Memory is bad. That's why I need a routine to keep functioning on my own. Or use a note pad. Cooking... I dknt leave the kitchen or else things will smoke up. Talking to people feel like they have to repeat what they said twice. Always forgetting things or getting loss

Same if I don't keep my note pad and cross things out as I do them ill forget half the list and I even forget and lose my note book :(

I've had migraines since service and I'm rated for it ,question is ARE THEY CONSIDERED TBI ? The symptoms your talking about is what I'm going through ❤

I actually have 3 TBIs in my medical records, but only got a 40% rating for 1 TBI which was from deployment. I had one when I was stationed in Italy, and the 3rd was from my 66th combat jump. I hired a lawyer to review my paperwork to see if I should be receiving SMC-T. I’m currently 100% P&T and SMC-K with 100% from asthma, 70% PTSD and attached TBI to it. 50% sleep apnea 50% flat feet, and a few more ratings.

I as well have a tbi non combat related but documented in service went to nico and everything I get a rating for it but it's lump summed into my mental health with no individual rating How did you get the individual rating with that I would be at 100% that ans my sleep apnea 😅

@@kirkmoody6109 The individual rating is in my c file. They combined it with combat ptsd and gave me 70%.

Great video! I'm curious if a TBI rating should not be lumped in with something like PTSD if you have multiple secondary ratings to TBI, such as migraines or other mental ratings that are clearly due to the TBI and are even rated as due to a TBI.

I had part of my brain removed that makes memories (amygdala, hippopotamus and part of my temporal lobe) due to a epilepsy from either a IED or an accident. My wife is actually my caregiver because I’ve lost about 1/2 my memory making ability. I get paid 100% yet it ain’t official…..VA disability ratings and pay can be so weird. My brain ain’t gonna regrow, yet my disability was never increased.

Excellent video. Is it normal to submit a MH claim to include depression and have the C&P examiner also fill out a TBI DBQ on your behalf? Is this a good or bad thing? I was diagnosed with TBI at a C&P years ago due to an event in service, but the rater determined that it was not service connected. Talk about mental gymnastics.

If i have it diagnosed already in service whil im still active doni need to go to the c p exam they have if im already diagnosed and concussion incident was dpcumented

I have a question. If you weren’t diagnosed with a TBI in service, but had witnessed instances of lost of consciousness while running, walking, office work, and other situations causing you to fall on your face or hit your head. Could you retroactively be diagnosed with a TBI from symptoms you currently have since those LOC? Things like memory loss, seizures, migraines, blurred vision, and those type of things happening after the potential TBI?

I have hostory of conussions before the army playing college football and was actually banned for a season from the ncaa because of it.. over 7 years it pretty much got better then i joined the army and had a new concussion and the symptoms came back.. the off post neurologist diagnosed me with post concussion syndrome mild cognitive degenerative changes and chronic migraines .. can i claim still since i already had history of this but it went away and then cane back because the new concussion in service?

I have a humdinger for y’all. TBI rated 40% but then combined with PTSD 100% PTSD, Major Depressive disorder, anxiety disorder, major nuerocognitive disorder, Panic disorder and migraines Then I am service connected for liver cancer, skin cancer and breast cancer is on appeal. I am also rated for a spinal injury with nerve damage, sciatica, arthritis in my hips, knees, legs. Feet have flop foot and currently waiting for a decision. Because of the PACT Act I am service connected for obstructive sleep apnea, congestive heart failure, a liver disease, but the kidney disease is pending. Seizures were denied. My sinus was approved. I have tinnitus. They called it IBS for a long time but turns out I have bowel incontinence and that’s in the process. We put in a loss of use claim. I receive SMC K, L 1/2, P, and S. Should I ask for SMC R1 or SMC T? I’m not as bad as some people but there was a house fire and I spent a year of my life in the psych ward. I left when I had liver cancer. Didn’t want to die inside a hospital.

Are TBI's rated at P&T? If not, why arent they?

