My experience letting contractors park equipment on my property. They left the driveway so messed up it was impossible to pass. They refused to repair the damage. I don’t allow it anymore either. Cost me 800 bucks being nice!

I've seen stuff like that happen too. And I don't blame the other family members for closing the easement on their property. I'm sure it was expected to stay in the family and now it's not. I wouldn't have non family members accessing my property either.

@@annwithaplan9766 I think he is spreading a lot of BS and not being forthcoming... says there is an easement, but they have to get an easement, and the new easement will be whatever he constructs, and ends saying he wished there was a confrontation.

It would be so delicious if when this gets re-surveyed that these folks that are giving you such a hard time found out that the property lines were not exactly where they thought they were. I would be laughing my butt off.

I've seen things get so wild when property is correctly surveyed that entire chunks of houses ended up being built on easements or someone else's land. It gets real wild when people try and sell their house and the listings say things like "attached 2 car garage and driveway is not part of property for sale"

I’ve been in the middle of family land squabbles before. I believe these property dealings are are evil in nature. Think a lot of family breakups happen this way.

Was just involved in a 23 yr family dispute that finally got resolved. Everyone in the family paid dearly and the only ones who benefited financially were the Lawyers and the Crooked Land developer who played the game of divide and conquer.

I wish the new property owners a lot of luck. I can't imagine having to live in the middle of that family. I'm sure that the new owners are very nice people, and can eventually have a neighborly relationship with the family members. If it were me, I would have searched elsewhere for a different property. You all did a great job on the driveway. You even gave me a few chuckles. Thanks!

I worked for a large construction company were Forman's took different approaches to situations like this. One believed to ask first and make the people feel like they were part of the process and that their cooperation was appreciated. The second believed it was better to ask for forgiveness then for permission. The former rather then the latter seemed to work best.

Fourteen different households had to sign off when I made a home purchase in North Carolina. The Patriarch passed away and her home was forsale. Decades earlier she deeded out parcels to many family members in equal shares. My home had to pass 5 other home sites down a shared easement driveway. Homesite/owner (lot#7), erected a gate and locked it closing off access to additional homesites preventing access to their land and homes. All this coming years prior to me finding the home thankfully. Over years of battling in court it was settled that she can retain the gate but it could never be locked or secured, Dividing the family forever. That history came to playout during my transaction, delaying my purchase closing date by over 3 months as I awaited each household to sign off on the sale itself. BTW as the new guy, I did maintain the common use driveway to help ensure peace remained.

*This guy is full of shit* - thinks it is OK for him to park his equipment on others property for his convenience, says there is an easement, then says they need to get an easement, then claims the new easement will be set to wherever he decides to place the road, and says he was hoping for a confrontation.

We always allow contracts to park or drive on our property….I’m sure UBC like most contractors will leave the staging area in better shape than it was before they arrived! In the two times we allowed it they asked us if there was anything we needed since they used our property! The one contractor, tree company, notice a dead pine next to the house…took it down, removed it and cleaned up the yard….it’s all about attitude mine and theirs!! Nice work again guys!!

Good morning to all and may God lead, guide, and protect you all. People can be so difficult, cruel, and greedy at times but Jesus said to Love them. I've ran across people and customers like this and you simply can't please them. I Pray for you and the neighbor that is building that they get along. It's going to be a struggle but maybe that's what God has in mind to make them change their ways. Please keep the videos coming because I enjoy them very much. @Upstate Brush Control its actually very smart move legally on their part. They are going about it the correct way by having easent agreements filed with the court and surveys done by a PLS. It avoids a lot of legal issues down the road for them an future property owners.

working around family member is always crazy. very few families that have land that meets are almost always a pain in the ass when someone is trying to do something to improve their part of the property. and the fact that this guy that is buying, or has bought this piece of land is NOT family, only makes things worse.

