What is a trademark?
The word trademark is made up of two words trade which means business and a mark through which your customer identifies your product or services.
Why do you need a trademark?
A trademark is only proof that tells that you are the owner of your brand. Incase if someone copies your brand for their business you can prove that the brand belongs to you and take legal action against them and stop them from using it. This is the exclusive right a trademark gives you.
What all can be a trademark?
A brand name like “Airtel” can be a trademark. A logo or a symbol like “Nike’s tick mark” can be a trademark or even a slogan like “What an idea sir Ji” can be a trademark. In short a brand name, a logo on a slogan can be a trademark. So far we have seen what is a trademark? Why do we need to trademark? What all can be trademarked?
How to apply for a trademark?
Applying for a trademark is a very simple thing. The entire process is online and can be completed within three to five days. There are just two steps involved in applying for a trademark.
1) First, we search the entire trademark database to check the availability of your brand name and then send you an authorization letter which is to be signed and sent back to us. That is all needed from your side. We then apply for a trademark with the trademark registry and share the Government's acknowledgment with you. Immediately after that, you can start using the ™ symbol next to your brand name.
2) After we have applied for a trademark, your application goes through a series of government procedures. This takes about 18 to 24 months after which you get the registration certificate. As soon as you get the registration certificate, you can remove the ™ symbol and start using the R symbol next to your brand name or logo.
How much will I have to spend to get that trademark application?