But what if u have already had a c&p exam was diagnosed with major depression disorder and one physical ailment and it came up 90% and when I got my decision back it said TDIU P and T and housebound SMC-S all service connected. Then about 6 years later they send me to Durham NC VA hospital for a 3 day TBI EXAM or Work up. Before I left the psychologist says I will call u in 2 days with the results. In 2 days the Doctor called and said I'm sorry but its positive and u need to be put on social security disability. I said how do I do that she says I'm calling the local VA clinic near u and have them assist u I said ok thank you.Then the VA clinic calls me about an hour later and says find someone else to help you because we dont do things like that and hung up. Now to cover everything I must tell u that i have opioid use disorder due to 3 surgeries on my right hand due to an accident while deployed on the USS NASSAU off the coast of Lebanon and overall had 5 surgeries on my hand all unsuccessful and have been going to a Methadone Maintenance clinic for over 21 years and i see the psychiatrist at the methadone clinic due to her treating me for all my disabilities. Now also i was sent out by the VA for a sleep study and it was positive i have sleep apnea so my Sleep apnea, TBI, and PTSD was all done or diagnosed AFTER i was awarded TDIU P/T and housebound status. So i was told since I'm drawing the 100% rate NOT to file a claim or open my claim back up that there was no sense in it I'm already drawing 100% rate and they could decrease my claim once its opened back up what should i do???

This is sort of like the blind leading the blind here. But Ill give you my opinion. Severe TBI btw.. but I took notes. SO here is what I have found. Both COmbat Craig and others have said it is best not to poke the bear if you are rated at 100%. I agree with him. But as all things? Talk to a lawyer or rather have someone else do that for you. It would be for the best i summerise.

so under the 10 facets it says subjective symptoms under one of the 10... in the criteria it only goes up to 40 (2)... is it possible to get a 40 percent from symptoms such a migrane's, dizziness, sensitivity to light, sensitivity to noise, and tinnitus while getting a separate rating for migrane's under diagnostic code 8100? ( an additional possible 50).. I suffer from them all. Or do they swipe under migrane's into the TBI subjective symptoms?? Im curious. Always thought migrane's was a separate rating but they sure do bring up headaches alot under subjective symptoms rating criteria. Also.. if I already have a mental diagnosis separate situation from my TBI.. will these all be separate claims? I hear tbi claims they like to combine them all into one rating which is completely wrong to do. Can I get your professional insight. and yes I watched the full video (:

The VA likes to combine TBI with disabilities like PTSD because they say "it's too hard to differentiate between the two." You can file a secondary claim for migraines due to TBI and this will be a completely separate rating.

Thank you for this video on TBI!! I had a C&P exam for this because of an incident running to a fire aboard ship. I hit a hatchway with my forehead running full speed and was knocked unconscious. This was the 1 time I was ever knocked out in my life. A corpsman used smelling salts to revive me, and he and 2 others on fire-party lifted me to my feet and took me to medical. There I remained for the night and they would not let me sleep because I was concussed. At my C&P in 2018 the DR. sent me for x-rays and found Spondylosis (Stenosis-Cervical later in MRI), but they claim it was not in my service records. I've tried to find a witness, but am not successful. Very exasperating to put it mildly. Not sure how to proceed. To make matters worse, it was in 1986. Any suggestions?

Write a statement of what happened, and ask a buddy who knew you before and after the event to write a buddy letter.

January 2023 Just had C&P with Optum (former LHI) in Los Angeles Dr was cold as ice. Dident want to hear a word I said. Never examined me just a bunch of questions. Negative attitude .

@@BearInThePhillipines ok I have an exam coming up. I've been in front of a higher level rater with my attorney because VA don't care about us. So I knew it was a battle I couldn't win on my own. I'll keep you posted on the outcome.

@@rayb2410 whoa....thanks Ray I had no idea .....you have been through a lot. When I went to CP interview I wore my vest with my unit patches 1st Cav Berlin. My thought was they are looking at a old man and they need reminded we are veterans. Wear your unit hat and lookem in the eye . Gods is on your side

I have TBI and PTSD. They lumped both together. In my letter, they gave me a 70% for PTSD. They also gave me a 40% for the TBI but said they can not determine which came first How would I get those separated into two ratings?

The VBA will almost always lump those two together even though we know they should be separate ratings. Their way out of it is "due to the similarities in the symptoms" ......

I thought mine were lumped together because of the verbiage on my VA profile but when I got my C-File and code sheet they were separate. PTSD just has a note that says with TBI residuals which I heard helps with not getting re-examed.

@@LawDogg01 the only thing that will help not to get reexamined is to be P&T. Otherwise, you will be reexamined every 2 to 5 years.

@@LawDogg01 same here. I've been in the system for 20 years now. Was on schedular for 11 years til the idiots pulled their head out of their asses and gave me P&T w/ SMC after my last C&P.

As long as the TBI is service connected, do the raters have to give the rating based on which box is checked or can they rate however they want?
