This is the “reply” brief. The final brief as part of Chille DeCastro’s appeal. First, he submits an “opening brief.” From there, the DA submits a responding brief. Then, Chille submits a “reply” (or response) to the DA’s arguments. It’s always possible the District Court could seek additional briefing, but I don’t see much in the way of issues to brief. They spent the bulk of this brief bringing up George Floyd, Rodney King, out-of-circuit authority, and robotic, unpersuasive writing. I think the convictions will stand.

obviously Chilito did not hire anyone, but claiming he did only increases the amount the suckers contribute towards his case- most law school students are well versed in the use of the English language--my brother had a Masters in English before going to Law school for example.

In this case also he was swearing at the police, and threating them . Obscenity, profanity, threating, provoking , fighting words are not covered by the 1st Amendment

Also, he walked by an actual journalist filming the scene. The police had no issue with that guy -- because he didn't interfere with the scene or them. Chille's own video destroys any claim he was arrested for filming.

@@greyskies9295 Not really. Under Hill v City of Houston (1987) police are expected to give a lot of latitude to the public's language. Any language would need to be a direct threat to the police before they could react. Like their photography, frauditors abuse the First Amendment speech rights.

People need dramatic lessons, dramatic examples, to shake them out of their "I know best" mindset. Once a few more try these ineffective arguments, maybe they will start to learn. No hope for Chille though. He is so certain. Doubts are healthy, and lead to more fundamental understandings if properly pursued. He seems incapable of doubting the rightness of himself or his actions, despite his own lived experiences to the contrary.

As a retired LEO with 41 years Mr D’Arcy knows what he is talking about and has broke down this case in layman’s terms. This is a prime example why you hire someone with his experience and knowledge of the law. I’m sure he is extremely expensive but you’re paying him for his knowledge and experience in court cases such as these. Doesn’t guarantee you’re going to win but this is who you want on your side to argue your case. Very nicely done Mr. D’Arcy. Thank you.

No matter what he does though Judge Zimmerman made a final ruling and he's going to spend the time he deserves in jail. Plus he has another case about the same subject coming up. But he actually had a strategic lawyer. Mr Mee KNEW that Cheech's video showed a lot more then Cheech's feet literally moving about 6 inches. It showed he swung at that officer, twice, and connected with his shoulder once. It also shows him resisting arrest. The lawyer wasn't about to let him further incriminate himself. Like it or not, Mr Mee probably did Cheech a favor. But! I say, if he's gonna cry about it - LET THE VIDEO IN. Then we let the dice roll. But Mr Mee is not ineffective because of that decision. I'm sure he'll argue that in his own case against Cheech.

Is there any chance you could find a different appeal brief filed by Oram and compare it to this? The prevailing theory is that team delete lawz drafted this as well as the other briefs and Oram has just been forced to file it to make their nonsense appear legitimate.

Yes, Chille is truly exceptional and got an exceptional sentence. Despite what the judge claims I still believe Chille would have got a suspended sentence if he'd behaved himself in court, disrespecting the judge during sentencing would have been the last straw, I mean what a fool.

I do not know who wrote that reply brief. I understand why all that BS filler annoys Mr. Darcy. I am in my 70s and practiced law for roughly 40 years. Back when I was a baby lawyer working in my first legal job, the various Bar journals were publishing articles urging lawyers to drop all the excess verbiage one sees in this reply. Back then and certainly it is the same way now, plagiarism is the greatest form of flattery in the legal profession. If one had to write a points & authorities or a brief on an issue, the first thing one would do was ask other attorneys if they had a successful brief on the issues you had to address in your case. Most law firms had brief banks with hard copies. When computers became standard in law firms, you could find all manner of briefs online. You could visit the law library and look at the templates in the forms and practice books. The problem was and still is, that this perpetuates that filler language. After all, if it worked for the guy who gave me this copy, it'll work for me. Some of it is based on old traditions and customs - like saying "Comes Now" etc. The one thing I do not understand is I have been told by several attorneys who practice in Las Vegas that Oram is a respected attorney who does good work. But that document was filled with conclusions and silliness. It reads more like something Chille would write using some form book from the prison law library. Or something I wrote when I was a summer intern after my first year of law school. Fortunately, the attorney I worked for just sat down and took my crap apart and explained to me all the mistakes I was making in my drafting.

