After my dad died and my mom had a little Money. I told her mom go out and buy yourself some new furniture . Buy a nice washer and dryer. Go to bingo everyday if you want to. My mom scrimped and saved all her life because we were poor. When it was my birthday I honored my mother because she carried me for 9 months and gave me life. When she died I was devastated. She left a couple thousand dollars to me and I couldn't even spend it. I kept thinking about the time she could have used it when I was a little kid. But she did go out and treat herself to New furniture and did spend most of it. She had a stroke and I was there every day. I didn't even think about my job. I thought how many times she sacrificed for us. Please be good to your parents. They gave you life.

I know how you feel. My mom lived with us the last 17 years of her life. When she got sick i didn’t hesitate to care for her. I was honored to see the woman brought me into the world out of this world. My brother who did nothing in the last 17 years for her. When she needed new tires i informed him she didn’t have the money….crickets. My husband I cover 60% (all we could afford). Over the years i provided for her as she provided for me growing up and a few times as an adult. Do you know he took 1/2 her insurance after burial expenses, but he did let me keep all funds from the sale of her car ($3000 after my expenses waiting for probate). Wasn’t super nice of him? Forgot to mention her insurance was only $25,000 after expenses. I’m feel greedy, but if the roles were reversed I wouldn’t taken half, if any at all.

I am an only child and my parents have been advised by their lawyer to make sure they have a living trust and not just a will. My mom literally said to me: “we don’t want to put you through the nightmare of the courts”. Their lawyer is a knowledgeable person and Toby thanks for explaining everything.

Good thing. Going into probate court takes 42%, per our living will trust attorney. I highly recommend a living will trust.

My dad passed away last December. He mentioned he wanted to go get a living trust done, but unfortunately he got sick and passed away before he had a chance. We are still in probate court and it's been a nightmare, not to mention expensive! We have been paying on his house for almost a year and just received the right to sell it from the courts. Get it done sooner than later folks, my dad thought he had time but you never know!

@@TobyMathis I have a similar situation, my father had been prompting me to set up a special account; the last 5 years saying that I have an inheritance, & so it doesn't affect my Social Security disability and Retirement income. I looked & only thing I found was to put it in an educational savings account for a time & amount dispersement; Is there anything better to secure my inheritance without pay taxes, or affecting, lose my SSDI INCOME!? ALSO my sister's KEPT ME in the dark, not inform me of anything till after. NOW there trying to lead me to believe there is no WILL; that DAD WAS BROKE, & THEY HAD TO SELL EVERYTHING TO PAY HIS BILLS and I was MIA (missing in action for so long, & not keeping in touch) they my two younger & one older sisters "didn't want to be responsible for ME. Tried to find some Legal advice FOR HELP. All Attorney said "to find out if Will was in Probate" couldn't find anything,

I think it's important to define the differences between revocable and irrevocable trusts... specifically the ability to shield assets from consideration regarding Medicare and nursing home costs.. please consider including this in future videos

One of the ways to shield assets from medical costs is to get a special needs trust and appoint a fiduciary to oversee it.

@RM-pq7vx just be very careful how you attempt to shield assets from Medicaid. Do not try to use an internet company. Find an elder law attorney.

Excellent information, our family is fractured now because of a will that was changed days before dad died. Resentment, envie, and greed motivated a couple siblings to prey on his despair and get him to change his will. My wife and I will set up a trust for ourselves so our heirs don't end up going through what we experienced. It is beyond my comprehension why siblings plot to hurt one another, but the love of money does funny things to people.

Amen it is sad people fight over things that can be replaced but the loved one dying no matter what their past is like you cant replace a loved one simple and to fight over it is sad belonging dont replace them the love they gave you and memories are the key to healing your heart and keep a loved ones memory alive

I know the feeling, im on my 2nd dealing with thievery in my family. 100s of thousands were stolen and last wishs not fulfilled. Its so important to have your affairs in order.

@@4wchitstands Sorry to hear that John. Don't get too caught up in it. It took me down a dark path for months. I am doing better for it, when I accepted it as a blessing and a lesson. Unbelievable how much abundance we have been blessed with since we had been taken advantage of, but God answers prayers when you show gratitude. Try to be thankful for all life's blessings, even the negative ones. Let go and move on, or it will consume you.

