Brutus v. Publius: The Fight Over the Judiciary

Before the United States Constitution was ratified, the Founding Fathers famously debated the merits and problems of the newly proposed government in a series of public essays that came to be known as the Federalist and Antifederalist Papers.
In this animated documentary, Professor Charles Kesler of Claremont McKenna College and Professor Gordon Lloyd of Pepperdine University discuss the insights of the anonymous authors, “Publius” and “Brutus.” In particular, Brutus, the Antifederalist, voiced prescient concerns about the power of the judiciary despite Publius’ assertion that it would be the weakest branch of the proposed government. Are the insights from both Publius and Brutus still relevant? Was Brutus right about the courts? Should we share Publius’ optimism about “ambition counteracting ambition”?

I'm in process of reading the Federalist papers now. It amazes me the insight these great men had into every aspect of governance. Federalist 10 is a perfect understanding of todays political climate by people so long ago. Activism on the bench is real and there needs to be able to have review of the reviewers.

I've been reading the Federalist and Antifederalist papers. The Antifederalist's predictions were, unfortunately, spot on. We should have left well enough alone. The loose alliance of states would have sent $$$ to DC if it was ever truly needed, such as to defend our lands from attack.

There is another Brutus, who was co-consul with Publius when the Roman Republic was established. It’s more likely the author meant this Brutus than the later one who assassinated Caesar and had little to do with Publius. Interestingly, Publius gave more power to the Roman people as consul, while the Federalists argued for more power in the central government.

But what if State governments start vilolating citizens' rights in place of federal governement? Isn't it what we see in commiefornia? Citizens' rights supersede all the governments whether it's state, federal or local.

I can’t help but feel we came so close, and yet with Brutus’ warnings not heeded, ended up so far away from what the US and constitution could have been. Maybe this is what Unitarian federalists wanted, but we now live in a world where even the Second Amendment is trampled by the judiciary, the constitution is not at the forefront of any discussion. Shall not be infringed could not be clearer, and yet, infringed it has become. The 4th Amendment is effectively dead, with rampant civil asset forfeiture, when probable cause has become a farce, and the government spies on its own citizens en masse under the pretext of protection. How did we get so far away from the Declaration, which when you read today you can imagine being rewritten with the complaints of modern citizens and applying just the same? Was this the intent? Is this good intentions gone awry? I can’t help but feel it did not have to be like this, but I’m not sure this is a ship we can right at this point. The average American cares not about their liberty to a remotely comparable extent that they care about their illusion of safety. Even if they did, what of the federal government is truly beholden to the people? I wonder if it is too late for meaningful change.

The only way to right the ship is a dissolution of the Union. Let’s go our separate ways.

The very idea that the judiciary can use their opinion of the Constitution is a direct violation to PRESERVE,PROTECT and Defend the Constitution. Every word was already debated,voted and ratified as the Supreme law of the Land! Their duty is only jurisprudence of said Constitution! Period!
