I'm proud of u for doing this step ! 😭 changing a name sounds so little but it's such an embrace of change !

So long as you are not asking for the change in order to trick someone that you owe money to- and you follow the procedures where you are - then all of the name change requests are granted.

You don't need a reason to change your name so no worries there. You would do this in the state where you are living. You can do it in Arkansas and then change your license etc and you will be all set when you move to Texas. Congrats on knowing what you want to do!

Hi xSimplyNoah There is not a rule that requires you to give a reason for why you want to change it or to explain the new name you are adopting. Your affidavit requires that you state whether you face criminal charges and if so you need to describe them. Then you state that you are not doing this to avoid any criminal charges or to avoid any debts or creditors or to defraud anyone.

Hi @Danielle Gender has nothing to do with name change- any person in the US can have any name they wish. People who want to change an official record of gender can that on their birth certificate.

The Court orders the name change- that goes to vital statistics and then you use a copy to change on all of your various things.

No- you will send a copy of the order to change birth certificate, drivers license, ss# etc. Some clerks will do that- just ask the attorney or the court.

HI @Keigo In the US adults have access to the courts- so a person 18 and over (or emancipated person) can ask for relief. For people younger than 18 they need to act through a parent or guardian.