Don't do it. It only benefits the attorneys. Almost 70 percent of living trusts are never funded. Meaning the trust is like a shopping cart and your assets are like the products you put in a cart. Everytime you buy an asset, or sell an asset, guess what..the estate planning attorney or CPA will charge you to update the trust and it is not cheap. Furthermore, if you try to say get a mortgage but your securities at a brokerage are held in the trust you will have to get a notarized ($$$) copy of the trust not just show them your statement from your brokerage.

@@ksmith2852 Thank you for voicing your opinion. I disagree, but get where you are coming from. Lawyers make billions (with a "B") from probate fees. According to studies, including AARP, the average costs of transferring assets via probate are in the 15-20% range. There are also things like financial & health matters during your lifetime - both of which are also addressed in a living trust. Even unfunded, a living trust is better than a will as there is still a pour-over will included in a living trust that dumps everything into the trust. What it eliminates is public disclosure of what is going to whom as well as the litigation between beneficiaries. Too much here for a simple response, but suffice it to say, I disagree.

Toby, been watching you for years and learned a lot. But this is probably one of the best videos so thanks for some of the suggestions! My mom's one asset was a house that was purchased in 1977 for $40k but sold for $1.1m (California) when she passed last year with the proceeds sitting in a specialized account until distributions are made. She had Alzheimers but she passed peacefully in her home as outlined in her AHCD which was part of the set of legal documents she had set up in her living trust. As the trustee of her estate, I am witnessing firsthand the grief and greed that you so aptly described. The beneficiaries are pulling out the stops. One beneficiary asked for their distribution immediately after mom passed, another contested the trust, and the last has filed a petition to have me removed claiming I had undue influence over her when she named me the trustee. But the trust was set up in 1979 (updated every 10 years with me named as the successor trustee every single time) when she was of sound mind so the net effect is that legal fees can still drain the trust by belligerent beneficiaries. Yes, those legal fees will eventually be recouped at their expense. It's stupid though. My mom would be mortified if she knew what was happening.

Very sorry for your loss of your Mother. I am and was a trustee for several people & family members, the greed I see is beyond belief! And yes, it is so very stupid. And yes I got accused of influencing, but the funny thing was when we had asked the greedy beneficiaries to help me as trustee to take care of the person so they had an idea of what was going on and could be paid a wage from the estate (and end up getting more money in the end than the others because they were being paid out of the same pot), not a one would step up. They wanted the money without the work. LOL...greedy, lazy and stupid...just unbelievable. Take care of yourself.

You're correct. I recall my children attending fifth grade in an Affluent school. It was very common for the children in the school who all seem to fit a certain image, to brag and declare how they couldn't wait for their parents to die so that they could have everything. Absolutely disgusting. But I wonder they were likely a reflection of their own parents

In California if your estate is over a certain amount they take something like 58% for probate. My best friend growing up lost Millions before they got done because his parents refused to put anything in a trust because they thought somebody would steal the trust from them and other silly rumors. They have four houses and a total of six million dollars in the estate. There was only him and his brother the brother who was causing all kinds of trouble. They had two boats but his brother wanted both boats stuff like that. Before probate was done a 6.5 million dollar estate dwindled down to 1.2 million each for the brothers. You better get a trust combined with a will.

Well done. I have one and forced my mom to set one up. She was on the receiving end of my grandmother’s estate - no will. Her sisters fought over tea cups. At the end of the day they never spoke to each other again. Easy Peasy estate settlement if you have a properly st up trust.

The Living Trust will do nothing about tea cup battles. Whoever gets into the house after the person dies will take the tea cups, photo albums, hard drives, safes and all technology. That's how it works in real life.

Wife and I did a living trust in 1992. She passed in 2015. Just sold our house which was in the trust. Found out one half of the estate was in my name and the other half was in the trust. I was shocked when the title company informed me. I received a check for half of the proceeds. The other half was a check made out to my trust. It has to be deposited to our trust bank account which we never had. I hope to see my attrney at church Sunday to see what I have to do as my credit union will not allow me to deposit the check. Talked to the bank the check was drawn on and was told I have to have an acount with them and then establish a trust account. Really perturbed at the attorney which set it up but he is long gone from here.

