Are you suffering from obstructive sleep apnea syndrome and hypertension? Recently, it has been widely accepted by the medical community that obstructive sleep apnea (OSA) is a risk factor for the development of hypertension, also known as high blood pressure. You may be among the more than 18 million Americans that have been diagnosed with sleep apnea, but may be unaware that you have developed hypertension as a complication of obstructive sleep apnea.
According to the Centers for Disease Control and Prevention, there is a high prevalence of obstructive sleep apnea among veterans. This may be because veterans are disproportionately affected by risk factors that lead to obstructive sleep apnea, like psychological distress, mental illness, and respiratory conditions. Many veterans, particularly Gulf war veterans, develop respiratory conditions, like asthma and chronic bronchitis, due to exposure to chemicals and other toxic substances. This makes veterans more susceptible to developing obstructive sleep apnea.
In order to better understand what this could mean for your VA claim, we must first discuss the relationship between obstructive sleep apnea and hypertension.

Anyone needing to file for Disability, this law firm is 100% the best. I had them represent me 15 years ago after trying on my own for over 3 years and being denied over and over, they took over and I had not only peace of mind but realized I couldn’t have picked a better team to be there for me. I had Ms. Carol Ponton, and her and her team made a tremendous difference in my life, Thank You Team SO MUCH........Deborahlee Edwards

"Their spouse makes them go for an assessment". That's literally what I went through. I knew I snored loudly since I was in my teens, but my wife noticed I would stop breathing at night. Unfortunately military doctors don't want to request sleep studies. I had to beg the doctor for one by telling him it would get my wife off my back. The results showed I have pretty severe sleep apnea.

Make sure to get professional help to submit your claim. This group sounds well informed, and i am not pushing any specific group to help you, BUT there are different fee structures for different groups. The one that is handling mine gets 20% of my back pay if i get an increase, which i have realized means that it is better for THEM if they take longer to get me a higher rating because the back pay would be much more. The one that I will change to once my appeal comes back actually gets 5 times the amount of the increase. Which if you just think 5 times is a lot of money, it is, BUT it is much less than the 20% back pay from 2 years of waiting or more. I would definitely find the best people to help you, But i would make sure that the fee structure is not taking more than is reasonable as well.

I was denied for sleep apnea (SA) (direct service & secondary to high blood pressure) I had a sleep study - 06/17/2013 - diagnosis my SA. Given a VA provided CPAP for 8yrs. they still refuse to grant me sleep apnea secondary to PTSD. I probably need a DBQ & medical nexus? any advise

Sleep Apnea: some pointers from my research: it needs to be ' ' Obstructive' ' Sleep Apnea. OSA is primarily caused by obesity. So if you are overweight you will need to make the nexus (connection) between your obesity and one of your service connected disabilities. For example, if you are SC for your knees from being a ground-pounder, you make the case that you your bad knees prevent you from exercising, hence the weight gain, therefore OSA is secondary to your knees bc your knees prevent exercise which caused weight gain which caused OSA. The same chain is valid for the meds you take for your other SC disabilities, provided a side effect of those meds is weight gain. It's rare that any of us got a sleep study on active duty, or had any idea that we should have got one to see if we had OSA. Hence the daisy-chain approach is your best shot. You will have to get a DBQ and Nexus letter from a professional who knows the drill on doing VA-Rating-Speak so that the VA doesn't deny you on a vocabulary technicality. When you get denied, go for the Higher Level Review. When the HLR is denied, get another DBQ and file a supplemental claim. My theory is the VA is going broke paying for all our disabilities so they do their best to keep the hole plugged in the dam.

Great Video. Thank you for all the knowledge you give us. However, one subject puzzles me. If I was diagnosed with sleep apnea while I was Active Duty. Also, If I conducted a sleep study , and issued a CPAP Machine while I was on Active Duty, will I still need to have an Event in Service like a Car Wreck to file a direct claim ? I have all the documents proving this. The only thing is that I do not have an event to name the cause. I just conducted a sleep study, got diagnosed, and issued a CPAP all while I was on Active Duty. Is that enough for a Direct-Service Claim ?

I'm hoping to get so help or guidance here. I am currently at 60% disability and trying to resubmit claims that was denied saying not service connected even though my military records clearly show I was seen several times over my career for these systems and still being seen currently. I have recently been diagnosed by VA as having Chronic PTSD, Major Depressive Disorder, Mood Disorder, Hypertension, Insomnia, and Sleep Apnea Syndrome, but but when I present this information to my DAV Rep, I'm told I need to get a Nexus Letter from the doctors to show how my systems are service connected, and my Rep don't want to file my claim until I get this connection. Has anyone dealt with this type of situation before, and can advise on how I'm to move forward with submitting my new claims?

Negative. When filing a claim it is often beneficial to have medical records from outside providers who are not associated with the VA, although in filing a claim the VA will likely request an exam even if you already have all of the medical records, it's just part of the C&P Process unless you do what is referred to as an "ACE" claim, which are becoming more common as a result of COVID lockdowns.

