What Gary said at 6.00 - „if you think you‘re getting married and having children with somebody, and then when the marriage doesn’t work out that person should be left with nothing: don’t get married. You don’t understand what marriage means.“ WORD. I might borrow this quote as a legal counsel.

Whatever. This is an old man who married a girl that looks like a child. No one deserves free money. Fair child support, yes. Spousal support for the rest of their lives? Absolutely not.

@@AnimatedBlast the System in most countries foresees a split of asset for the duration of marriage. In case that’s substantial, the spouse would get a handsome sum they can either keep or divest from (which would make them cash you could see as accumulated spousal alimony for 20, 30, 40 years). When the law foresees that as the norm and the wealthier spouse to be wants to find a different regulation, it is only fair to foresee some kind of monthly payment until remarriage. It S not s Gift - it s agreeing to regulate differently than the law would foresee.

I remember as a child, I had very little exposure to divorces and broken families. Once I hit my 20s, suddenly so many of my family friends are going through messy divorces and I could see how it impacted the kids, even if they were my age at the time. Years of resentment and unresolved issues can make someone really difficult and even selfish and irresponsible during a divorce. Even then, I realized that what's worse than an angry partner during a divorce is an angry partner who cannot leave due to financial instability and is forced to remain in the marriage. That's just terrible for everyone living under the same roof. Despite being raised with a conservative upbringing, I agree with you and Gary. A prenup is important in modern marriages to safeguard the future of both parties. Even though growing old together through years of marriage is a beautiful idea, the future can be unpredictable.

If you know the history of Valeria you would know she comes from a traditional background and would marry someone that is mature such as Gary. She’s a free bird but also admires stability

Okay, dang!! Gary had some GREAT stuff to say in this video; I loved this! Especially the emphasis on this being an equitable protection for ALL parties--that if you're committing to the love and respect and partnership of a marriage, you are also using a prenup to commit to the most equitable and respectful resolution of one, too. I've never heard of a man, or anyone, talk about a prenup in that light before. I am really impressed with you both. Wow.

I really respect prenups and the agreements that are made within this. It is so important for both parts to have like what Gary said a «plan for war», cause you never know what could happen! Especially in the western world, or where I live (Norway) it is so common to get divorced, and all of the «other stuff» that you have to deal with especially when kids are involved, it just makes things even harder if a pair were to split up. And this is just a way to handle it «better». Where I live, couples who only live together, not even married, are recommended to document an agreement which states what should happen if they were to split up. Kind of a prenup, or a contract, if you will! It is sad tho how prenups are portrayed as something so bad! So nice to hear this! Love it!

Being married is one of the most financially and legally significant decisions a person can make so thank you for talking about this. My partner and I are broke millennials with no financial stake in getting married but even we are both dead set on a prenup. It has everything to do with how you want your relationship to function and the safety of both partners/any children if the relationship dissolves. It’s naive to assume that marriages don’t end. Moreover, questioning the strength and longevity of your relationship shouldn’t be viewed as negative or distrustful. That being said if you have an unfair arrangement that needs to be addressed. Wouldn’t you want to find that out about your relationship beforehand instead of blindly assuming everything will work out in your favour.

But to be honest, sometimes I really miss your videos where you just do your makeup and tell us about your thoughts, or your "girls talk" videos. Very informative. An important topic to discuss since many people take it personally and think it’s thinking about the end before it began but that’s exactly what saves you from lots of headaches if you ever get a divorce. Divorced people always say „the person I divorced isn’t the one I married“ …

@@ValeriaLipovetsky Nicely said, however, the only people who would discuss a prenup is if there is lots of money to be protected. Most people without money would not pay a lawyer to talk about their future. So again it falls into the trust department. Just feels like you are going into a marriage that needs more trust. In the end, the person who doesn't mind so much will sign. It's not bad, it just means the signer is just easy going. (maybe that's a good thing)

I think a prenup is very necessary especially if you’re thinking about having children. If one partner dies with debt it can protect you from being responsible by making a clear distinction of what is there’s and what’s yours. It’s like having life insurance. It’s important to have.

When prenups are brought up, it says alot about the relationship. People are free to make up their mind on what relationship they want. But it says alot about it.

agree. gary was older and saw his own parents divorce. he obvious;y likes to be in control. HE PROLLY DOESNT TRUT VALERIA DUE TO HER AGE. PLUS HE SAW HIS DAD AND MOM SPLIT S THAT MIGHT MAKE GARY NOT TRUST PEOPLE

My mom always said: A prenup is solid foundation for your marriage. Its a really good way of sitting down with your partner and talk about everything the future will hold. Some marriages fail (specially young) because they realize they don't have the same views like for example in children and their education.