I’m a paralegal probate law you are so right! Living Trust is the way to go. Lawyers push Wills but the cost before & after is $$$$$$$$$ and the effectiveness of a Will is almost nonexistent.

I have a question for you my grandfather passed away a couple months ago. He was living with his girlfriend for 25 years they’re not married he left two homes a couple of properties, some Ira account and a couple of vehicles. His girlfriend is living with him, sell any of his vehicles under his name Without having a will or a living trust ?

thank you for all of this info. most you tube videos only give you a small amount of information and you need to buy their program to get the rest of the info. These are people that say they care about wheat happens to the ordinary person. How do they care if they arent willing to share their knowledge? Not everyone can afford to buy their program. A living trust is the way to go. No messy probate. You as a trustee are that person when that person passes away. Everything goes to you.

I have a living trust. The attorney that wrote it tried to do a will. I am so glad I didn't. The cost was $675 for the trust or $2000 for the will.

Thank you very much… This information came right in time!!! My mother passed away without a will or a living trust!!! And I’m sad to say that my brother is a practicing attorney of over 30 years! This should have never happened!!!! Im a nurse of over 35 years and when I constantly spoke with her in reference to her affairs she always said “she had a will”… Thank you for your service!

Just went through probate of my dad’s estate. He just had a Will and left me everything. He should of done a Living Trust. Probate was a nightmare.

The problem is people are not educated in living trusts. I was familiar with them. I talked to my sister who is the executor of my dad's will & then we both talked to our 91 year old dad about setting up a trust. We explained it would make everything flow easier in the future. Everything would be organized & easy. When our mom passed, it was a lot of paperwork, phone calls, transferring everything everything to our dad, etc.....He saw what a hassle that was & that is why he agreed to do the trust.

Seriously helpful and lines up with everything I learned going through this process. Super useful. I don't know if you've considered this before but if you were to find someone to present these in other languages such as Spanish and Mandarin, you would impact so many people. Stuff like this that is relevant to aging in the United States is almost impossible to find when English is not the first language. I've heard so many stories from first-gen friends with parents who are so lost but don't have the means to how lawyers, and don't know where to find this info. Thanks!👏🏼

Went through Probate with my beautiful mother in law and it was a four year horror show with all sorts of never heard of “Step kids” in their 50’s putting hands out. Pure distain for those types. My mother-in-law had a trust and when she died, it was really hard but she had a living trust and all we had to do is open up the book and follow the instructions. It was so easy. I want to thank her for making it easy for my wife in this trying time, it was so easy I believe in living trust everything worked out properly. It was just perfect.

I live in NJ. A few years ago, my dad set up a revocable trust. We went to a local estate lawyer. His will got updated & everything-his home, stocks, etc.- were put in the trust. It wasn't hard to do & overall, it didn't cost that much, under $2k. Our family has peace of mind. When my dad passes, it will be a very emotional time for us. His estate will be be settled quickly. All the work was done while setting up the trust while dad was alive.

Mr. Mathis, that was a great video. Very informative. I've been through that probate process a few times after the death of loved ones, and it's been painful and dramatic every time. Grief, greed, and personalities - leads to people doing crazy things. The video gave me a lot to think about for future planning to avoid those sort of scenarios. Thank you for sharing it.

@@TobyMathis toby I’m trying to find the video you did explaining how to sell your home to either an LLC or an S corporation to take advantage of the $500,000 exemption if you’re married and having a new cost basis at the higher price for the LLC or S corporation. I told my lawyer about it and wanted to do it but he doesn’t think it’s possible. I’ve searched and searched videos and I can’t find it on your page or in my history. Thank you. Scott

This is exactly what I want, I want to create generational wealth for future generations in my family, unfortunately I’m starting from scratch at the moment but have a plan and I’m running with it, and I like the fact that I can dictate and make sure that the money and assets continue to grow and continue to be handed down generation after generation without those future generations just squandering the money but making that money grow and the assets grow even after I’m gone, to create generational wealth so that my grandkids and their kids and so on aren’t starting from scratch and have a good shot in life, I am so glad I saw this video

Thank you for the information. My parents have a will and asked me to be their caretaker. I recommended a Living Trust because we have siblings and some are not on speaking terms. The Living trust provides my parents the opportunity to provide their voice in their assets. Great inforamation.

