8 жыл бұрынYesterday a grand jury refused to indict the police officer involved in the killing of Tamir Rice, because the prosecutor threw the case to help his political career. But Ohio is an open carry state… Cenk Uygur, host of the The Young Turks, breaks it down. Tell us what you think in the comment section below.
"Last year, police officers in Ohio shot and killed John Crawford in a Walmart in Beavercreek, and, in a separate shooting, 12-year-old Tamir Rice outside of a Cleveland recreation center, largely on the belief that Crawford and Rice were carrying real guns. Grand juries have now backed up the officers, deciding to file no criminal charges against the cops involved in the two police shootings.
Crawford and Rice were carrying toy weapons, but the killings have sparked questions about why police were allowed to shoot two people for holding what appeared to be actual guns in a state where it is legal to openly carry them.
But legal experts say that open carry laws and the laws that govern police use of force don't really have much to do with each other. Here's why...
However, the open carry laws have little to do with whether a police shooting is justified, experts say. As attorney and gun rights advocate David Kopel explained, police officers wouldn't be allowed to shoot someone just because he's wielding a gun where open carry is a legal. Under the two Supreme Court decisions - Tennessee vs. Garner and Graham v. Connor - that dictate police use of force, officers must show that they had an objectively reasonable belief that a suspect was a threat up to the moment the last bullet was fired. ”*

what trips me out the most is that everyone who defends the cops who shot Tamir Rice always say well the 911 caller said rice was pointing the gun at people, but never seem to remember that same caller also said he though the gun was fake.

+Jesus-Pierre-Miguel Salgado III It's not worthless when someone is executed likely due to that omission. The 9-11 caller repeatedly emphasized it looked fake and like a toy, just because someone isn't an expect doesn't mean that the omission of that opinion did not change the tactics and decisions the officers made. If the dispatcher relayed that you were speeding down the highway with a woman screaming in the rear without telling the police your wife was in labor, it makes a difference. Their actions were most likely very much impacted by that omission. Would they have pulled their weapons instantly? maybe. Would they have possibly questioned the young man about the weapon before opening fire? I would bet they would have.

Tamir Rice didn't have a chance nor the time to drop the toy gun. The cops started shooting him as soon they got out the car. I watched this video and others in slow motion. There wasn't even enough time to say "Drop it or we will shoot. " The family deserves every penny from the City of Cleveland in that $6 million settlement. This was murder.

Im wishing there was a place we could go where we would just be safe to walk home, or down the sidewalk without having hatred pull up in a cruiser and murder us based on what we look like. He is also pulling shit out of his ass when he talks about the 2nd amendment and militias being there to suppress blacks. During the civil rights movement the 2nd amendment was a huge benefit, look up the Deacons for Defense. Also it may surprise you to know that the NRA was founded with the express purpose of arming freed blacks and teaching northerners how to shoot, and they opposed the first gun control laws which were proposed in part to disarm blacks. That said shooting that kid was indefensible, but rather than blaming racism, I blame the shoot first curriculum that's used to teach cops today. I've had run ins with black cops and white cops, and i don't see a difference in how they act. The problem is that the police no longer have any idea how to deescalate a situation.

They belong in jail.. if they were startled and “had to react to defend their lives” due to having been in that situation where pulling a gun and shooting was required to defend their life, it was their own fault for pulling right up to him, instead of on the road, giving them no time to react - they should be charged with murder and serve the amount of time people get for shooting cops because THEY KILLED A KID FOR NO REASON!! Whether the criminals are 15 or 45 years old... We literally cant hold police to a life or death situation because they're making (basically) minimum money to protect our/their lives. I could understand if they were taking NBA contracts and "my personal family is at risk" .... It may be worth reminding people that the second amendment applies to black people too... i mean what is the NRA going to do? It would be hilarious... Incidentally i recall that the NRA started up around the time the the KKK got banned as a terrorist organization (though the newer iterations obviously are not classed that way though that may need a revision as things are going if you ask me :p)

He wasn't breaking the law. Even if it is an open carry state, he was "brandishing" if it was real gun but it was not a real gun. Tamir's death is still the police's fault. My friends and I had a big debate about this early.

There was a game we played as kids that we called "Guns." We took it very seriously. We had a massive arsenal of toy pistols, shotguns, rifles and machine guns that we hid from our parents because we broke the orange tips off or painted to look more real. Looking back, it had to seem pretty shady, a bunch of boys sneaking around the neighborhood with authentic looking automatic weapons waiting for the opportunity to "POP! POP! POP!" each other. If you think for a second that back then in my white, suburban neighborhood, that a cop would have rolled up on us, despite what we were doing, and gunned us down in 2 seconds flat then you're kidding yourself. If you think that's reasonable then investigating this case further won't help you, you're already too far gone. If you're a real human, on the other hand, then it is your duty to act and speak out against #nojustice for Tamir Rice.

There's a huge difference between carrying a weapon and brandishing it. From the 911 call: "He's pulling (the gun) in and out of his pants and pointing it at people." Though the caller also said the gun was "probably fake," this was never communicated to the officers.

