Also, regarding "what is in people's heads" that's precisely why that when it comes to law, you need an explicit statement, you can't just _presume_ . That is, the legal point of view is that yes, you can't "guess what is inside people's heads", and thus as a result, one is commanded to _err on the side of caution_ . Your thinking, however, seems to tend toward erring on the side of license. That is quite irresponsible, reckless at bare minimum.
