I have dyslexia, dyxcalcula, ADHD & a memory impairment, I have struggled with this all my life but I am a great parent. I had to go to court to file for Child support for my 2 children after separating with there father, we we together for 15 years. I requested accomodations when the hearing was finally coming up after 6 1/2 years waiting. Due to my low income I could not afford an attorney & had to represent my self, I was told there was no accomodations for this type of Disability. After a virtual hearing I noticed they miscalculated child support for the years and number of children, I had to file a motion so they can correct there mistakes since there is state guideline, they can confirm since it shows where they made clerical mistakes & with my disability I could not correct them at the moment. After I picked up the court notes is when it was obvious, it's been 7 months since this hearing I call to get updates in my motion with no resolve. I cant even apeal since theres no signed orders. I was told to file a new motion but why if they have not responded to the first one. The father has an attorney that must know this mistake benefits him. I have to now pay an attorney to recalculate what the court should have done with the correct information that was provided. This has caused me extreme financial hardship & emotional distress, Just knowing there are other like me or worst, to know they can be taken advantage of due to a disability really hurts. YA

So I haven't been able to get anybody to answer my question and you touched on it when you talked about abandonment and the best interest of the child. My son's father is seeking timesharing as well as joint responsibilities /as well as relief from child support after he abandoned us for 7yrs. (And by abandoned, he kicked me out @6 months and had another baby 8 months later) He began this court process after he got a letter from dept of vital statistics asking for DNA. My son has ADD symptoms, severe allergies, acid reflux and a host of other issue that haven't been taken seriously because I was on medicaid in a town where that was synonymous with poor.. and I don't feel it's in his best interest if I have to defer to this man's opinion when it comes to getting my son the help he needs... Especially since he's not offering to provide medical. He also has a problem with my son calling his stepdad who's been in his life since he was 3 'dad'... and is trying to get my son to stop by putting it in his parenting proposal We went to mediation right before the shut downs and I had to work extra at the hospital unable to facilitate the original agreement. BD wasn't understanding and will try to paint me as a person who kept his child from him. (Ironic) I have a hard time believing that I have no right to ask foR majority timesharing and sole parental responsibilities so my son doesn't have to go from household to household and be able to stay in his home with his stuff and routine, his dr's, his school, and the activities I'm going to put him in so we can manage his disorder. But I keep getting told that none of those thing are factors, what matters is he wants to be there and have joint responsibilities and he's got a house and a stable job and 3 kids... Sorry for the dissertation, I'm sure no one is gonna read this far. I just wish there were more videos about my situation instead of calling me a gatekeeper mother and saying I'm wrong to put my child first.

Do you have texts messages? If he hasn’t been involved plus he kicked you out while pregnant, had another child while you were living with him I think you have a win win case. They’ll see right through him for wanting 50/50 custody only for child support

@@cupcakepatrice8418 they did, I won my case and the judge found everything pretty much in my favor. He couldn't justify being in uninterested for 7 years.

As far as the information shared it is very informative and I appreciate the time taken to together and develop this video informing myself and other parents of how things work. Aside from that just a suggestion, with future videos maybe set up a slide on a computer in front of you or have your paperwork set up in front of you so when you’re looking over your notes it appears as if you’re still looking at the screen and not having to look down at a sheet of paper.

What are some time sharing provisions you’ve seen or would recommend to your clients? Also if 50/50 is difficult to be granted in long distance living arrangements why have majority of attorneys say it’s likely? Kinda broad question but this has been my experience.

I have not been in my son's life due to drug addiction but within the last year and a half I have went to a Christian Base program which was a year-long and graduated has got a full-time job and paying my child support I just want a little bit of time to see my son what is usually the normal on a case like this

I wonder how this will work with my situation. I am a father I live in the Miami area unfortunately I don’t know if you take cases down this way. The mother of my child lives with my in the house where I pay the rent. She does not pay any bills except her phone. She recently got a job and my son is a year and 2 months. The owners of the house want her out by the 30th. I will continue to live here because they don’t have a problem with me. She has created all the problems and wants to take my son 4 hrs away to Clearwater. I’m thinking of doing 50/50 custody but I’m not sure how this would work in this situation. She refuses to move out to a place here in Miami simply because she wants to be closer to her mom in Clearwater. She puts her feelings before my sons best interest. I could really use some advice or an overall picture of what I could expect from my current situation if I file for 50/50 custody. She’s not a reasonable person at all.

I recently went to court and they granted the father and me 50/50 , but before that we separated prior and he hasn’t seen his son for about 4 years , first year he was on a restraining order because of a violent behaving he was causing , & after his year was up he didn’t bother looking for his son or get in contact , but he knew what school he was going to because he got married and his step kids would go to the same school , and until his sister who one day seen him there because she was a dental hygienist ask to contact her so they could be able to see him , then I was letting them see him and they would let the father know when his son would be there for him to see him , mind you I never stopped from him seeing him when he filed the court to seeing his son every other weekend because his job didn’t let him be able to spend time with his son , most weekend because I would be the one with him more time because of school he would see him every other weekend , and we would communicate only through his sister , so now we have 50/50 , because they seem he wasn’t violent anymore he didn’t show he wasn’t unfit , he was married and had another child that he wanted his son to see , and that was settle and we started 50/50 this December and he asked to file taxes this year when he just started in december which made no sense , I do everything he asked , for & it seems to me like he just trying to make it harder on me , so now he filed again to court not months to reduce child support and wants to alternate years for taxes when I have 183 nights and he has 182 , & we have 1 child together but he has another child with his wife and another on the way ? What can I do ??