Are we forgetting it was a toy gun, and on top of that the boy dropped it. After it was dropped was the boy still a threat? This would have been the tipping point for me as the father. No court of law could and would contain me. These cops would not be able to walk around while my child is in a casket. That's how you show Black lives matter.

But I say these police officers need to be charged with the same crimes as the citizens of the United States who isn't wearing badges. +rockethead555 It is a valid point. They show pictures of white people carrying guns in public and say, "What about this person? What about this person? What about this person? Why didn't the police gun this person down?" Well, they all had their weapons properly holstered. Open carry doesn't mean that you get to have your weapon in your hand at the ready at all times. Even open carry states have laws regulating when the weapon can be unholstered and brandished, and failing to acknowledge that is either ignorant or deliberately misleading.

The point of this specific thread was that Cenk points to examples of white people that are open carrying with their weapons properly holstered and then tries to equate that with black people that have their weapons (which turn out not to be real) brandished in their hands. Open carry laws generally do NOT allow you to brandish your weapon in public. It must be properly holstered. So pointing to open carry laws in these cases is either ignorant or misleading. Based on Cenk's previous videos, I'm going to lean towards misleading.Second, I agree with what you are saying in principal and I think both of the incidents that are discussed here were handled terribly by the police; however, I completely disagree with the notion that there is no reason for the police to fire upon an individual that has not fired his weapon. Expecting the police to wait until they are fired upon to return fire is completely unreasonable. If a person has a weapon in hand and is behaving in a threatening manner, then I have no problem with the police gunning that person down. The problem that I have with both of these cases is that the person that was gunned down never had any opportunity to put their weapon down. The police ambushed them and fired on them before they had an opportunity to really even know what was going on.

This video, however, was about how white people can open carry but if black people open carry then they get gunned down. That argument is ridiculous. Or at least the way the argument was presented was ridiculous because the white people that are used as examples have their weapons holstered in a legal manner whereas the black people that are used as examples have their weapons brandished in an illegal manner. Now it turns out that neither of those weapons were real, but the point remains. Open carry laws had nothing to do with either of those incidents because open carry laws do not allow you to brandish your weapon. You can say that your point has nothing to do with race, but the whole point of this video was that white people can open carry but black people can't, and that is a ridiculous argument.

I can't tell you how many of my FB friends lost their minds over: 1) Michael Brown being a "thug" (what he allegedly did in that store, roughing up the owner, was wrong, but did it call for the death penalty, without benefit of a trial and conviction?); 2) Trayvon Martin being a "thug" (because of the way he dressed and having smoked marijuana... again, not death penalty); 3) any black person shot or killed by police who should have "just followed orders." Some of the comments make me seriously wonder how they perceive ME... Are they really that quick to dehumanize black people? Yes.

These two kids were shot on sight, when they were completely alone, posing absolutely no threat to anyone or the officers who ran up on them out of the blue. They got false reports, did not bother to ascertain the situation,. it simply jumped out of the car or turned the corner and opened fire. There is absolutely no excuse for that. The full videos are available and those criticizing TYT for this report are willfully blind. The comments here sadden me to my core. Whether or not they had the toy guns in their hands is beside the point. They did nothing illegal and the officers made absolutely no attempts to investigate the situation. It is a reckless at the very least and if you cannot see the racial component of these killings it is simply because you do not want to.

Open Carry means it's secured in a holster if a handgun or with a sling if it's a rifle....anything else is considered "brandishing" which is illegal. Back in 2007 was in Cleveland area for about 6 months to train a group of new hires. Several people gave warnings about black people and how dangerous the streets were... there was nothing open after 11pm. There wasn't anyone dangerous. Just burnt out rust belt, with a freeway system built for a few millions, with apparently at that time the traffic volume of my city Boise Idaho... population 250K. I was surprised a north eastern state/city was perhaps even more racist than a southern state... I spent time in Richmond VA and Chattanooga TN doing the same thing, training new hires. Racism is everywhere. Idaho its mostly against Hispanics and Natives. I only notice it when others confide in my blonde blue eyes. And I usually give them the WTF look when they do. We have serious issues. I hate this country. Isn't it ironic I wish I could go to my paternal ancestors origin, back to Germany? I liked Germany a lot. But they're getting swamped by refugees, they have more priority that myself... but if they weren't having mass migration issues, I so would be strongly considering of leaving to there... or Canada.

Correct me if I'm wrong, but in those clips he showed the person who was shot was holding the gun in their hands, not in a holster. Even if a state has open carry you can't go around HOLDING the gun or pointing it at people unless there is a threat to you or someone else.

I was 15 looking like I was 12. 2 detectives rode up on me walking from the store in my neighborhood. With grocery bags in my hand about 12 in the afternoon. They pulled up, questioned me and was smoking at me like it was funny. That's when I 1st felt like something was wrong. When I got older I was arrested for a bag of weed found in my cousin suitcase. He wrote 2 different affidavits saying it was his and the DA threw them out. I was under a unheard of $100,000 bond for about $300 of drugs, on a 1st offense. There were Rapist, attempted Murderers, people with domestic violence who bail was lower or somewhere around mine. Even the white CO said that I was profiled by the state toopers and my arrest didn't make any sense let along my bail.
