Quran Surah Nisa Chapter 4 Verse 11-12 talks about inheritance in Islam in detail. Islamic inheritance distribution has been given in detail. Please I want you to help me. We are 8 in numbers 4 boys 4 girls my father give everybody a portion of land he gives two of my brothers land with their papers and one sister while we are all young he told everybody he Seattle his property equally by showing everybody his portion and make witnesses to that but now my Brothers still claiming that they want a portion of it again. What will i do please help me 😭

Then she will be answerable to Allah s.w. Each daughter must get equal share in the property. This is a commandment of Allah s.w. and obligatory on all the Muslims, not an optional thing to do.

Daughter's will get 2/3 of the share in d property total and d wives will get 1/8 each

First 1/8 will be given to two wives (in this case 1/16 each), then from the remaining property 67℅ will be equally distributed in 5 daughters (13.4℅ each). Whatever remains after this is distributed among siblings of the dead. If Dead has parents alive then they are given the respective percentage in the beginning before distributing it in daughters.

If one brother earns less than his younger brother, is property distributed equally or not?

To the best of my knowledge, earning has nothing to do with property distribution. If parents have property but they are dependent on their children (means they don't have cash), they should rent/sell their property to meet their expenses.

Yes,in that case also property has been distributed equally coz Allah SWT knows best HE knows that may be some of the family member is not equally rich than the other so HE can simply said that the rich one will get less share n poor one get more

​@@muzamilaziz3355 As i mentioned earlier, earning has nothing to do with property distribution. The property must be distributed equally according to Allah's command. If one of the sons who is earning more want to give up his property to the one who is earning less, he can do so but parents do not have the right to distribute unequally or force the person (who is earning more) to give up his share of property to the one who is earning less. In my personal life experience, giving up property share to the one who is weaker, is a backdoor (chor darwaza) created by Moulvis and hypocrites to favour the one who is more dear to the parents. The benefit is much less than the damage it does. And Allah knows the best.

According to Fiqh or Islamic jurisprudence the one having both male and female multiplicative organs is called Khuntha or hermaphrodite or third gender (Uddin, 2017). All actions with regard to Islamic Law will be taken to determine the gender of hermaphrodite. One the gender is determined it will be considered as that gender for all legal rulings, including inheritance. Certain symptoms are essential to be analyzed to regulate the sex of hermaphrodite, the first of which is the organ it uses to urinate. If it uses the male organ, he will be classified as a male and if it uses as female organ, she will be categorized as female. If the hermaphrodite urinates from both male and female organs, then the first one to release urine will determine the gender. These symptoms should be analyzed at or immediately after birth to ascertain the sex of the hermaphrodite (Ali, 2016). Based on their sexuality, they have been categorized as male and female (Hirschfeld, 1923). If the Khuntha or hermaphrodite falls into the category of male or female, he or she will succeed to as a male or female accordingly in all cases (Uddin, 2000). But, if they are not classified as male or female who have both male or female genital features and cannot determine which sex is dominant in that child,then the Khuntha or hermaphrodite will not be assigned as a specific gender and treated as 'hermaphrodite difficulty'. Inheritance of Hermaphrodite or Hermaphrodite Difficulties It is clear that if the hermaphrodite is treated as male he will inherit the property like son, brother and paternal uncle and, in cases of female, they will inherit like daughter on the status of female. But in cases of hermaphrodite difficulty there is conflict between the jurists. According to Imam Abu Hanifa and Muhammad, the general rule is that hermaphrodite or Khuntha difficulties will take the share as female unless as male he will get lesser share. In short lesser share would be given to hermaphrodite difficulties (Ullah, 1940) (Source : Inheritance of Hermaphrodite (Hijra) under the Muslim, Hindu and Christian Law: A Case of Bangladesh)

But Islam says inheritance takes place only after death of parents for children , and children have a high probability of disputing the shares , what solution Islam has for it

But the property distribution has to be decided before death. As it is mentioned right from the beginning of the verse (4:11). Allah is talking to the living in these verses, not the dead.

If parents have their own source of income and the widow is helpless then should not she get the money

@@TowardsIslam JazakAllah for reply and same should be applied in unmarried daughter specially is she has been earning and spending on house ..but I do no think that Muslim brothers will consider such exceptions
