That being said, when the driver has a warrant and police decide to tow the car, the contents are searched accordingly. If the officer wanted the car towed because the driver was suspended and the passenger had a warrant, the car is then legally searched. Not many departments would allow her to drive off with no license. As a passenger, he had no reason to show identification nor did the officer tell him he had to by threat of arrest.

In Oregon, for years in the past, they followed an unofficial "2 out of 3" rule. License, Insurance, Registration. If you have 2, you get a ticket rather than towed. I don't think they are still following that rule now. Probably too much liability if they let someone drive away.

I can personally atest it's not always that simple. I got a ticket, small town, mailed them a money order for (literally) $5 below the fine by accident. 6 months later, I went to get a new license after losing my wallet only to be told i was suspended and had a FTA warrant. Ended up having to pay $575 for the warrant and to get my DL reinstated. The only thing on my record. Always a fun story to tell when my background checks come back for work on why i had an arrest warrant

@@evanhamm8271 isn’t that just ridiculous?! Why is nobody doing something against it in the USA? That is only the case in the USA and third world countries with totalitarian regimes. No where in Europe anybody would get a warrant because of a 5 dollar missing fee! You’d get a letter, pay it and everything is good. That such things are allowed in the United States shows that the people are the opposite of free nowadays, thy can be as easily arrested as in China or Afghanistan! The ridiculous for profit system in the USA should be punished by the United Nations, it’s so unbelievable discriminating against every citizen!

I drove for 2 years without knowing my license was suspended. Got a speeding ticket, paid the fine in total, as I was moving the state sent a driver's improvement class letter to my old address where my father was living and he threw it out. We weren't on talking terms at that time. Only found out when I got pulled over 2 years later for a tag light being out that I wasn't aware of and ended up in handcuffs. Went to court and was suspended for another 6 months, 90 hours of community service, and had to take the driver's improvement class.

When the folks that have the ability to suspend a license and not responsibility for that choice it happens a lot more then it should. I was charged with a red light camera ticket on a car, that I had never ownd and plates that had been on a car I sold 8 years before, from a area that I had not been in over ten years. I got stopped, was told and recieved a ticket for driving on a suspended license, over a thousnad dollars in legal fees to get it all fixed then the final ticket was dissmised and it cost around $300 and some time off work. No biggy the folks that made the mistake in the first place were not out any money. When its not about enforcing the law only collecting money regaurdless it will always be a problem

Yeah I was just thinking that....just saw a video of a huge drug bust and the cops didn't wear gloves....even touching these drugs is crazy.

Do research. A scientist spilled a huge(his own words) amount of fentanyl directly on his skin and had no issues after washing it off. Rumors cause more problems.

Especially to get stopped for expired registration. It follows that domino effect when one thing leads to another. Good Officer to cut her a break by letting her have the time to take care of her mistakes.

No insurance no dl and expired tags. She should not have been able to drive away.

@@Just.D The insurance part I agree with, but if somebody is having a tough time of things financially and has an active check engine light on their car so they can’t get it inspected/registered and just found out that because of a monetary civil judgement against them was filed with the DPS so they suspended their license, should that person just not go to work if they have no other means of transportation? If so, how exactly will that improve their situation? It’s already bad enough that the state will suspend your license because you owe somebody money that you don’t have so can’t pay them….then you can’t get your car inspected and registration renewed (one in the same, must be done together in some states) because there’s some b.s. mechanical issue that doesn’t actually make the car unsafe but causes a check engine light and will cost another thousand dollars they don’t have and therefore there can’t pass inspection…do they still have to listen to y’all call them dumb and criticize them for driving when they’re in a bad situation that you’ve never been in a position where you had to deal with such a situation because you’ve been blessed enough to not have to deal with serious financial problems? Are they beneath you or just nit a good person because of this?

It's not necessarily a mindset. It's more likely a financial issue. Being financially unstable can lead to an expired tag, that leads to a ticket, and failure to pay the ticket leads to a license suspension. If a person is having a hard time to begin with and you add all that on top it becomes a situation that is difficult to overcome. Meanwhile life goes on. People still need to transportation to work, get groceries, function etc. There's a lot of people living paycheck to paycheck who are just one step away from a situation like that. Some will get the registration as soon as they can and have no issues, others will get pulled over the first week they're expired and start a really harsh cycle becoming further in debt.. Not everyone has family or friends to help them out, and for a young person in that situation just getting started it can happen. Even to intelligent people of good moral character.

Resources? How about just reading the Constitution, or the laws around stopping, detaining, checking details etc. Why is everything always someone elses’ responsibility? Educate yourself, you won’t be sorry.

If you are not driving a car, you Don’t need to carry ID. Passenger didn’t need to ID at all. They can ‘ask’ for ID all they want, however you aren’t obligated to provide it

That happens all the time. I've been pulled over 3 times on a suspended in the past year and drove away everytime. I'm trying to fix my DL but it's expensive and I have bills to pay and 3 kids and live in an area where there's no buses or anything. If you have a good reason and your not out joy riding or doing other things to break the law then they will be understanding. For example everytime I was pulled I was doing something for my family. Twice was coming home from work and 3rd going to the grocery store. These guys that get pulled over on a suspended and are smoking a blunt and are out selling drugs deserve to go to jail. That's why they usually don't get a warning. We al make mistakes and not all of us have money to fix these things right away.

​@@nohandleforme.... Even in a stop & ID state the passenger is not required to show ID unless there is suspicion of a crime or infraction by the passenger. However, I have watched multiple traffic stops on KZfaq where a passenger was threatened with arrest or arrested for not showing ID when they did nothing wrong. The charges for the passenger arrested for refusing to ID are usually dropped soon thereafter, but they still spend a night in jail with no repercussions for the officer that violated their rights. There is a police department in Florida being sued over arresting a passenger for refusing to ID during a simple traffic stop and the passenger was released the next day with all charges dropped. Even with the lawsuit in the local newscast people living in that jurisdiction have since reported that the same police department is still requiring passengers in vehicles during traffic stops to ID or face possible arrest. Nothing ever changes.

It's best to let them violate and get a lawyer on it afterwards

It goes both ways. If people would stop doing STUPID SHIT like lying, running, shooting, assaulting and generally acting like animals, then they would get treated accordingly. IF these two ran from him and got pitted, then foot-bailed, they'd have been in a world of this with THIS cop.

Yeah, it's usually the stupid people that break laws and get their little feelings hurt who don't like cops. Then the first time they need a cop to rush into danger for them, they expect them to be tbere.

@@tomr3422 Another reason is because databases have been behind in updates on occasion and people whose licenses had been reinstated still showed as Revoked/Suspended or people had not yet been informed of the suspension or revocation. So people were arrested who should not have been. Major liability with that as in "False Arrest" suits.

He is letting her go to the DMV to get it squared away. Sounds like it isn't a traffic violation that got it suspended. Right though the Officer cut her a break.