It's been years since I've had to submit any sort of Appellate Brief but one thing I do remember is that they need to be sharp and to the point. Imagine a law school student (law scholar!) submitting this as a piece of assessment. Immediate failing grade.

I have a few questions: 1. Did Chillie write this? 2. Does a licensed lawyer's name have to be on a brief even if they are pro se? 3. If you answered yes to the first question; why in the hell would you let that man use your name on this brief? 4. Is there no spell-check in jail? (It's not that important. More of a thought)

My unqualified opinion would be Chille wrote it and his lawyer caved in to Chille's demands to submit it which is an idiotic thing for a lawyer to do because his reputation is on the line, he'd be better off sacked by his client which probably would have happened if he'd refused.

Pudgems probably insists that Oram files what he (DeCastro) writes, with no changes. Oram probably goes along with it, because he gets paid either way, and he doesn't seem to have a great deal of scruples. I doubt he cares about how this will affect his reputation; there's always more ambulances to be chased.

This sounds like Chille wrote this brief with all the typos, bad grammar etc and just had his attorney sign it. My personal opinion why would any lawyer allow anyone who wasn’t one of his staff type a brief loaded with mistakes and just sign the document. I would think that the lawyer would want to protect his reputation as an officer of the court.

I find it almost impossible to believe that this was written by Oram. Everything I have read about him has said he is a well regarded, experienced, attorney. This is NOT the writing of someone who knows what they are doing. Some of these “mistakes” are so elementary, I’ve got to believe that Oram threw up his hands and let Chillie write this himself, or gave it to a law school intern he has working in his office. No experienced trial lawyer is going to make so many blatant misrepresentations. It’s one thing to argue the facts in favor of your client, it’s another thing to misstate the record.

Many of my college students spent so much time trying to “sound smart” they seemed to forget the purpose of the assignment. I often read documents by people who think there is a trick to sounding educated. They never realize that people don’t “sound smart” they ARE smart. The document is simple a vehicle. I am disabled & my medication in the morning takes a while to kick in. It is hard to function at first no less laugh or smile. However, your ‘Ransom note’ WRITTEN across Chile’s brief, (corrected ‘’B’ capitulation 🤣🤣), made me laugh out loud! It’s a good thing I had swallowed my first sip of coffee or I would have spewed it out of my mouth and made a mess! Love your straight to the point deadpan style & we do sincerely appreciate your legal knowledge that, unfortunately for him, obviously still ‘hits that brick wall’ of Chile’s ego! The type of narcissistic displays that Chille has historically shown refuses to accept the excellence of your expertise and advise as we watch this ‘car wreak’ as his proclamation of being a Constitutional Scholar, while slaughtering any definition of such, in his entertaining yet ridiculous, wording in his appeals contradicts it has become comical ! Thanks for your time and willingness to educate us layman while giving us a good laugh, knowingly or not! ❤️🌟 Excuse errors as my one finger typing is still fighting to function😉😊.

I can't believe a "real" lawyer would allow his name to be put at the end of this "brief" that Chille DeCastro, the "law scholar" that he claims to be, actually "wrote." If a length of space is decreed in law, all a police officer need do is to continuously approach the "defendant" and thereby invoke "distance" from him or her to the defendant, as a breach of law.

Well he has this outstanding too, "City of Las Vegas v. DeCastro", "Obstructing/False Info To P. O." when he was arrested on February 15th, latest status, "Initally, a pre-trial hearing/conference was schedule for May 1st, 2024, but that has since been continued until June 24, 2024, at 1:30 PM Pacific Time.".