I definitely agree that a lot of people go into marriage or even a long-term relationship without actually discussing their expectations around core life issues like children and finances. I don't think a pre-nup is necessarily the best way to address this, but I do think that more people should seriously look into pre-marital counselling as it's an excellent tool to open up communication and actually think about and discuss these things. People often seem to spend more time planning their wedding which is one day than preparing for their marriage which is a lifetime.

@@msmarya100 well not everyone can afford it. Counseling can be more expensive than hiring a lawyer. Moreover this is 2 in one. You talk about it and protect both of you at the same time. But you are so right, if the same effort put into a wedding would be into preparing for marriage a lot would be different, and counseling would be ideal.

Very educating video! Thank you for your opinion. Still I am getting a kind of passive-aggressive vibe from Gary which I hate because I “know” that he is not that kind of person and it’s probably just because he is very confident… but he does not interact with Valeria at all and gets easily offend, he acts like a strict teacher who needs his students to understand the given information because the time is running off. Valeria instead is really relatable and takes her time and is chill. I would really love to see both of you interact more and respond to one another’s opinion. Don’t get me wrong, I am just describing how it seems to me and the feelings I am felling with it because it makes me feel uncomfortable getting something taught in the way Gary is and that is my issue but I just wanted to share it with you. I absolutely admire both of you, am so excited for your podcast and I feel like I can learn a lot from your mindsets.

I have a friend who lives with her sister and before they became housemates she drew up a contract. The contract was a good way to discuss things and make sure they were on the same page before conflict arose. (Her sister is a lawyer). I think prenups can function in the same way- making sure both parties on the same page and making sure there’s a contingency plan in case anything happens. Marriage is a legal contract and a pre-nup allows you to tailor that contract to what your relationship needs. That said it’s super important for both parties to have their own lawyers. So I’m glad you raised that. Never sign anything without asking a lawyer that isn’t working for the other party.

Another good way to ‘prepare for war’ so to speak, is to get to know your partner for a while before commitment. Watch how they deal with conflict, money etc. In my personal opinion it’s much better to marry someone who you know will act with integrity (and you too) in the event of separation because they’re a good person. Not marrying someone who in the event of divorce has to be forced into things because of a contract. It shows you don’t know them enough to trust they’ll do right by you

I agree with this! But I think its still a good idea to have a prenup just so then you are both on the same page - just to have a plan incase things go awry. Kinda like how people plan for their own funeral lol it will just make it easier on everyone if it needs to happen

@@mackenzybarry6625 if that’s what floats your boat go ahead! But pre-signing documentation about your divorce BEFORE you sign a document stating you’ll be together seems ominous and contradictory. Like if you need lawyers to start your marriage, it feels like you’re planning that lawyers will be how it ends.

The reality is no matter how much of a decent person you marry - people change... and not always for the best. Having a prenup, I don’t think it takes away from the romance and love between two people I think it’s just another decision two people in a relationship make and shows a level of maturity which I think is a better way to start a marriage.

These videos are honestly so educational! My parents never talk about stuff like this, its very taboo in my culture to talk about money in general. So if the prenup states that you get to keep everything you made before marriage, but everything made after marriage is split 50/50. That would put Valeria at an extreme disadvantage because she was so young when she got married she hadn’t had a chance to start making her own money. Then when she started her social media empire that’s now making A LOT of money she still has to split that 50/50? Whilst Gary gets to keep his assets from pre marriage. Gary has really won the jackpot here; a beautiful wife who has given him 3 boys whilst she started an extremely lucrative business.

In Mexico this so normal. You have to decide when you are about to get married whether you want to split everything or separate the assets acquired before marriage. We are getting married next year under that separate assets scheme.

So interesting to contrast this with my Catholic view/background. If one is Catholic, getting a prenup would actually be grounds for annulment/invalidation of the marriage contract. Basically: if you get a prenup before marrying, you didn’t even really get married because you didn’t *actually* promise to be bound (contractually!) until death . Since that’s what a marriage contract *is* for Catholics, a prenup makes contracting marriage literally impossible lol (Of course there are civil divorces and merely civil marriages, but once a *valid* marriage contract is signed you will be bound by it in the eyes of the Church/God for your whole life, until at least either you or your spouse dies). Us Catholics take this “one flesh” and “until death do you part” thing prettttty seriously. Marriage is kind of nuts! But wonderful!