Thanks for sharing. My father was in the process of creating a living trust, then went into the hospital one week before signing the documents. He then died about a month later, that was this past January. So probate has been a whole lot of fun. There is so much work involved while you should be grieving. 💔

I knew some of the information about Living Trust but not all, it was mind blowing to find out what you can do with a living trust and I really don’t think my dad knew that too because he left it to my sister and my niece and my sister (niece mom) took everything & still complained. There was provision for all his grandchildren but my sister turned around sold all the property and put it under her name because she was the executor. Now everything is gone, no one has anything and she even convinced her siblings to give her money because of property taxes which she pocketed. Greed beyond imagination! Thank you for this information, I will definitely look into this!

She could have gotten in legal trouble as executor for not following the will. The executor is responsible to fulfill the wishes of the person whose will it is.

God Bless You we are getting there the past 2 years I have been telling my husband we need a LIVING Trust! No we do not have a lot but house cars and a little insurance money I have seen Wills eat families money up by being in court! YOU DO NOT-KNOW how much you have helped me I called my husband in the room and got him to watch settle! I question we live in small town a small county do I need a attorney to ours up that specializes in Living Trust! We already know who our Trustee will be!

Sir, you are a BLESSING!!! My wife and I have been praying, and we have a Prayer Circle on our Ranch that we go to 2 to 7 times a day. I went there this early morning to beat this intense extreme hot(106°) weather. I watered, planted, arranged, and walked the circle praying for answers...I GOT IT, THROUGH YOU!! I came inside to shower and nap, then I pulled up my KZfaq, and your/this video popped up and stood out to me...at 1st, I was like, hmmmm, no likes, but tons of positive feedback and comments. I played it loud as I sat to eat lunch, so my wife could hear it too. We were at PEACE and CALMNESS came over us. Your genuine servitude, professionalism, transparency, and love for TRUTH is very evident, sir, and for that, I thank you, man to man. We have a 18 acres Ranch in the Texas Hill Country, built a 2 story Barndominium, and have a 2 acres stocked pond, plus 4 German Shepherds, 120 chickens and roosters, 17 ducks, and multiple raised Vegetable Beds. My mom and her brother STOLE my INHERITANCE that my dad left for my sister and I when we were 5yrs and 4yrs old, he was a 2 time Purple Heart medal recipient, and he loved us, I REMEMBER!! Long story short, he left everything to us in his WILL, but somehow, my mom assumed the role to dole out my sister and my FORTUNE, and USE it on herself and her new husband who physically abused and beat me naked on drugs listening to demonic music. Then my grandfather who took me under his wings, left me his fortune too, because I was 1st born, and I helped him clean up his rental properties and small lots around town, as my sisters and cousins MOCKED and LAUGHED at me because they saw HARD WORK and NO PLAY on the weekends A LOT. Fast Forward, my grandfather came down with Alzheimers, but before he lost his senses, he PROMISED me that he was leaving it ALL to me. Once he died, they buried him immediately, and TOTALLY SHUT me OUT, and Never Answered the phone and said that I wasn't allowed to come to their Mc Mansions. I was confused, angry, lost, and CRUSHED, because didn't know what was happening....NOW I DO!!!lol THANK YOU!!! What can we do to work with you on our LIVING WILL?🙏🏽 Father God Almighty, please continue to bless this humble giving gentleman who is freely giving crucial information and explanations from his BIG HEART. We pray he will experience a hundred, thousand fold increase in his business opportunities and clients, in Christ Jesus name, amen🙏🏽🤴🏼🙌🏽

He only presented a very basic positive side of Trusts. He is a salesman. There is a huge dark side of Living Trusts. Do your research from sources who do not make money from you opening a Living Trust, funding and changing the trust, and administering it when you die. The last cost is hidden; you are dead so you can't complain about the charges and the beneficiaries don't know any better and have no recourse other than sue.

Thinking about it, I will have it a restrictive trust. Hubby just passed and unable to sign it. Creating a trust requires 6 months waiting period. Thanks for this video, it really helps a lot.

This has helped out a lot. I think it will be easier for our properties because there will be only one beneficiary, our nephew, and then his children after him, if he has any. We do have several properties in several states, a business, and a fleet of business cars. This has been a concern of mine for a while now. Thanks for the video.