I was diagnosed with severe sleep apnea years after I retired, but now I seeking compensation for both. Served in the Gulf War and it's on record that I was exposed to oil fires in both in Kuwait and Iraq and no telling what other toxic fumes. It's seems from what I'm told the VA doesn't always play fair by denying compensation or at a low percentage.

How do they come up with which reading to use? Is it based on readings off medication or after you've been taking medication? Also, according to the 38CFR, the verbiage used is PREDOMINANTLY to categorize the criteria. Do they just take an average of the readings you submit?

i need clarification on how to read the CFR for hypertension in the M21-1III_iv_4_SecE the va defines hypertension as "Hypertension means elevated diastolic blood pressure is predominantly 90mm or greater." Isolated systolic hypertension: means that systolic blood pressure is predominantly 160mm or greater with a diastolic blood pressure of less than 90mm. but in the 38 CFR 4.104, Diagnostic Code (DC) 7101, Note 1. under 7101 Hypertensive vascular disease (hypertension and isolated systolic hypertension): it uses "Diastolic" instead of "Systolic" to define hypertension and isolated hypertension is this an error? if this is not an error how can one be following both the definitions of "hypertension" and "isolated systolic hypertension" in M21-1III_iv_4_SecE and also following the two criteria in the 38 CFR 4.104, Diagnostic Code (DC) 7101, Note 1. , if we were to use the criteria in the M21-1III_iv_4_SecE isolated systolic hypertension then "diastolic Blood Pressure" should be "LESS" than 90MM but if we compare that to "38 CFR 4.104, Diagnostic Code (DC) 7101, Note 1." then "DIASTOLIC" needs to be "predominantly 100 or more" which would take us out of the original defintion of hypertension, i believe the use of "diastolic" in the note 1 is an error, could anyone clarify this???

How do I convince the VA that my sleep apnea and hypertension is service related? I was discharged in 1979. I was diagnosed in the 80s. I did not know the symptoms in the 70s but I definitely had apnea while I was in the Navy. The VA has denied me . How do I fix this?

I get 60% disability rating for BP and lower back AND OBSTRUCTIVE SLEEP APNEA issues upon discharge from active duty. I was given 10% for my BP. In November 2019, it was found that my BP stayed at 210/100 without proper meds. Furthermore, it was found that my cortisol level was so high that my meds had to be changed to get my cortisol levels down. I had to got thru surgery on my adrenal glands which was discovered at that time that my glands were producing too much cortisol and the other hormone that the adrenal gland produces (can’t remember the hormone name). When I went to review my medical record for the purpose of getting a higher disability rating, I was denied an increase for the BP. My rating did increase due to my back problem to 80%. My question is: should I be able to get a higher rating for my BP due to these hormone imbalances?

Are there different ratings for Central Sleep Apnea with an ASV?
@HillAndPonton
@HillAndPonton 3 жыл бұрын
Hi Aaron, yes, it is possible to be rated for Central Sleep Apnea. Just as a Vet might be rated for Obstructive Sleep Apnea, they can also be rated for Central Sleep Apnea with 0, 30, 50, or 100 percent rating depending on the severity of their condition. Thank you for watching!

@HillAndPonton
@HillAndPonton 3 жыл бұрын
Hi Tiffany, the answer is that it would depend on many variables. For help regarding this and the information you would need for a claim, it would be best to consult a Veteran's Service Officer or Veteran's Advocacy Group. We do have a great blog on this subject that I have linked here www.hillandponton.com/how-the-va-rates-obstructive-sleep-apnea/

@@HillAndPonton I have a family member who was diagnosed with hypertension during the military, but sleep apnea not until 25 years later. He filed a claim for sleep apnea from awarded depression, but it was denied. He had a buddy letter speaking of the symptoms you mentioned, and that it started in the military, but still his claim was denied. Should he resubmit for the claim of only sleep apnea as the main claim, then hypertension as secondary? His doctor is confused how to link the sleep apnea to his active duty time. Thanks.

Allison, This is discussion is mostly process related to "ratings". I would like to know how most vets get sleep apnea. I FEEL I KNOW HOW I GOT IT I was classified 11B (light infantry in 1966) In Vietnam I was assigned to the 173rd Airborne. Our daily routine was 4hours guard duty concentrating on being alert for different noises outside our perimeter. After that it would be 8 hours of "attempted sleep". All the while listening for VC trying to crawl under the wire. It creates a ultra-alert sensitivity. You don't get DEEP SLEEP at all. .....do it 365 time's in a year and you are conditioned to sleep very light, or in my case not at all, a lot of times. This pattern has been with me for 50 years and getting worse

Unfortunately with the VA things are rarely simple however if you believe your sleep apnea is related to your time in service then you should consider speaking with them regarding service-connected disability compensation.
