You received a DUI! Terrible experience. You sat in a back of a police car and was taken to a cold jail. You were searched, fingerprinted and photographed. It was a miserable experience. Police offices treated you unfairly. You are not like the other people in jail. You are a good person. You work. You pay taxes. You have children. It was a mistake. Now your want your lawyer to have the charges reduced. So what you blew over the limit. You re not a criminal. These laws are ridiculous. DUI classes and follow up treatment is ridiculous. You don't need that. Your license was already suspended for 6 months by DMV. This is crazy! Now they want to give you probation or put you in jail. They want community service hours. A lock on your car (immobilization). They want an ignition interlock device so you will have to blow into the device to drive the car. What is this madness? You are a good person so can't they just reduce the charge? Why can't your DUI be changed to a reckless driving? You did not kill anybody. You did not hurt anyone. Those machines mess up all the time. Your friend's sister got her case reduced to a reckless driving. WHY CAN'T MY CASE BE REDUCED FROM DUI TO RECKLESS DRIVING? Make it happen!

1st dui (no prior offenses) no injury no damage. researched requirements for diversion program in palm beach county (tier1) and i meet all them. how likely is it to NOT get accepted.

Drunk girl hit my car(tap...no damage or scratch) while I was parked and getting my phone. She preemptively called the cops and said I hit her vehicle. I figured what she was doing and waited about 35-40 ft. away from my vehicle. I was cooperative with "crash investigator" who suggested I get an uber and fight the ticket. When I asked if I was free to go, another officer that had been standing next to the crash investigator said "No, you smell like alcohol, you can get an uber after you finish a field sobriety test." Then he said "Im switching over to a DUI investigation." To my knowledge,(please correct me if I'm wrong..)all citizens have immunity during a crash investigation, and the officer made a mistake by admitting he used evidence gathered while I had immunity, therefore, it may be likely that a motion to dismiss will be granted. I also read that because no officers saw me in, around or near my vehicle, that they would need a warrant signed by an judge to arrest me. Is there ANY truth to my aforementioned statements?

well we all know there are stupid people and the same goes for police there are stupid cops. To establish dui officer needs actual physical control and signs of impairment. Accident and odor of alcohol are not sufficient for conviction of dui. I can only speak to florida as I practice across the state of florida

Wreckless driving gives you the same punishment as a dui. You gotta get a interlock system, do community service, drivers license suspension, have your car immobilized, take dui classes, and etc, you dont get convicted of a dui though but its practically the same punishment

that is true to some extent. Its tru most of the time. However, I have had charges changed to reckless driving and client simply paid a fine of under $400 and received a withhold with no dui classes, no community service etc. Obviously, depends on facts. Each case is different.
