This video ends too soon. More has happened where the video left off. In Feb 2018, Giuca had his conviction reversed, and one month later, someone else confessed to killing Fisher. Giuca's bail has still been repeatedly denied since his conviction was reversed, and he's still in prison... he has a hearing in Feb 2019. He will very likely be released, thank goodness. This whole situation is horrifying and sickening.. at least he finally got a shot at a hearing though.

that seems so crazy...how can he still be in jail after his conviction was reversed? I totally don't understand how after being found not guilty for the crime he was in jail for he wasn't automatically released.
@arcooke
@arcooke 5 жыл бұрын
@@neatznotso7424 not sure how that works in the legal system, I just read through his Wikipedia page. I guess even though a D.A. overturned the conviction, a judge still needs to make the final call. This is what it says (quoted in chronological order): "On February 7, 2018, a state appellate court in Brooklyn, reviewing Assistant D.A. Anna-Sigga Nicolazzi's case against him, unanimously overturned the conviction and sent it back to the Brooklyn district attorney's office." "On February 20th, June 28th, and September 6th, 2018 Giuca was consistently denied bail despite having his conviction overturned." "On March 22, 2018, Antonio Russo confessed to killing Mark Fisher. Russo detailed the killing to detectives, in a DD5 that was passed along to Giuca's attorney Mark Bederow. Russo told detectives that he killed Fisher after he and Fisher left Giuca’s home. Russo goes on to state in the DD5 that the “gun was his”.

@@arcooke yeah maybe you're right that a judge still needs to make the final call, maybe just because his conviction was reversed doesn't necessarily mean he was not guilty. In this case though it's pretty obvious that he is not guilty so hopefully he gets released really soon. Thanks for the added info. So terrible that he has spent 10 years in jail for something he didn't do, this is the best result given the circumstances though, that he gets to go free and the actual perpetrator has come forward so the family of the victim gets real justice - I can't imagine how it would feel as the victims family finding out that the wrong person had been found guilty and spent so much time locked up. Johns mum must be so happy with this outcome, John is really lucky to have such a supportive mother.

There are still many more innocent people in prison. Wrong place at the wrong time. Some cops just want a speedy arrest, trial if any, conviction and on to the next case. They get witnesses to lie with threats. A cops word is always believed and they are aware of this, and use it to their advantage. I hope he can finally put this behind him and sue the shit out of the city's corrupt police officers. His mother is amazing to do what she did to help prove his innocence. God Bless both.

John Giuca - you've got a friend AND supporter here in Canada!! I sincerely hope that ppl EVERYWHERE will start to wake up and help to STOP injustices like THIS as well as many other types that happen EVERYWHERE, EVERY DAY so lives like all the ones affected here, WON'T have to be ruined anymore....... ESPECIALLY by the "powers that be"(such as Police, D.A.'s etc.) who are SUPPOSED TO fight for JUSTICE, NOT help put INNOCENT PEOPLE AWAY just to "close and/or WIN" cases! There are sooooo many WRONGFULLY convicted and/or accused ppl who have suffered because of these INJUSTICES and sadly, the "powers that be" who KNOWINGLY AND WILLINGLY ruin ppl's lives are essentially UNTOUCHABLE! Google it... and you'll see how they(cops, D.A.'s, judges, purjurers eyc.) are NEVER held accountable for ruining lives. It's appalling, it's disgusting and...... it's true!! Of the MANY MANY ppl I've read about or followed in the news etc., who have been proven INNOCENT after spending YEARS in jail for crimes they DIDN'T COMMIT, NEVER got REAL JUSTICE because REAL JUSTICE would see that EVERYONE in the "powers that be" category, involved in their WRONGFUL CONVICTIONS who KNOWINGLY AND WILLINGLY put INNOCENT PEOPLE in prison, are held ACCOUNTABLE for it. Instead, it's hidden or excused to protect everyone from THE TOP, down, who allowed such HORRIBLE things to go on. There's a special place in HELL for those ppl and I hope it burns them all alive!

