The law is simple, if it is publicly accessible you can access it and up to the point you are told to leave there is no offence, when you are asked to leave it becomes tresapss which is a civil matter and if you refuse to leave it becomes aggravated trespass which is criminal.

Extremely unlikely if it's about the satellite images, and also unlikely if it's the Google Earth pics taken from airplanes. However, the analogy of some arbitrary guys taking pics/videos on a hot-air balloon ride is more helpful when it comes to discussing the air space above that site.
