Batman will probably always be my favorite superhero, but I do have to concede that Spider-Man has a better origin story. Batman's origin is passive, whereas Spider-Man's origin is active. That is to say, Batman is created because something beyond his power to control was done to him, while Spider-Man was created because he actively chose not to do the right thing when he had the chance, and it came back and bit him in the ass. For me, Spider-Man definitely has the better origin story.

When it comes to Marvel and DC, you think of their best characters. When I think of DC’s best characters, I think of Batman and DC’s villains.

Spider-man is the definition of a true hero Batman is also given way too much credit. They literally make him way too strong. Doesn't anybody question what Bruce Wayne does with all the tech he buys. Spider-man inspired many heroes and even changed many villian to the good side. Though the "Origin Story" should have been a tie, most of the rest were pretty close (even considering the questionability in saying batmans rogues gallery is bigger) I'd say as far as main baddies go, I'd lean towards Spidey, mainly because Goblin is basically a cross between Lex Luthor and Joker,. (Also Spidermans rogues have a lot more deadly lunatics and sociopaths in it.) Except for the reasoning given, i'd almost agree with the last one. *If you want to go with direct to video releases.* Going by strictly cinematic releases however, it's a different story; They both put out 8 movies to theaters, with the Batman Franchise earning *$4,424,900,000* in total box office, and the Spider-Man franchise box office coming to *$5,228,300,000* (totals tallied from google, also none of the separate totals have been adjusted for inflation) Plus it's somewhat arguable, but there *is* a case in saying that there are also more,*good,* Spider-Man movies. :-)

Origin: spidey was responsible for his uncles death, Batman was just a witness. Rogues gallery: green goblin practically ran spidey’s life behind the scenes on multiple occasions. Also, who else but spidey has taken on a team of their greatest villains?

