Yes-- it is almost impossible to protect children from an abusive father through the courts. A parent can be an absolutely HORRIBLE parent and still have custody of the kids.

I am not claiming that false accusations are MORE of a problem, but when the frequency of accusations being false becomes as high as it is today, you can't be surprised when people's initial reaction is skepticism. blindly believing the word of anyone accusing another of such a crime without proof beyond a reasonable doubt is immoral.

I don’t know how these DV judgments typically work so I could be wrong, but if her ex has DV charges and 2 bankruptcies, why does he have primary custody of the kids? I don’t think she is telling the full story here.

He has partial custody or secondary custody. The mom has the primary custody. That's why the trust and all. If he was capable of managing money; then most probably the trust wasn't required.

Sarah is very smart to address this now. Too many people procrastinate or think they don't need it until they're old but you never know when you're gonna go. Car crash, serious illness, DV......could happen tomorrow. She might talk to a lawyer also about making her parents the guardian without waiting for him to hurt them and his parental rights severed. Dave was cautious to say much about the DV but being responsible for two young ones when you've already demonstrated impatience and disdain for a human being sounds risky to me. Once an abuser always an abuser I don't care how many therapy sessions you've had.

So, he's horrible with money and I'm also suppose to believe he's been convicted of DV yet he still has FULL CUSTODY? Rare but possible. Or, she has some issues as well. Nevertheless, definitely smart to get life insurance. I feel for kids caught in between this mess.

There is always a second side yes but as the man he is responsible for his actions if he gets with a bitch and he catches her cheating and he smacks the shit outta her because he has anger issues it’s his fault for not getting help for his mental health and it’s his fault for choosing that bitch to have his babies. All a woman needs to do is call the police and say she was attacked, and the man would be at fault, even if she was the one who was abusive and he never laid a finger on her. A judge would give her primary custody on this police report alone, and call this evidence.

I like this advice but I think that Dave should make this modification: don't make the trustee for a trust held for children someone who could have custody. My wife and I did this because we didn't even want the temptation to be there for a guardian to draw from the trust for their own purposes instead of for the children. We just had too many horror stories in our family where someone bad with money manipulated a situation to get money they shouldn't have.

Literally, the most important choice you’ll ever make isn’t what activities you do in high school, what college you attend, or even where you buy a home. It’s who you make babies with. My guess is that there were red flags about this guy that she ignored. Now she’s a single mom with a completely unreliable BD and the mental scars of DV (obviously only on her word, I lean towards believing that happened). Her life is hard mode for at least another 13 years.

@hornetguy9063 Totally agreed. Trouble is, rarely are we taught at a young age what love really is and how to actually decide who to marry. Too often we simply get horny, fall in love with someone, and decide to make a life-long commitment on the basis of those very temporary emotions. Little wonder then that this country's divorce rate is as high as it is.

I know someone who was in this situation they want the father to be in the children’s life as long as he doesn’t harm the children. So they won’t allow you to move. They ordered my friend to not move out of the state of Georgia or she would be arrested. This is a typical situation

For the father to have full custody, the mother has to be an absolute train wreck. The courts side HEAVILY with the mother when it comes to divorce custody. Something doesn't smell right with this call.

Not buying the DV allegations. Women always go there when they don't want to be honest about why they got divorced. It's rare custody goes to the father. She must really be messed up.

I’m guessing she has primary legal custody and he has the children half of the time. Judges love 50/50 custody. I do believe the judge feels that since he only abused the wife and not the children, he isn’t a danger to the. It’s messed up but that’s often how they rule. Be careful who fathers your children. Bad men don’t change.

She never said DV convictions, she said issues. There were some supervised visits so they were watching the kids carefully. The easiest custody is 50/50 if both agree and doesn’t sound like she fought for full custody. But maybe he has partial custody. Why did people jump on her??

The caller needs to work with an attorney on this, NOT an online form service. This is too important to take the gamble of that going work. Trusts and estates are what I practice as an attorney. I see problems with these cheap online options all the time. Just DON'T do it.

I know this sounds extreme, but hear me out.. Imagine if there were laws on the books that prohibited marriage and having children until you are "approved" by the law. Meaning, you have to provide similar documentation as getting a mortgage...2 years of W2s, 2 years tax returns, last 2 months of bank statements, etc etc. You would be approved once you show that you can support a marriage and raise children without ANY financial help from the government. Sounds crazy right?! But I guarantee that child poverty would literally end in less than 5 years from enacting it. Which in turn would either end or DRAMATICALLY reduce the murder rate, the homelessness rate, the mental health rate, the pollution rate, the unemployed rate, literally everything!

Spoken like somebody who has never seen a full episode before. You have only ever seen highlights. Otherwise you would know that each day there are two hosts on and those two hosts have to take the call. There is no opportunity to find the person whose expertise is best suited to the call. If they're not on that day, too bad.

You have no idea how gynocentric the family court system is. So if she is truly a victim of DV and the court STILL gave custody to the father, WTF kind of danger and dysfunction is in her life. Remember, the standard of review for custody is what is in the best interest of the children. So for a court to award a batterer custody over mommy, wow - just wow. @@TonyCox1351

This is a typical situation they always want the father in the children’s life even if you have a restraining order against them which you need proof of abuse in order to get which my friend had they still made her stay in Georgia and he had partial custody.

The trustee need to be no one else other than her parents if she passes away while the children are minor. Any other person can be influrnced by the ex-husband which may lead to major issues.

There are two sides to every story, and she never said what her relationship was with this man, if he was her boyfriend, fiancé or husband. There's a reason why he was awarded full custody of the children. If he has a history of domestic violence charges, and experienced numerous financial problems, the court would not have awarded him full custody of the children because, he would've been founded as an unfit parent.

The father does NOT have full custody. He gets visitation essentially.

@@slimdude2011 No, she stated the father has custody. She did not say full custody. For example, if one parent keeps the kids 6 days a week and the other keeps them 1 day a week, both parents "have custody." That's called "joint custody." The mother has custody. The father has custody. Custody just means they are legally required to have access to see the children unsupervised. If someone does not have custody, it means they don't see the kids unless the custodial parent allows it.

I don't believe it for a second. Women receive preferential treatment in family courts and there's almost NO way he would get custody if he was truly abusive. The court would not trust him with children. If he, a man and thus STATISTICALLY almost certain not to get custody, actually has custody, it almost certainly has to be something about her that is a threat to them. Nope, I think she's lying.

They always get some kind of custody my friend had a restraining order against a guy which you need proof of abuse in order to get btw and he still got partial custody and she couldn’t move out of the state

What could he say that changes Dave's advice? Regardless of who my ex was or what they were like, I would STILL set up a trust as my life insurance beneficiary, where there is a trustee who ensures a monthly child support allowance is provided out of it, and the kids get what remains at age 30 or something like that. So I'm not sure what side of the story Dave needs to know to advise that.

You've got to be hella toxic to be a woman and not get custody of your kids. Evidently the judge thougt the kids were in more danger with her than they with their "domestic abuse issues"- having father. Women like this make us all look bad so I will call it out.

She did not say she doesn't have custody. She just said that he does still have custody. So they both have custody. Meaning, from the sounds of it, that the kids stay with her the majority of the time and with him some of the time.
