There is no such thing as a judicial branch, just like there is no such thing as 3 coequal branches of government, consisting of the executive, judicial, and legislative, the federal government is the congress, an assembly of the States as equals with equal suffrage to reach a majority consensus of the States as the Union governed by legislative processes. Collective decision making is what is governed, the legislative processes are the governor! The judicial department is to adjudicate conflicts and disputes between the States and to act as the last resort upon appeal for redress of grievances, which could arise from laws that are properly legislated but disenfranchise or otherwise disproportionately impact a State or States. Laws cannot be unconstitutional, only the assembly which makes the laws and the legislative processes which are used to make laws can be unconstitutional. To constitute means to form or assemble, and the only thing formed and assembled by the Constitution of the United States is congress as a legislative assembly of the States governed by legislative processes to reach a majority consensus of all the States as the Union. A constitution is the blueprints and Standard Operating Procedures (SOP) to assemble and operate congress as a legislative assembly, this is a result of a participation versus compliance agreement of the States which established the benefits, privileges, rights of participation in decision making and cost of membership in the Union, forming and empowering, the assembly, the united States, in congress assembled, the Union and Established Government Authority! Once an agreement is reached the agreement is formalized in a constitution rendering the agreement unalterable outside a unanimous agreement of the members who reached the agreement contained within that constitution. All petitions must be made to the legislative body, then the legislative body refers the petition to a court of 5 judges chosen by lot from a pool of no less than 7 and no more than 9 judges starting with the petitioner, the Chief Justice is not one of that number, as they must preside over the proceedings to ensure that the court is properly assembled and functions properly to reach a majority consensus of judges chosen. As the last resort on appeal, the decision of the court cannot be changed or overturned by another court at a later time, that practice would constitute mutability of government and is precluded from our governing system by assembly by the republican principle, and the assembly of the Senate by the democratic principle of the States assembled as equals with equal suffrage to reach a majority consensus of all the States as the Union, and each State being apportioned 2 senators, with 6 year terms and offset elections for replacements, this provides continuity and stability of government, what the States agreed to yesterday is the same today and will be the same tomorrow, barring another consensus agreement of all the States as the Union. How we assemble the court today and how it functions is an abominable that is unconstitutional as a violation of Article 3 of the Constitution of the United States!