@missClaire9087 separation isn’t ideal, but can definitely be necessary for the safety of the members of the family (esp/usually the woman and children). The hope is that the family can ultimately be reunified, but that doesn’t usually happen. In that case though, separation still doesn’t mean the marriage has ended. Each spouse is still obliged to remain faithful to the other, and should hope to reunify, etc. You really are still married forever (despite separation) because of your vows. In sickness and in health… including spiritual/mental sickness and health! That’s the wild commitment of marriage- that is, it’s a real, permanent commitment lol.

Interesting, my 16 mth marriage in the Catholic church is still recognized38 years later since I could not afford an annulment through the dioceses of Los Angeles?! Well I guess my subsequent happy marriage after, to a Lutheran is illegal? Well I don't consider myself Catholic anymore for some serious reasons anyway...

Great video, Great details on the topic by Gary! Very much appreciated. Although I wish Gary was allowed to dive more into the technical aspects. The specific details are very helpful. Valeria! Your audience is now 30 year old women!!! We now have money, not like it was 5 to 10 years ago and we were in our 20's. This day and age, our 40 year old men have no stable jobs and have been living on their mommy and daddys money! We need this advice for our own sake. The tables have turned and the *detailed* pre-nup information is important to YOUR audience, we are not 20 year old babies anymore!!!!!

You guys mostly touched on division of assets but another reason to get a prenup is division of debt. If one partner accumulates a ton of debt during the marriage, in the case of a divorce that debt will be split among both parties, even if only one of them knowingly accumulated the debt. At least it’s that way in the states

In the states, if you get divorced, that debt still belongs to the original borrower - you don’t need a prenup to say that. The law already covers it. And even if one person takes on debt during the marriage, it’s rare that the other person is on the hook for it if it isn’t in their name. In most states, separate debt is separate debt.

Interesting video, but I'm not sure if a prenup is only a Canadian/US thing. Correct me if I'm wrong. Because in my country a prenup is very unusual and I don't know anyone who has it. I actually didn't know what it meant until you explained it. I personally am not for a prenup, because I would then feel like being in a business relationship instead of a love relationship but I won't judge anyone who has it. My husband and I trust each other enough and can talk reasonably enough no matter the circumstances so I believe that we could figure everything out between us without a contract in case we would split up. So to each their own.

Yeah and in my country my lawyer told me that barely any prenups stand up in court because it’s easy to prove that circumstances have changed enough in your life from the time you signed it. So judges often rule the couple is no longer bound by it and their divorce will go ahead like they never had one (e.g. the spouse with lower assets/income has since had children and now believes that has changed their opinion on how much they need/deserve post divorce etc.). Prenups can be a really expensive legal exercise to just be eventually thrown out.

I’m a young lawyer in Europe and prenups exist. Perhaps, it’s not common, and the couples should be those who start this conversation with their lawyers before marriage, otherwise the marriage contract will be therefore be applied under the principal rules that exist. I sense that many couples don’t actually know it exists.

I really really appreciate this video because my partner and I are in the process of getting a pre-nup and when it was first brought up I felt very nervous about it because of how people portray it in media. I definitely felt more comfortable after getting my own legal advice but I do feel like this video has helped me understand the benefits of both having a clear understanding of what might happen in case of a break up and it will help me explain it to friends or family who have only seen it through the media.

Her money and business were created during the marriage, so it would be considered a marital asset and therefore split 50/50. Although they may have a shareholder agreement as I’m sure Gary helped with start-up funds. So her business may be protected through that instead of the marriage….

@@estherolalere1138 Well maybe for her youtube videos she only needed a camera but she did hire a videographer later, when she started the business you need money to invest to produce all those products before you start selling. They had a team before they even sold a piece of jewellery, So yes, you do need funds because there were a lot of fixed costs there for the office, for the employees which you need to pay even if you don't have a lot incoming.

When I got married my husband had much more wealth than I, but I insisted on a prenup because he was retired and I still had some working years ahead of me. He also had children and I did not. There is no question what we will have if our marriage fails. A good lawyer will make sure you are protected and it's fair.

Prenups remind me of a great real estate agent when buying your first home. Home buying is confusing and complicated and stressful, and a real estate agent is there to help mitigate the logistics. Imagine going through a breakup when you're married (with kids, with assets), BUT you only have to deal with the emotional side of things because the logistics are already taken care of. Yeah the break up sucks, but it would be so much worse if you had to make big decisions while going through a really hard time too.