I'm from a family of 15. I've done best when I didn't live anywhere near them. The closest I've lived to them after I got married is the 500 miles from them where I live now. At one time, it was about 5500 miles distance when I moved to Europe to work and live. Now that my parents are gone, I only talk with four of them, one or two others, I'll talk with once a year. The others, never. I might talk with them sometime in the next century, but not before.

I'm in the mountains of WNC and people are fierce about defending property lines. They'll fight for generations and spend fortunes in court for a few feet of land. Old property lines were defined by rocks and old chestnut trees which are now gone. I"ve also seen conflicting survey plat maps. What a mess. I've given up a few feet of my property just to avoid making an enemy and having to go to court. Not worth it.

There is no way that I would ever be that mean to a new neighbor trying to establish a home. This is a family dispute, leave the neighbors out of it, assist the neighbors the best you can and deal with the dispute within the family.

I'd be careful about blanket stating you can't be kicked off the easement. It depends entirely how the easement is legally defined in the deeds. I have the same problem with a bad neighbor, who has an ingress/egress easement across my property, to access his. He seemed to think he can park on it any time he likes. He cannot.

Reminds me of what happened to my former barber. He owned frontal property along the public roadway and his neighbor owned a land locked property behind him. My barber made an agreement with him that a road would be built back to the landlocked property and both would use it. Over time, the barber installed mobile homes on the back of his property and used the driveway as access to those homes. The neighbor still had access to his property and no one complained. Then one day, the neighbor decided to sell his property. The new neighbors, fully aware of the previous agreement, insisted a legal easement be created for their property. My barber agreed and the papers were drawn up and filed. That's when the trouble started. The new neighbors decided they didn't want the barber to use the driveway to access his rental homes. I can't remember if they went to court but in the end, it was decided the easement had the higher claim and my barber had to build a new driveway along side the first driveway to give access to his rental homes. After doing so, the new neighbors got mad, claiming the added driveway made the road look like a two lane road and their side would be driven on instead of the barber's side. So they installed a chain link fence right down the middle of the gravel driveway as a divider. It was really odd to see.

Good fences make for good neighbors. I get it I have so many issues with my neighbors I had to be the one to put up all the no trespassing signs cameras and fences to keep my neighbors animals from attacking my children and my wife and self and to keep them from dumping trash. Nobody seems to care about your property like you do. So you do have to make it known right away. In the end you pay for that property.

That is one of the problems with "family" plots all connected. One wants to sell out but the rest do not want to pay a fair market price for the property being sold out. So the one who wants to sell puts it on the market and once it sells all the others are all butt hurt over it and cause problems for the new owner of the land they think they should have just been given from the family member who sold out of it all. I would bet that the new owner once any construction start beyond access to he property the "neighbors" will cause even more problems trying to force them into selling the land or costing a lot in legal issues because oft the easements established.

I honestly feel for the family, thats loosing a piece of their family land, I understand its up to each individual to sell or whatever, I just think its sad. Our family was done the same way, but it made its way back into the family, just on the other side of the family

you cant jus shoot someone for walkin on your property, you warn them to leave and or trespass them, meaning serve a notice. You shoot someone in self defence and theres a lot of sweat interviewing and appearance in court on that one.

Great job. Family land squabbles can be a bad situation for contractors…lol. The last thing you want is having them all pointing fingers at you as the bad guys when you’re just there to complete a customer work contract…lol. Thankfully your quality of work and patience will bring additional work to your business. Your finished work is your calling card to future work.

Family some times is a piss fest to deal with ,mine was the same in fighting for a few years .I left them to their own and moved 3000 miles away, 20 years later !!!!!! They were still tweaking about it ,most of what they fought over is crushed and sold for SCRAP ..But I've got the memories stories and pictures from growing up with Grandpa ,his living in New Orleans during WW 1 as a teen-ager , showing me the proper handling of explosives at the age of twelve, " I carried the blasting caps " . Him racing against a side oiler ford in a pancake turbo six ,first and second gear front wheels off the ground ,they couldn't believe a guy 50yrs older than them just smoked the local street racers with a Convair powered dune buggy !! Ah family don't you just love em.