He’s Italian, has a group of friends that are fondly referred to as “ghetto mafia,” and the prosecution calling him “Tony Soprano-wannabe” all point to another example of the justice system using stereotypes to put someone in jail. EDIT: Getting to the end of the video now, and Holy Cow, the statement about anti-semitism really adds to the above.

Wow what an amazing mom. Our justice system and the people who work there are completely incompetent. Shame on the judge to ignore the tapes . This is why people take the law into there own hands because the Law doesn't protect or help the victims!! She is an incredible woman

As of June 2018 his appeal for a new trail has been denied again. Whoever the judge, prosecutors and police officers are on this case, they are gonna burn in hell. Hopefully he can get out and sue the hell out of anyone that had a part in this miscarriage of justice.

I’m not a Mother but someday I hope to be. And I can honestly say I’d do anything for my children. But this Mom took that to a whole new level... Love is a strong thing. And it’s what will get this young gentleman his life back. I hope the truth will set him free.

This is why, until there is true justice, I am not in favor of the death penalty. Poor people get death while the rich get the maximum sentence of life in prison.

It also just hit me, that regardless of who it was that did this, had to have been someone he had considered to be a friend!?! Which means that so-called "friend" is out here running around with their freedom, and he is sitting behind bars, doing time for what they did to this guy!?! How messed up is it to know that someone he knows is guilty, and they were just willing to let him take the fall, not even caring that they destroyed his life to save their own!?!

It's always sad when you see that the main goal of the prosecutor is only to win the trial and not to find the truth. Maybe it's good for his career but in reality, he might be putting willingly an innocent man to jail. Priorities. That's how you understand who's a person working for justice.

MVP and BAMF of the year awards go to the mother! Seriously, that's amazing of her. I agree with everyone else al well that even though the real killer has confessed, they won't let this man go and dismissed her evidence because they don't want to admit to being wrong nor do they want to deal with the payments he absolutely should demand for the wrongful conviction. This also explains why the criminal investigator, who I saw in the video on this channel about the mom who insinuated her son had cancer, gave such a hard push-back to her lies. He has a best friend wrongly accused so he's been there with his friend and experienced liars harming the innocent. His interview with that woman tore her stories apart and I loved it. He's shaping up to be a great criminal investigator.

You can feel it when he speaks and when you watch him. He's innocent and its a shame that once again our justice system has failed us. As soon as someone else took the blame, they should have released him.

UPDATE: just this week, a judge has ordered a hearing to determine whether John's lawyer was EVER given the statement tape of a prison inmate who told the prosecutors that Russo confessed. When asked, the prosecutor in 2019 said: “I cannot say with any certainty whether or not, either prior to or during the defendant’s trial, I provided ... an audiotape or transcript of Ingram’s statement,” Nicolazzi said in a 2019 sworn statement. Hopefully all goes well during the hearing.

I always say that I hope I am never falsely charged with a crime I didn't commit. Because when I think about how jury selection is made, it terrifies me! It would take a lot of work to find a group of 12 (or even 6) people who have the mental capacity to sit and listen to evidence and be able to reason and follow instructions with impunity. Yet, letters are sent to random citizens who are ordered under penalty of law, against their will, to report and be asked questions to garner supposed character and honesty and possibly illicit their chances of siding one way or another. Too many agendas and lies from the beginning- potential jurors saying whatever they think it will take to get out of this duty for starters. No one is tested for IQ or mental stability before being asked to sit in judgment of another human life. It blows my mind. Story time: I remember when an 18 yr old member of a group I was part of, consisting of recovering drug/alcohol addicts came in several times complaining that he had jury duty. He was, in fact head juror! It blew our minds, as it was a murder case. The result? Defendant was found not guilty, and 2 years later, was arrested again for almost the same crime. (He almost beat a young child to death using the excuse that he was trying to do CPR, same thing that happened in the first trial.) First child was his daughter, and she died, this time it was his stepson, and he barely survived. If he'd been properly convicted first time, he wouldn't have had the opportunity to hurt the 2nd kid. Too late, they realize this was his MO and they had made a mistake letting him go 1st time.
