Retired Law Enforcement here and a fellow BMW owner (2021 M440I). Sadly this happens all too often. Never accept a cashiers check and turn over car until the check officially clears. Many scammers out there (I have investigated quite a few in my career). The checks always looks legit - even to a bank employee at first glance. But ALWAYS wait until the check officially clears before releasing car. Hopefully the car can be recovered and not put on a container ship heading to Africa or the Middle East.

Did you not watch the video? He said he went to the bank and deposited it, and the cash CLEARED into his bank account. Then 3 days later the cash was removed from his account. How would you recommend avoiding that?

Would you just draw up a simple contract, wait for it to clear and then hand over the vehicle? Couldn’t the scam be pulled in the other direction, so how do you buy safely too?

the fact that the bank said it was good with out even checking the routing number. it wild. I think only a bank from the original maker of the cashier check can truely verify that a bank check is good. I hope you get this car back.

With a police report or detective calling, bmw can most likely track it via satnav or idrive system. If you do get it back I’d tow it in case they trashed the motor with something. At least tear it down again. Everything. Also, check for tracking devices like AirTags or similar…happened to a friend. Stolen recovery, they put tag in it and car jacked him next day. He looks like a New Yorker. My car was stolen in july of 2023… wasnt found until 4 months later in Yonkers , NY. I bet you money its around that area right now being hidden somewhere. Its not on the rode that is for sure… I would imagine it being hidden for now until some time passes by for the local authorities to lay back a lil and not have so much heat on the car. Best of luck finding it Bryan.. nothing worse than being scammed/violated for the hard work you put into a passion and a career you made for yourself.

I scammed too 2 years ago I sold my 2011 e90 and a dude gave me fake money orders and I didn’t know. Filed a police report 12/22 and it was located in queens ny finally got it back last week after being missing for over a year.

The right thing to do with a cashiers check is to call the branch that issued the check to verify if it's legit. Usually the branch name is on the check. Unfortunately nowadays you can't trust anyone.

NJ has a nasty car theft ring. See posts on Bimmerpost constantly about M car thefts in that area. Some thought the individuals had a tie to dealerships and were cloning keys. They have been very savvy. This breaks my heart and I hope you can find justice and be made whole. Not sure why bad things happen to good people.

I work at a BMW dealer in central Jersey and our dealer is a main target of thefts. We’ve had armed robbers attempt to steal cars straight out of the wash bay (broad daylight, all of the techs were still at work) but failed. We’re now facing a problem of thieves following customers home and stealing their cars as soon as they get out of them. What they’re doing is really messed up

That's very true about NJ. Last year in August a good friend of mine had his very clean 180sx stolen. Another guy in the neighborhood I lived in, Jersey City, had his Lexus Rc-f stolen. From both accounts I was informed the police are no help and do very little to assist.

Nobody can be trusted , next time you sell a car hide a $25 AirTag in the car somewhere , then when all is good contact the buyer and tell him to remove it, My friends car was actually stolen and in his knapsack in the trunk he had an AirTag and he found it and got it back , he actually knew the guy 😮

I feel it for you guys. When I tried selling my STi, a lot of these sites tell you not to NOT to accept cashier's check, personal checks or even money orders. I was confused because I thought these could never be fake once a bank is involved.

Bryan this might help you!!! Call BMW give them the Vin number ask to get the BMW connected drive subscription, and let them locate the car and they should give all the info to the Police that’s what we did when my brothers BMW was stolen! Do it it only takes 5min. All Modern Cars have built in GPS so before it’s too late and they remove the battery 🔋 do it.

My tip to community: I've been flipping cars for a while now and people have offered cashier checks, wires, venmo, zelle, etc.. the only way to ever 100% safely do a transaction, especially talking about thousands of dollars, is cash. If buyer disagree with selling method just wait there will always be another. There are some escrow accounts you can do now but have never tried that route. Payment security is a HUGE problem that needs a solution and banks will never be liable..

I suggest to everyone reading this to install an Apple AirTag as well as a Tile tracker in 2 separate, discrete locations inside your vehicles, that way if one tracker gets located, they’ll be less likely to look for the second. Apple AirTags will sometimes alert the person if it determines an unwanted AirTag is following them. Even when you sell your car, leave the trackers inside the vehicle and once a week or 2 passes and the sale turns out to be legit, you can text the new owner and let them know to discard the trackers. I got AirTags on my pets too, they work well and are very inexpensive. Sooo damn happy you recovered the car and hope there was no damage done😔🙏🏽

Yeah, nope... wire transfer is the only method of payment to agree upon when selling any valuable goods... especially the car of this caliber. Bank verifying it 4 days later only shows that releasing the car should have happened once that cleared the bank... I will go a step further and question if the bank is responsible for your loss...

This exactly same story happened to my coworker on Jan 18 as well! He sold a Rolex, met the guy at hiw local bank, verified the cheque with the buyer in person and it was deposited in his account as well. And the exact same story happened to him after. (Toronto)

The easiest way to avoid this is put a tracking device on a vehicle. Once everything clears the tracking device can be disassembled never to be used again by you the seller. People while I understand that you want to trust humanity trust your gut first and foremost. Never let a car go unless you have cash in hand. A check, any check regardless isn’t cash in hand.

Man! This is SICK!!! IMHO, the bank is at fault for not practicing due diligence to make sure the check was legit. Have you considered notifying Port Authority to be on the lookout for the M3 , just in case there’s an attempt to ship it to Dubai or some other overseas location. Good luck to you. This is the bank’s fault. I can tolerate both sides but given the details of the bank initially telling you, “looks great” then deposited the funds - yeah no. They should have done a more thorough search. Hey, though…I’m not a bank clerk nor do I sit on a board at any financial institution. So what do I know. I hope the vehicle is recovered!!!

I sold a car recently and was worried about this exact same thing. I felt silly for even thinking that someone could scam me, but I guess it does actually happen. When I sold mine, a consultant at the bank randomly called me (just about investing that cash I just received from the car) and advised me to immediately transfer it into my savings account. I am not sure if his intention was to ensure me protection of my cash in case of a fraud like this, but I think that would be best practice if doing that will actually protect your money from being pulled back out by the bank. Kind of like if the cash was cleared, then technically you can immediately withdraw that money in cash and walk away. The bank can’t come after you after you pulled all that money in cash. Just thinking out loud here. Trying to find ways for all of us to sell a car safely.

Back when i worked in banking, i would have told you the ONLY way to determine if the check is good is to call the bank it's drawn on to verify it and cash it there. Otherwise people can still place a stop check on it. On the other hand, your bank clearly did nothing except deposit it, because the acct, routing and check number could have been verified with a call to the other bank. Likely, your teller thought that depositing the check without an automatic hold by the bank somehow meant it cleared.
