In this video I look at the nature and sources of the UK Constitution, including: an overview of the development of the Constitution through key historical documents: Magna Carta (1215); Bill of Rights (1689); Act of Settlement (1701); Acts of Union (1707); Parliament Acts (1911 and 1949); European Communities Act (1972).
I also examine the nature of the UK Constitution (unentrenched, uncodified and unitary),and the ‘twin pillars’ of parliamentary sovereignty and the rule of law. The video also includes the five main sources of the UK Constitution: statute law; common law; conventions; authoritative works, and treaties (including European Union law). Make sure you subscribe for notifications as I look to cover the whole A Level Politics course.

Not sure what it is about this seemingly simple section of the course but it has always stumped me. Took my time with this video and it has solved the issue at last, thank you so much! :)

What are drawbacks and criticisms to Dicey module of Constitution (Liberal Democratic Constitution)? What are the different interpretations of the expression "elective dictatorship" Thay was included within Lord Hewart book The new Despotis?.
@AlanHistoryNerd
@AlanHistoryNerd 3 жыл бұрын
The main criticism of Dicey's model would be that the power held by Parliament and the lack of a written Constitution or Constitutional Law that is superior means that the law is what Parliament says the law is, somewhat undermining the idea that the rule of law could act as a barrier to parliamentary sovereignty. Critics see the need for a written constitution or bill of rights to protect individual freedoms from tyranny of government. They would argue in favour of an American style constitution. I'm not sure there are different interpretations of an elective dictatorship- essentially once elected with a majority a government can do as it pleases with nothing that can be done to stop them as long as they have agreement amongst their MPs.

Also I thought I'd look up what treaties the UK has signed for non Europe examples and came across International Convention for the Permanent Control of Outbreak Areas of the Red Locust (London, 22 February 1949) - easy one to remember!

Have we now copied eu law into UK law? Thanks for the help
@AlanHistoryNerd

Essentially yes for areas where there was no UK only law as a transitional measure. The difference now being that these laws can now be changed by the UK parliament

where did the term ‘parliament sovereignty’ originate from?
@AlanHistoryNerd
@AlanHistoryNerd 2 жыл бұрын
The theory was identified by A.V. Dicey in 1885. It is the principle that parliament hold ultimate political power in the UK as: it can make, amend or remove any law; it is not bound by previous parliaments; it can't bind future parliaments.