He wins more then me , He makes 3,982 monthly & I make 1292 monthly we have 1 child and he has 1 with his wife and one one the way , & child support monthly is 581 , he said he wanted to claim because he has more bills than me and has 50/50 custody , so I’m just stressed about the situation

My child’s father abandoned us, I had to start a go fund me to pay rent, as I had just quit my job to stay home with our son, he’s been gone for seven months now has a lawyer and is trying to get custody. Any advice? Also, he’s still married, wasn’t divorced when we had our son, but they’re separated.

let him get custody while you get your life right. Why continue to make life hard, if he's trying let him try. You shouldnt have to create a go fund

If you're in florida you both will likely get 50/50 timeshare, just file a counter petition asking for 50% timeshare and settle in mediation. Make this easy on all three of you.

what if the father is on probation and DCF seems to not be caring about that, the mother of the child was arrested during a fight, can the mother get the baby when she is out because he is on probation?

So going threw custody battle with my ex fir our son who is now 10 months old. never married failed mediation cause it's not his way, he wants 50/50 with no child support, he's been trying many ways to stop all this tho he filed, but when it comes to time sharing I only do visits only since he threaten to keep our baby for the amount of days he claimed I held our son from him even when we get our custody papers he will not return our son . It's been this way forever now, I'll offer him sometime to see our son and he either belittled me or tells me to sign over our son with his demands 50/50 witch since he deemed it that I was taken too long or refusing his demands he went to primary then now to sole. He defaced me on social media and had cops called to my parents house where I live now, it's just non stop. He's free to see his son but doesn't want too, he wants me to do as he says and sign over our son under his demands...what do I do?

My child’s witnessed domestic abuse. I left the relationship and have proof of the domestic abuse he’s also in prison now for a violent crime. Shooting into a car. Felon possession with a gun. He has history of drug use and mental issues. He was diagnosed with Psychosis, Suicidal tendencies and homicidal tendencies. Would my child’s father have a chance? He gets out next year and already filed a motion of paternity. I have tried to have him involved with her and talk to her on the phone while he was in prison but the last thing he said in front of my daughter is that he wanted me dead and I stopped all conversations. I’m not being a spiteful child’s mother I want to protect my daughter at all cost from a violent criminal And from somebody that actually tried to kill me three times. Did it in front of her.So I need to know if he would have a chance of like every other weekend or something. I might add I’ve had a stable home for her for the last three years she’s six going on seven and he hasn’t seen her since she was three Because he’s been in prison.Also the last time he did see her she was screaming not to go with him and she was scared of him.

Great information, but with everything going on in my life, it seems that the courts still put mothers first, no matter how many false allegations, which I have several made towards me and all cases are closed, I still got every weekend instead of 50/50, I lived 5 mins away from my children, she doesn’t provide medical information and makes it really hard, so yes, Florida won’t say it, but they lean more towards the mother, we don’t see it written in the law, but we see it based on their decisions

I am the mother and awaiting a mediation date by the end of the year. I currently sleep on the couch with no future living arrangements. At which point can I find somewhere to live without fear of abandoning my kids? I assume to just wait until after mediation, but will that hurt me for child custody as I have no home to put my kids in?

This video cleared a lot up for me, thank you. Im moving from California to Florida for work soon. I have sole custody and my ex-husband has eight percent parenting time on paper due to child neglect, child emotional abuse, child abandonment, substance abuse, his inability to follow court orders, his inability to coparent, and so many other issues. It took years and a lot of problems to get the custody arrangement we have today to keep our kid safe. It cost me twenty five thousand in attorneys fees too. I came across information that Florida is an equal parenting state and became concerned they wont adopt our California court order once i try to register it there. I became scared they will force a joint custody situation on us which would be horrible. From the sounds of this video, that will not be the case. My ex-husband hasn’t seen our kid in almost a year now and has only seen him about three times in the last three years. Hes been popping up once a year since i remarried seemingly so i cant terminate his parental rights just to spite me since California requires an entire year of absence to TPR. Him popping up just once a year, the bare minimum, makes it where i cant TPR. Im hopeful i can register our court order in Florida and immediately file to terminate his parental rights via step parent adoption since they only require three months of abandonment. I am excited to start our new life and have some actual stability and safety for our kid.

She's right about the way the law is written, however that doesn't mean the people working on your case ( your own attorney included) aren't going to insert their own beliefs into it. This is becasue the judges and magistrates get paid from the reimbursement of child support collection through the Title IVD program where the federal government pays the state 66.6% of every dollar collected in child support by the Florida Department of Revenue child support collection agency. So, these judges and magistrates benefit financially from collecting child support and they will not put a woman on child support, cause sexism exists but it's against men and not against women.