Spider Man should have won based on the most important category which you didn't mention which is conviction rate. Batman's suspects would be let go or at most charged with trespassing, as most if not all the times the cops showed up, Batman was gone and never really left any proof of the crimes they committed, nor is he willing to go to court to testify except in the 60's version, and as a master of stealth to thwart the crimes he need only arrive and set up hidden cameras with high res to record the evidence of the crimes and present it to the police for them to actually arrest and charge them. Instead he often commits more crimes than the criminals themselves: He uses fear, so terrorism as a tool. Assault and battery as he often attacks before the suspect. Excess use of force, and use of lethal weapons, and he is a trained lethal weapon himself as a master of martial arts he rarely warns most suspects of his true capabilities before he assaults them, which could lead to charges of manslaughter and attempted murder. Mental and psychological torture has been utilized for information many times. He uses his detective skills at times to be at the destination before the suspects so all those assaults can be criminally branded premeditated. Breaking and entering, theft, disturbing the scene of a crime, obstruction of justice for all the times he took evidence from the scene of a crime which is then tainted so inadmissible in a court of law as chain of custody cannot be established so even if he returned the evidence that he used to catch the suspect, making it good enough that the cops could have used it to do the same while building a proper case that could result in a conviction. He doesn't even wear a body cam to submit that footage to prove both the crimes or even the injuries suffered by his victims were in self defense or not, making him liable for damages and and injuries caused, not to mention destruction of property which was often a result of the many fights which only happen because he was there. This is why the main gallery of villains ends up at Arkham Asylum not for crimes they committed but more so their mental states as threats to society. In most situations of stress which may endanger others he often antagonizes the suspect or raises the criminals stress levels which often results in more destruction, injuries or deaths, due to the criminals feeling trapped and giving them no way out other than escalating or executing their plans and as these people (the suspects in Arkham Asylum) are mentally ill to the point of institutionalization it means technically they aren't even responsible for their actions and they tended to escalate their actions as his existence alone would create a sense of paranoia and anxiety amongst all of Gotham. His motivations are unclear as well as his criteria for selecting the suspects, as he assaults the security of some suspects who's only jobs (key word Jobs) are to protect said person or property meaning he is willing to assault criminals and non criminals alike simply based on association to mentally ill patients some of whom he drives to insanity simply by always showing up or letting them know he's watching which pushes them past their breaking point, and then just drops them off at Arkham like garbage on the curb. Simply think of all the times he could have stopped the Joker by simply laughing and he doesn't which gives Joker a purpose which is to make Batman laugh, but Joker also knows that in order to get the Bat to show up for a performance he needs to constantly up his game just to get his target audience to appear, that's the only reason, if he knew Batman would show up at a comedy club to hear him perform and laugh at his jokes good or bad he would do that instead. Harley Quin only falls to a life of crime because she is treating the Joker who corrupts her only so he can escape to perform for the Batman once more, making Batman the cause of her downfall and that's only one of many examples. He only commits the crimes for Batman attention and Batman is so Mentally ill he doesn't even realize the Joker is just trying to get him to loosen up before he snaps like himself. People fall into crime more often due to circumstance than desire, and Batman may desire cleaning up crime to the point of obsession and compulsion even at risk to his health and the health of others and a complete disregard for the effects of his actions which as the Joker points out means Batman should be in Arkham as much as he should; simply because Joker sees that with all the money batman spends on all the toys and gadgets he uses if he gave that to the poor or spent it creating affordable housing and societal improvements, or Job creation, or focused his skills on the white collar crimes, slumlords, or other non flashy situations it would reduce Gotham crime rates far more than any actions he takes as Batman. Even as Bruce Wayne he seems philanthropic but for all the times we see him being charitable he still lives in Giant Mansion with 2 other people on an immense estate grounds which could house so many, and improve so many lives but only lets one person in other than the butler. As the Batman he is more of a menace to society than the suspects he investigates, and will rarely be cheered or respected my those he wants to help as they see a brute who obviously has ton of money who is doing this all for kicks and they know the revolving door his actions cause as they see both Big and Small criminals released due to lack of evidence or escape but instead of fleeing and disappearing they return to get revenge on him or to inflict more suffering on those they were originally focused on because they are aware of his modus operandi and realize they will most likely walk out of jail due to the evidence or lack there of or witnesses or surveillance footage. Violent offenders tend to escalate in aggression and violence when they know they can get away with it, or the punishment isn't a deterrent, making all lives they touch worse. Spider Man is the only superhero who would take Photo's or video of the crimes in progress (don't even get me started on all those with invisibility or hyper speed capabilities like the Flash, Superman, etc who never record video or photo evidence of the crimes) or would subdue the criminals, with either witnesses to testify as to the crimes or would include the evidence and his testimony of the crimes he witnessed and did this for big criminals and small. Spider Man never sucker punches or initiates combat without first letting the suspect know he is there and giving them a chance to potentially walk away before they commit the crime or will use his webs to catch them in the actual act of committing the crime without using violence or physical force as that is saved as a last resort as he knows he can hurt people with his powers, and will give the assailant multiple opportunities to end peacefully before using physical force, and even then will revert to subduing them over violence give the chance. He will often ask the motivations of the suspect before the potential crime is committed to find resolutions as he knows that having a record can ruin a persons life be it from a minor crime to a major one, he also realizes people act out of emotions a lot of the time, or mental health issues and knows that they may not be in control of their faculties. He even tries to alleviate the stress and deescalate the situations with humor when he's in a volatile situation that may threaten others lives and will try to talk the criminals down. He tries to obey the laws as he realizes the difference between being a hero and being a Vigilante is using the rules of law as your guild, and he is aware that criminals only go to jail with proper evidence, testimony, eye witness accounts, and video and photographic proof, hence most of his captures result in actual jail sentences, or proper mental health treatment or even full deescalation without a crime being committed. He can show himself in public because he has a clear conscience and record. He is respected by the people because they can see his motivations are pure as he is only wearing his suit and swinging from a web making him local and as such relatable. His local actions also help to improve the neighborhoods and as he is local he patrols the area regularly and knows first hand what it's like to live there and be of the same tax bracket as those he protects. His main Nemesis is Jay Jonah Jameson an editor who is constantly trying to portray him as the Vigilante that Batman actually is and he is also the only one who is truly obsessed with him, which intern keeps Spider Man in check as he knows Jameson is always looking for a reason or evidence that will unmask or put Spider Man away for ever. Making JJJ the equivalent of Jiminy Cricket keeping Spider Man staying on the right side of the law doing good. This is why Spider Man's Villains have to escape more often from prisons than mental institutions and why Spider Man should have won.

I completely disagree with Batman having a stronger origin than Spider-Man. Yes, Batman is driven entirely by a childhood tragedy, but Spider-Man's tragedy was entirely his fault. Bruce Wayne was completely powerless to prevent his parents murder, but Uncle Ben's murder was one that Peter COULD have prevented and had to face the hard reality that with great power comes great responsibility.

Always thought Spider-Man’s origin was more powerful simply because he very easily could’ve prevented his uncle’s murder. His credo is “with great power comes great responsibility.” But, realistically, it’s less about responsibility and more about a crushing, all consuming and always present sense of guilt. Guilt due to an easily avoidable tragedy that shattered a family and completely derailed a life which could’ve gone on to do greater things than swing around NYC in long underwear. Batman’s origin, on the other hand, doesn’t have anywhere near that kind of stopping power. Yes, him bearing witness to his parent’s murder is tragic. But, at some point afterwards, Wayne should’ve been able to come to peace with this. That point should’ve come well before he took on a dual persona. The fact it didn’t doesn’t make his origin more powerful. It just shows that he belongs in Arkham and has for a long time.