We were looking for upstate property back in 2015/16 and ran into a disgruntled family member who was using scare tactics to scare us away from buying land. Same situation as this, family member selling property around other family members. My radar went up and we learned a lesson that day. We purchased land in Woodruff with no family ties to the land, no restrictions, and no easements. 7 years later everything has worked out and our land has almost tripled in price. Might be time to sell!

I’ll tell you what, if I came home and saw all your equipment on my property to work on the property next to Mine without asking permission I would have done exactly what they did. Move it off right now and fix any tracks etc. , that is without regard to any disputes. I’m not dissing you, I’m just talking from my own property perspective. I have an easement with two other home owners otherwise I’d be land locked too…I would never step over the line and use their property without written permission from them. It keeps the peace and peace is so important with a neighbor and an easement even when you live acres and acres and acres apart.

If a construction crew working on my neighbors lot was using my land as a parking lot, I would boot them. Should be happy they agreed otherwise, and didn't require the new easement be in place BEFORE progressing. *Seems they're not fully forthcoming,* talking about having an easement, and needing to get a new easement, without explanation, then saying he wanted something dramatic to happen.

It is one of those things. if it comes to something like this. Verbal Agreement is not enough. Get it in Writing with all Parties Involved. No Writing and Signatures from All Parties(IE Homeowners. Not Sons, brothers, uncles who are only staying there. Actual Homeowners ones that have the deed) None of that, Do Not Start Working until You have that.

Yep Easement agreements sometimes are a necessary evil when owning property where you're land locked and no access to a road. Such as a property surrounded by other properties and the only way in and out is a road on one of the other properties.

You need a 4 in 1 bucket with your skid steer no one in Australia runs a skid steer with a standard bucket,you can load better ,pick up things like a tree trunk ,open your bucket and place it over a load and close to pink up. Also opening a bucket and putting both edges on the ground is great for levelling.Hop I don't sound like I know it all

For years my grandfather used to maintain an access road he owned but gave a right of way to another cabin in rural Maine. He was maintaining it by hand, including using a boat to row buckets of gravel from a quarry across the lake. My mom inherited and the first time the neighbors got drunk and decided to Baja their ATVs up and down the road that was it. Posts sunk in and cables across. Go Baja your quad over there in the mud bog jerk#$ffs.. Unlike my grandfather we only had two weeks off work and that's about how long it took just to open the place up for the season.

In Texas if you allow anyone to use your property to access other property for 10 yrs the "easement" is automatic. You can't just erect a fence & cut ppl off after they've used a road on your property. For yrs a school bus driver used my parent's farm road as a shortcut. When they stopped keeping it up he called the county asking for maintenance. County turned the bus driver down, but if he had pushed hard the county would have been obligated to begin regular maintenance. Thankfully the children moved away, so the issue solved itself. By using my parent's field road he cut a mile off his route.

A man has a right the do with his property as he sees fit, within the laws and zoning that applies to that property. It's the MOST American of facts. Why folks in 2022 either don't understand that fact or don't respect it, is beyond me ... but that's why I own a 12 gauge ... in case some fella needs that explained to him.

Your demeanor, and action, such as clean up and raking before bailing on that job probably went a real long way in terms of negotiating the continued work. You have ethics, and it's hard to hate that.

My neighbors were like that when I moved here 25 years ago and haven’t improved at all. They are known in the community as “those” people.

Crazy, I know of a couple instances where a judge said to do away with deeded easement and replace with the historical use easement. Made all parties involved split cost of a survey to add new easement.

Hi Jon. I have two kubota svl95-2s with shearex mulchers. Im looking at my next machine but I am torn between an ASV RT135F and a CAT 299D3 XE land management. CAT dealer is huge and asv dealer not so big and far away. I need something that can keep me in the seat longer than kubota. I'm in Mississippi. Thanks!

I understand that people don’t want there property infringed on. They should have crossed the Ts and dotted the Is prior to you beginning. They are lucky that it can be worked out without going to court.
