Please start encouraging emphatically that veterans take more interest in their own claims, since nobody knows better what they have been through. Don't just wait. Learn. Become the Expert on your Appeal. Because, let's be honest - they're going to deny. As you become your Expert, you will find opportunities to help or support other veterans. I filed my claim on January this year and turned over 25 years of medical records. Within 3 months, they gave me 80 percent combined in April. I'm trying to file for TDIU now but COVID19 has made it impossible for me to work with my rep as they are closed. I'm just going to fill it out the best I can and submit it.

@@seekersees693 - several Facebook pages dedicated to Vets' benefits pursuit have a lot of resources to help. Besides this one, other great Attorney pages are also available on KZfaq. If you're not familiar with Chris Attig of VLB, put his videos on the list. You should be able to submit the TDIU form through eBenefits without any help. They should, but never, automatically consider TDIU for everyone. The stuff they ask is needed.

I was awarded 70% in May 2019, the same day that I received it, I filed for TDIU. In November 2019, they denied me TDIU. Instead they awarded me 100% Permanent & Total Disability!

You are 100% scheduler so you don't need TDIU ...you can also work if you want to.

Congratulations! That is the best rating you can ask for! I am in the process of the same. VA advised I have an opportunity for an Inferred Claim for TDIU based on the 70% rating. I uploaded new and current medical evidence to include lay statements and a comprehensive report from a Vocational Expert. I am hoping for the same results. Did the VA have you go through further C and P exams? if so, what for so I can be prepared.

I suffer from Depression & Anxiety that made it difficult to continue working. One month after I filed for TDIU, they sent me to a local Psychologist for a C & P Exam. Since I know that I have issues, All I did was act normal, and honestly answered all of their questions. They did a excellent DBQ on me, all in my favor. A few months later the V.A. sent me back to the very same Psychologist for a second Exam. This time they gave me a better DBQ than the first one. In which the first one should of gotten me TDIU. So this second C & P exam was the one that V.A. rated my disability as 100% Scheduler instead. If you have all your medical evidence in order, I believe you should have no problem. But remember, be yourself. Your medical record will carry a lot of weight with the V.A. Good Luck to you

@@davidposey7145 Thanks David for your reply, I am in a similar situation, already had a mental psych exam from the VA which gave me 70% now I suffer from migraines, submitted a secondary claim for migraines, now VA has consolidated both claims. Maybe the VA knows what they are doing and will set me up with another C and P for migraines and another for psyche. Praying for the same results as yours. With the Covid Virus, VA should be doing these C and P's using tele health video.

My deceased husband didnt know about TDIU in 09-2014 but was granted SSDI . On 03/2014 he had to stop employment at the VA hospital due to a terminal illness. He expired within 6 months 09/06/2014. Shouldnt he have been granted TDIU.

How about rental income. I have 1 rental property that I pay someone to do all the work on and the tenant brings me the check every month. I did not hire a management company to oversee it, so the only thing I do is call someone if there is a problem that needs to be addressed. I just started receiving TDIU and last year I took an 8K loss on the property due to upgrades. Do you think there could be an issue with my TDIU and having the rental ?

Veterans need to talk to an Accredited Service Officer (VFW, American Legion, DAV, Purple Heart). They will have all the information that you need on all VA Benefits and will help you apply for them. And will help with all appeals as well.

Correction, the correct Form is 21-4140 I believe. But, anyway Veterans do not have to fill out this form. The VA uses the IRS to determine Taxable Income.

I was hurt on my back my legs and head in a military base in Okinawa 1970 for so many years I have chronic back pain and migraine and headaches.i'm 70 years old and I only get two hundred louzy dollars each month now they are worried because they think I will kill my self I think maybe is a good ideal so they can help so many veterans that need help that they are homeless and hungry,why our country help so many people but not us veterans I would like to take all those f.... Thank you guys . I'm employed by a church members family business. Doing me a favor. I earn 30k a year but I wouldn't. Have a job if it were not for them protecting me. So with a 60% or more ptsd rating I could qualify for tdiu?

Sir I was totalling 70% combined rating with 30% flat feet, 30% depression, 10% lumbar spine, 10% left knee and 10% right knee when I filed for tdiu in January..today I checked my ebenefits online and saw that my combined rating is increased to 80%...70% for depression, 10% flat feet, 10% left knee, 10% right knee, 20% lumber spine, the decision letter is in the mail tho..so my question is do you think my tdiu is granted and is it possible to verify that online. Thank you

I have a service connected disability of 70%. To file for TDIU I would need to open a new claim for an increase to this 70% claim and also fill out the VA Form 21-8940 and then add the 21-8940 to the new claim? Is this the correct procedure?

All you need is 40% for 'one body part' with 70 combined. Put in thru the VA for an increase to raise your % to 100% disability compensation . State that in you written response and show the Drs all areas where worsened. If not received, keep the appeals going

I applied, I'm 70% and am 58yrs old ... How old were you at application? You should try for 100% increased compensation, state that in your appeal that you wish for an increase to 100%

So, I filed for a schedular increase in my rating via HLR and was granted 70% for PTSD. I didn't apply for TDIU, but during their review of my rating, they uncovered a duty to assist error, My decision letter states they are pursuing this claim and in fact have decided it, but that they need to develop the claim, which I take to mean they need the 21-8940 to tell me what their decision on TDIU is. My question is, if granted, will the TDIU 100% pay be retroactive to my schedular increase that qualified me for consideration?

No, if your receiving VA disability, and they're lacking on their end, file an appeal stating you wish to attain the 100% combined disability rating.

