More info on the 1st clip: "The police arrived with guns drawn on the at fault driver - his firearm ended up being illegal, he was arrested and he had a kid in the car and some chick came and picked up the poor kid. - It is a no fault state (Florida) yes., I had to use my insurance to go after them and they actually tried filing a claim with some other chick ? They didn’t get away with it - horrible down here"

Haven't looked up Illinois law yet, but if they're anything like Arizona, cammer had right of way. Here, yellow is literally just a warning the red is about to be displayed. As long as your wheels are past the line before the red, cops call it good. Same happened to my son's ex. She was the turner. She was cited for failure to yield. My son just got this same type of accident on my dash cam a few weeks ago. Same thing. Turner was cited for failure to yield.

Not sure of what state specifically cammer is in, but generally fault will lie with speeder if they are traveling excessively fast. In the clip here, we can see the cammer is traveling at least 70 mph in a 55 zone.

@@ihazdashcamyou’re correct. But that’s from a legal standpoint. I think the idea here is, when the light is yellow, it’s the safer decision to slow down to a stop before getting your wheels in to the intersection. Especially if you’re going to be in the left lane, not having a clear view of cars waiting, already in the intersection, to complete their left turn. This was an avoidable incident.

I don't know legally, but technically, his is at fault. The rule say : when it turn yellow, if you can stop without endangering yourself, you stop. Second things, I think he was way over the limit. For me, it seems like he would had have to break hard (not a "lock your wheels" hard and everything in your car go flying, but still pretty hard) and the light still turn red while he was crossing. Around 4 seconds of yellow. What google tell me is min 3.6 sec for a 35mph zone or 4.3 for a 45mph. My guess is that it was a 35 mph (~ 50 kmh) and he was goin way way over. The other one did the same mistake as so many : start entering the intersection before being able to go & clear. And than proceed to try to get out of the way as the light is about to change.

I agree... especially if police aren't on the scene. I'd want them to see recording (after I watched it a couple of times) if it shows 1000% I'm not at fault. I'd just like the police report be very clear and in my favor. I've not had any luck getting a police report changed after the fact. I won the suit, but the report came up in court - just another piece of the puzzle. Ps: I'm not typically in favor of speaking with the police after an incident (maybe if I was just a witness) - they're not there to find a guilty party, they're looking for someone to hang a charge on and go. I had 4 witnesses (all latino) claim I caused a wreck. 3 of those arrived several minutes after the fact and they all talked for a long time before the police arrived, and I was never questioned. Installed a dashcam a few days later.

@oys So many people respond to anger with anger and only escalate the situation. It feels rare to encounter someone that responds to it in a way that de-escalates a situation. I.e., instead of taking the attitude of thinking they're in the wrong and how dare they, thinking, what did I do wrong and how can I fix it? Even if they're not in the wrong at all, I've found that when I've been the angry one (or seemed to be) that it made the conversation go much better.

The last accident I was in, was NOT my fault. The passenger was the owner of the vehicle I was driving. He is a firefighter and EMT. He immediately jumped out to check on the two elderly women, in case they needed medical attention. They started screaming at him after he asked if they needed help. They tried to say it was my fault that they turned left in front of me. They told the officer that I was going so fast that she didn’t see me. I was driving a 2004 Jeep Wrangler with a manual transmission and had only driven 3 blocks. The cop knew she was full of it. It’s pretty impossible to get up to speeds she claimed I “must’ve been going” in such a vehicle in 3 short blocks. She was ticketed. We got to go to the concert we were headed to in the first place. Her car was totaled. She was pissed. It didn’t matter that we were kind to her and her mother.

If anybody is caught blatantly trying to commit insurance fraud, they should permanently lose their license, put on a blacklist for every car dealer and rental car agency to not allow them to be behind the wheel, and if he's caught behind the wheel still, then they go to jail. Any accidents they are involved in are automatically 100% their fault and they will be held in jail till all damages are assessed and have all wages and benefits garnished until the damages are paid off. It may be that they are told to not arrest for lower-level things or that they just don't want to be off the street for a length of time filling out paperwork. I remember the day when police responded to every traffic accident, but there are too many accidents and not enough police anymore. If cars are drivable, no police unless there is a bad injury. #20 sounds exactly like my experience. A few years ago a woman ran a stop sign, and made a “j-turn” across three lanes of oncoming traffic. I had no time to react and slammed into her car. Lucky for me I had a a dash cam and OnStar. A “wild Karen” started accusing me of speeding and intentionally ramming the other drivers car. Little did she know I had a dash cam. She got between me and the other driver and wouldn’t let me even exchange information, she just yelled at me saying they were calling the cops and my ass was grass. She told the lady that pulled out in front of me “don’t worry about this sweetheart, we got this!” Needless to say the other driver was ticketed. She AND her “witness” still lied to the insurance. It took a year to settle and my insurance had to sue hers for the damages. She also was found guilty of insurance fraud by filing a supplement claim for a damaged child seat. My insurance claims adjuster told me her brother in law was an insurance attorney ironically. OnStar also recorded I was driving the speed limit, when I hit the brakes, and everything! I advocated that everyone get a dash cam, it’ll save you from having to deal with crap like I did!

Yellow does not mean yield. It means prepare for red. If it meant yield that would mean you have to stop for the people turning and give them the right of way, you do do not. The driver turning has to give the right of way. Get a drivers handbook and maybe a dictionary too. Reality is that guy didnt break the law.

The cammer was already in the intersection when the light turned red. He is allowed to complete his turn and clear the intersection. The guy he hit ran the red light. It’s close, but, the other car is not in the intersection before the light turns red. That’s what the court saw and why the cammer is not at fault.

Man, some of these people are terrible drivers. Not just the at-fault parties, but the people with the cameras. Like, slow down and read the other drivers. #2 - bro didn't think the left turn car was going to try and sneak through? Come on, of course they are, slow down and wait a cycle and save yourself the hassle of a bent up car. #4 - as soon as the car pulled off, I was thinking "I bet they pull a U" and sure enough they did.

@@davebrown9725 I would prefer a dedicated dashcam. Using my phone as a dashcam is too complicated for me. But I would like that camera to be almost invisible to avoid thieves smashing my car's windows to steal the camera.

Theres an awful lot of people that are commenting on #2. Im going to put that one to bed. Theres nothing in the IL code that says to stop on yellow. (625 ILCS 5/11-306) (from Ch. 95 1/2, par. 11-306) Sec. 11-306 This section only states that it is a warning that its about to turn red. There is no prohibition from entering an intersection on yellow. There is no rule to slow down. There is literally no rule at all on what to do on yellow in that state. Would I have stopped? *Absolutely*. Is the driver at fault? Nope.
