I believe his point is that freedom of speech can only be defined by an absence of suppression; it doesn’t have an existence unto itself.

It isn't, it is that its positive content is merely a matter of decisionmaking (power).

That's called word-bending, a lot of Hegelians and Marxists are really into it. You use the dialectic to transform an idea into something it isn't. When people refer to "freedom of speech", they are not referring to either freedom of speech as the positive contents of something actually said, nor to the absence of suppression. The entire argument is a false construction, because "freedom of speech" refers to a specific constitutional right, in the US at least. Freedom of Speech isn't any particular thing said, it just refers to the actual right as enumerated in our founding legal documents. That is how it is defined. That is the positive component of its definition, the concrete, written text embodying one of our individual rights, that being the first amendment. Thus, freedom of speech is not actually a linguistic concept, or a historical one, it's a political concept.

What is this blathering? Free speech doesn't exist because "free speech has no positive content"? "There is no way to force you to think that one thing is more free than another"? Free speech "is just a mere absence of constraints thing [i.e. negative freedom], but that doesn't mean too much for us"? I think Mr. Snel is confused. He defines free speech in terms of negative freedom, which I believe is correct, but what he's arguing against is the idea of free speech as a positive freedom (i.e. a misguided idea that freedom somehow involves self-realization and the opportunity to fulfill one's own objectives; not just the absence of external constraints, but also absence of internal constraints). We can meaningfully say that free speech is speech in the absence of external constraints, and that this type of free speech exists. Of course, if there are no constraints then one expression is no freer than another one (maybe he meant that there are always some constraints in society, but there might be fewer for some forms of speech than others, therefore they're freer? I have no idea what this guy is on about). This man's confusion is so profound that I can't even see what he's talking about.

It is possible that Johan Snel's argument explores the idea that while individuals may have the right to express their opinions, there are societal, legal, and ethical considerations that come into play. This perspective emphasizes the importance of responsible speech and the potential consequences that can arise from misuse or abuse of this freedom. Just kidding It is not 🗿

You are naive if you think that you can literally say whatever you want without consequences. Just because you won’t be executed by firing squad that doesn’t mean that there aren’t consequences to speaking outside of the cultural norm in the United States, and I am not referring reputational damage done via speech. You can lose your job, get put on the no-fly list, be doxxed, etc. We are not free. Disclaimer: I am not even talking about saying fire in a theater, or any other nonsense argument like that. I understand that.
