How about petitioner who has domestic violence can apply for k 1 visa would get approved

Hello Madam, Quick question, My father, who is a green card holder, has been living with a woman in New York for 5 years. Since he refused to marry her, she wants to obtain her green card through alleged verbal and physical abuse that according to my father, has not happened. She has even called the police 2 times already but they have left from lack of evidence. I know New York does not recognize common law marriage if she wants to try that; but just in case, we would like a word of advice from you, Does she have a case? Thanks!