@@Blueskathy Thank you for your input. I was less than clear, I think. The VA itself open a "new claim" for TDIU based on their HLR when they uncovered a "duty to assist error." That claim is dated as having opened in June '21. Apparently, a 70 PTSD rating requires them to look further to see if TDIU applies. So my question is, if granted TDIU, will that increase be back-dated to June '21, or to the nearly year before when I filed my HLR?

I retire from the federal gov because I had enough time to retire at .but did not apply for disability but did apply for social security,I was diagnosed with cold just before I retire ,but did not try to apply for ssdi beccause I did not think I would qualify for.I the applied for va and iam know a 100 percent disable due to my cope. Would a person qualify for ssdi after 8 or 9 year of collecting just social security.. I believe that it is too late for me bu this may help other veteran in the same situation.

The VA no longer need form 2140 for TDIU. The New procedures is that the VA uses the IRS to determine yearly Taxable Income for Veterans rated as TDIU. Again, disabled Veterans do not have to fill out form 2140.

Get a hold of the State VFW service officer or one of the other service organizations service officers that are accredited. They will be able to help your husband with all VA matters. They should be talked to first. Not an outside person that may not have all the up to date information that the Service officers have.

Is it really worth it to risk being reduced from 100% to gain a few hundred dollars a month? Especially if he is 100% due to a mental health condition like PTSD or Depression. if you guys can't make it on almost $3200 a month then you need to reduce your expenses. But if your hubby is 100% due to real, documented service injuries then he should fight for everything he's earned. That is my 2 cents.

If he was awarded 100% it's the same thing. You could lose it either way. 10 years is usually the break away to it becoming permanent. So make sure he attends his medical appts and continues his care.

Hi thank you for sharing I have a question I'm 100% permanent and total disabled veteran under individual unemployability tdiu and I was asking my primary care physician at the VA to fill out the DMV form so I can get my registration fee waived as I qualify according to California DMV. But he refused to sign the form he said California DMV change the rules on this something about module 5 states that in order to qualify for registration and placard the veteran disability have to be so severe to affect his or her Mobility that they need a medical device to move. I told my doctor that I was not seeking a placard but I was seeking for him to authorize The form to only get my registration fee waived for my one vehicle you know the sticker that you put on your license plate that has the year and month on it but he keeps saying I do not qualify I am 100% permanent and total disabled can you please elaborate on this I would appreciate it

I'm a Vet, I had the placard (in IL), the same Dr that signed the form decided she wouldn't anymore, I went to patient advocate and I basically fired her, switched Drs, told them I don't want her as a Dr., The other Dr signed my form. My previous Dr frankly wasn't an advocate for veterans, a form of bully from my knowledge and experience. I've since had the placard. . File for an increase in compensation to attain the 100%, state that as your wish, showing nothing has improved but have worsened .

I have been TDIU since 2019 and have been DENIED SSI TWICE because I was told I make to much with TDIU, and I am 44 so I think that is why I am getting denied! Thoughts???

Keep persevering and if you don't already have one, get an attorney like I did. I was going to quit due to frustration being denied twice and court hearing twice, but I'm glad my attorney encouraged me not to. I was 43 then and I think my TDIU helped me get approved for SSDI since VA deemed me unable to work and I didn't work for almost 4 years. Praying you get approved also

The SSI and SSDI people are honestly far worse than anyone at the VA. My social services person said they have been denying people who are pretty much at death's door lately. So it's not your fault. Definitely get an attorney involved and take it to a judge.

File an increase in disability rating with the VA, state you wish for an increase to 100% rating . Show Drs where all 'injuries' are and that they've worsened. You also at the same time should file for SS disability, SSI is supplemental income.

Yes you can but don't rely on your VA primary care provider to fill out the paperwork. Get an outside nurse practitioner or MD to do your paperwork. The VA will accept outside DBQ for Aid and attendance or homebound.

Question? I recently had a heart attack and had two stents placed In my circumflex artery totaling 50 mm.i was station in QuiNhon Vietnam in 1968 within walking distance of Phu Cat airfield one of three bases that flew agent orange . I believe this is a presumptive condition. I am currently in cardio rehab .can I make a claim and if so what claims should I apply for and thru who the Va,VA, or a law firm ?

@@stevenstyles2363 I'm not going to look at this article, but if you are saying TDIU will end when SSAN starts, that is not true. Spouse did not get TDIU until age 71. Age is not a factor. He was 90% and this was just the route taken to finalize the 100%.

No more dbqs is bullshit....means nothing. VA will still accept dbqs. You dont need to do a video. I just told you, for free. Finding a doc to fill them put is the rub. Stupid too. Docs write about what the vet tells them. Duh. Many scammer docs out there too wanting $2,000.00 to read your file first, then charge you to fill out a dbq. Scumbags. You fill it out and take it to your C&P if VA sets one and say-- here, these are my symptoms. Who knows better than you your demons?

All of these programs are based on V.A. and SSI, SSDI. What about the people who are Federally Retired and V.A. ?? My husband was in Navy for ten years and we married after he was discharged. He passed away in 1995 . I’m now 73, are there any V.A. gains for me? We were married for 28 years and I never remarried. We both worked for and retired from the USPS him, 33 yrs. Me with 29 yrs. And because of the double dipping rule ( I don’t understand), I don’t receive SSI. !! Now what??

I would check with your county Veterans Service Officer, but I don't believe you would not get any benefits unless he was service-connected and died from it when you guys were married, or, he was receiving a wartime pension when he died while you guys were married. But don't take my word for it, call a VSO and meet with them to make sure.
