Are you confused about what to do when writing a legal brief in your family law case? You’re not alone. Family law motions are confusing, but in this video, using the IRAC method, I will help you learn how to write a legal brief and how to write a legal memo. The IRAC legal writing formula will help you whether you’re writing a family law motion to dismiss, family law motion for reconsideration, family law motion for contempt, family law motion to compel and more! Writing a legal memorandum is not that complicated if you understand the nuts and bolts of a family law brief. If you follow this formula, before you know it, you’ll be writing IRAC writing samples yourself (which are the same as CRAC legal writing samples). Legal writing in plain english is simple, straightforward and persuasive. When writing a legal argument or writing a legal document, if you use the IRAC format, that in and of itself will improve your writing, your argument and your position with the court. Before you know it, you might be sharing legal writing examples with your friends and co-workers who don’t understand the IRAC formula!

I have had to fight child support on my own for the past 14 years. My state was not doing anything within their powers to aid in collection for cs. So, I had to file motions and petitions on my own. I did not know about the IRAC formula, but I took a persuasive writing class and I have not had any issues. Today though, I am preparing for another hearing regarding child support where the father failed to disclose employment and/or changes with employment which is allowing me the opportunity to petition for retroactive child support back to when the fraud first occurred. This is going to be the biggest thing for my children, because we are talking thousands of dollars. I am here to polish up my skills on this 14 year battle. Thank you so much for all you do!

Omg, what PERFECT timing! Court really overwhelms me, and I am in a custody situation with a high-conflict co-parent. I have several issues that need to be addressed, and I've been writing and rewriting the issues that need to be addressed. This gives me the much needed structure I was looking for so that I can go in there confidently, with the relevant information presented in a clear, easy to read format. THANK YOU!

Thank you so much for this video! I’m currently writing a motion for reconsideration to vacate my settlement agreement due to fraud, perjury forgery etc. The evidence came out in discovery, but was not available to the judge when he made an interlocutory order to not vacate the agreement. I was frankly struggling for an outline for the past two days and feel like you are an angel delivering this information! 😇

Really helpful. I'd like an example though? I'm a non-lawyer, I'm a paramedic. Similarly I use a formal structure when handing over a patient to the hospital.

I'm going to use the IRAC formula. I filed a motion to modify parenting time because my ex was not doing overnights and sometimes a no show. Once I did that, he wanted the overnights. Now I have to go before the Referee. He's in a violent relationship with a girlfriend. It's a lot.

IRAC formula: issue, rule, application, conclusion.

Issue frame issue for the court. Number each 4 with roman numerals. 1 Issue: ex. Father should be compelled to disclose his medical records. Tried to get and was unsuccessful. 2. Rule of law according to statute: court must consider these elements. (Cases that support law in favor). 3. Application element. Applying the rule of law to specific jurisdiction in your case. Use law in your favor. Court needs to look at the records. You can't make a full and informed decision about this case without these records. 4. Conclusion wrap it up and summarize relevant point this is what I'd like you to do prior for relief. Order disclosure of these records.

I've filed several of motions in criminal court for both my father and I and I believe this formula might have helped but I can't count how many hours and hours of research I've done day in day out. Literally 24/7 for the last three years has been researching about every square inch of every relevant law, statute, etc. I think my case got to the point where my court appointed attorney was feeling like I was the attorney lol😅

I did not know about the IRAC formula. I want to make a disclosure and ask for discovery documents from a past arrest I can't seem to find. I also really want to give a brief overview for the judge prior to the trial. I believe your state calls it a Pre Trial Statement. Could you answer a Q.. what is another name for a pre trial statement another state may call it or use instead.

Hey, Wendy. I have an ongoing divorce procedure in Switzerland that has been going on for the past 2 years now. Recently, my lawyer emailed me saying that the decision has been forwarded and they'll send over my alimony via bank transfer to my bank account here in the Philippines as soon as possible. They also sent me a bill via email. My question is how long does this process usually take? My lawyer is quite difficult to contact since he's free legal assistance in Vaud. Thank you.
