As an attorney, I want to just clear something up. Asking the court to dismiss for lack of jurisdiction is NOT the same as asking the case to be dismissed and finished forever. You have to sue a defendant,here Logan, in a jurisdiction that has personal jurisdiction over the Defendant per our constitution. You can’t sue me anywhere just because. Ex. I hit wade’s car with my car after a wild night in Vagas. Wade lives in Tennessee . I live in Georgia. Wade decided to sue me in Tennessee. I have every right under our constitution to ask for the case to be dismissed for lack of personal jurisdiction. You can’t sue me in a state that doesn’t have jurisdiction over me. So even if the Court grants the motion to dismiss, it doesn’t mean the case is over. Wade can sue me again in a court that has personal jurisdiction over me. Asking the case to get dismissed for lack of personal jurisdiction simply means plaintiff you picked the wrong court to sue me in, not that I didn’t do anything wrong. You can refile the case in any court that would have proper jurisdiction over Logan. It is MUCH more complicated than this. There are literal law school exams based on fact patterns similar to this. But I’ve tried to keep it simple. I am not a Logan fan. I don’t dislike him that much either. If I was his attorney I would advise him to put a nice chunk of change in an escrow account to cover all the losses and say look we have the money to pay it, but we need to reach a global settlement because I can’t die by a 1,000 cuts with legal fees. It isn’t unreasonable from a legal standpoint to wait and try to resolve it all in one go. Also, I looked at the docket. The case is set for mediation. Hopefully they reach an amicable settlement and move on. It is something that has been said incorrectly by numerous KZfaqrs. I figured I’d help to shed some light on it. I love the scene.
