Veterans filing for VA Disability claims under the PACT Act just got some changes that are favorable to veterans. Solid changes especially to the OG Vietnam Era of Veterans.

I just got rated 10% for Rhinitis last week. VA decision letter recommended I file a claim for Sinusitis. That was based off my CT scan indicating mild sinus disease. I HIGHLY recommend you get a CT scan. This will speed up the process. THIS MAN SPEAKS THE TRUTH!

Great work - clay. I submitted my claim - colon cancer under the agent orange/ Vietnam/ boots on the ground ( 1965-1966) Danang. they denied my claim - stating colon cancer does not come from agent orange; however prostate cancer does. Now, I have prostate cancer. I guess I can re-file under pact act for prostate cancer - this presumptive???

So evidently I developed Asthma, which falls under the PACT ACT, while being at Johnston Atoll. They gave me 0% service connected. I hate the 0%, any thoughts? It’d be nice to get at least 10% for it. 🤷🏻‍♂️

They didn't service connect me for my digestive system because they says crohn's disease is a structural gastrointestinal disorders and not a functional gastrointestinal disorders but I have a current diagnosis and was in iraq/Kuwait in 2008, but they medical examination says it's not a presumptive condition but it falls under the medical unexplained chronic multi-symptoms illness and the va still denied it. Can you I u illerate on the matter

Thanks for all you do. I got denied for COPD and am a Combat Veteran (OIF 09-10). They said my "favorable findings" was I have the diagnoses of COPD and I my local and time of service is TERA proven. BUT, they still denied on basis that there is NO Nexus (link) that my COPD was caused by my service as there was no record of complaints or med exam during service. Can you Please Help? -Man Down

I had a ibs c&p exam for Ibs, and the examiner went against me because he said since my va doc diagnosed me with it then its not presumtive. Got a denial. Doesn't matter at this point but a true story.

What in the world? I was service connected through the c&p examiner, said there was documentation about stomach pain in medical records but at the end, I was given 0% service connected. So now I was filling the paperwork out again to get that claim. But your turn out seems like they will deny me again, even though I was service connected. Yeah I know, how horrible to go through that experience and still no help, but let’s help other countries with their needs and let illegals come in and let us pour millions of dollars for their needs but not the needs of our own veterans? Horrible

Here’s an interesting question. My ITF was Aug 2023. May 2024 I submitted 4 new claims. June 7th I have my last C&P exam. June 9 I submitted a supplemental claim for old denials. If anything on that supplemental gets awarded, will it be back paid to Aug 2023?

I think you would have needed to submit them both on the same day.

The 4 new claims submitted in May (assuming they were submitted the same day) will use up that ITF. More info would be needed on the supplementals. They could be paid back further than Aug 2023 if you filed within a year of denial, continuously pursued the claims, etc. Otherwise the effective date is likely the date you filed. A knowledgeable person (VSO, lawyer, etc) would need to see your file to give you an accurate answer for those.

Get the CFile and do a HLR. Likely rater error as their training sucks. Your claim has DD214 validating appropriate theater medal, private doc record with diagnosed ICD10 code, and free a VA Toxic Exposure screening = automatic 0%. Private and VA treatment for at least 4- 6 months = 30%.

I do not understand the first one at all. Are they saying no C&P exam or opinion is needed if you have a current diagnosis for a pact act presumptive that has been confirmed as an exposure via the veterans Tera memorandum? So confused.

I was stationed on Guam from 73-74 and have been diagnosed with cancer, heart issues and diabetes and all they required was documentation, Nexus letters, from the physicians treating me outside of the VA.

The way I interpret this is it requires a higher level of evidence from the veteran to establish their participation in a TERA but the way it's worded I could be totally wrong. They write this crap so no one can understand it.

Good stuff Clay. What about psoriasis? I was denied psoriasis recently. Isn't psoriasis considered a MUCMI because it is a skin issue? I am a gulf war veteran that is covered under Sec.1117 and 1119. During my HLR I received favorable findings for the current diagnosis, participation in a toxic exposure risk activity is conceded, and the evidence shows that a qualifying event, injury, or disease had its onset during your service. How does this change affect my claim for presumptive?

@@TheCivDiv No my HLR was decided on January 27, 2024. I was continued and denied. I submitted a supplemental for the Psoriasis on January 29, 2024 and it was decided on June 7, 2024 and it was denied with a private IMO and favorable findings from the HLR. I was so frustrated that I submitted a NOD 10182 for direct review.

My Dad was a service connected Vietnam Marine and had pulmonary fibrosis and was told by his doctors at VA that is was not caused by Agent Orange, but I read on the internet that it is definitely on the list. He died from this in 2017. This really upset me.

You may need to talk to an accredited agent, but I’m sure you as a dependent can continue a claim after the service member has passed away.

Need to add any toxic chemical exposures regardless of location and dates. Chemicals do not care when and where you got exposed. We had toxic chemicals in our fresh water supply on my Aircraft Carrier all the time. Also as a AIMD ships company Jet Engine Mech we used many toxic chemicals and got socked in JP-5 all the time, 1976-1980 USS Ranger CV-61. VA needs to stop playing games.

@TheCivDiv my self and my VA lawyer have. To many medical research papers state just that. I even added them to my caims. Two of my claims are setting in HLR for almost a year. VA errors. Does not help when reviewers have no clue what they are doing.

I put in for SA in my submission to the VA and got granted 50%. I took a sleep test three years ago and stated to NP on exam it was contributed to Gulf War. Also had a medical study submitted stating GW vets are more likely to get SA from war. Hope this helps.

My issue is that I neither served in any of the locations nor timeframes but was service-connected for my adrenal tumor by the VA for Southwest Asia service. My argument was that I was exposed to Agent Orange in Okinawa (where the VA has 250+ Agent Orange claims) but has now placed it in the Persian Gulf where hundreds of thousands of Veterans became ill. To me the VA has opened a Pandora’s box of claims for Agent Orange (or did they use the rainbow) for all Veterans from 1990-2024 who became ill for Southeast Asia service.