Prenup is an act of love because with one you will take care of each other and make sure you're both going to walk away with something. To me it's also an act of respect towards the other for acknowledging their hard work and devotion from before and during the marriage.

Hi ! Very informative video ! I do think that it's VERY important to do research. Ask for legal advice 😊 In France we have a legal matrimonial regime that applies if nothing else is chosen but most parties do not look carefully on what that regime entails. We have 4 different regimes + the option of a mariage contract. I am not saying that using the mariage contract road is the only good option (IN FRANCE), some regimes are very good BUT I am saying no matter what don't choose by default choose because you are aware. And do that, no matter where you live in the world. Honestly I am in law school right now and it's frightening to see some cases where people just had no idea what they were getting themselves into.

Me and my husband don’t have a prenup but having a prenup does not equate to them believing or thinking that in the future, their marriage may not work after all. This is not something you foresee when you enter marriage. If yes, then why marry? Do I believe in it? NO but I respect you couple for agreeing to have one. Again, every partnership is different so do whatever works for you! 😊

That's such a great topic. I would like to see a follow-up on the specific clauses that can be considered for the agreement. What are typical questions to cover there? Fire example, my friends got divorced and as they had issues with unexpected things. For example: - The family of a girl gave her an apartment as a present. They were using it to rent out and she was supporting her parents with that money. The guy was never involved in managing or using it. So to me it seems fair to not split it - Company gives stocks as part of a compensation plan to one of partners. After the divorce another partner wants to get it. It looks bizarre - Both partners are individually investing into stocks, ETFs, crypto etc. One partner is making wrong decisions and ends up in a negative balance. Another partner is not that risky and is saving money for retirement. I don't think they should split one partner's money between two just because the first partner was stupid. I'm sure there are many interesting scenarios partners should discuss. What are the other scenarios you advise to bring on a table?

too much cold calculation involved (too much of a mathematical approach)when it comes to entering a marriage with prenup (i have to STRESS in my opinion )because you marry someone when you LOVE them so much you do not care about anything especially about the business or money , you marry someone when you BELIEVE you truly know the other person so much that you are proving you are ready to take the leap of faith and risk everything, nothing else matters, that's why you say the vow (in my eyes) . if you need a contract - you need reassurance , you are not ready, you predict a failure in your head, you do not believe enough, don't marry if you're have doubts and 'what ifs'.. or that you even THINK that the other person expects!? anything from you in terms of money- BUT its how (I STRESS )-- I -- was raised - that vow and true love and marriage raise above the money , that true faith (im Christian and i understand not everyone is and i respect that) does not need contract - that would be contradiction .Well done for sharing a piece of your life though and if you happy - you do you:)

This video makes me uncomfortable. In California, when you divorce, you split everything 50/50. That’s what seems the most “equal” and “fair.” The person bringing the prenup to their partner is inevitably going to be the one who wins, b/c the contract was designed *for them.* In many cases, that person will end up with the “power” in the relationship and an unhealthy dynamic will develop. Very glad everything has worked out in this case but I can’t with men trying to justify protecting their own butts in the name of “equality” and “fairness.”

this assumes that you actually know what is in a prenup in every instance for every couple, and also that the only thing that will give one person in a relationship "power" is a piece of paper. both assumptions are wrong. If a woman had built a multi-million dollar business and then got married, does her husband deserve half of that multi-million business if they get divorced? How is 50/50 fair in this scenario? If you worked for 20 years, like Gary did. Built a business, sold it, built another one, invested....why would Valeria be entitled to half of it if they broke up? What if she left him? What if she fell in love with someone else, and abandoned the family? Men DO deserve equality. And they DO deserve fairness. They are human beings and no less, or more, than women.

Hey. This is the second video in the youtube-universe I have ever commented on, so it is probably going to be a big one. Skip if desired. Interesting video! I was very curious to see the comments. A lot of people get angry (also in this case) about talking in a business like tone about "this romantic event of love". Sure, most people get married because they love each other but the getting married part is on it's own only the biggest contract of your life (well, if you do it once). The fact that this contract is so over-romanticized makes a lot of people get very emotional about prenups. But why? Getting married myself very soon, I noticed how a lot of people flipped out about the idea and compare it to not having trust, lack of love etc. But if you really really think about it, it is actually a very nice thing to do for your spouse if you have good intentions. Having a prenup means that you make non selfish decisions for the future at possibly the most loving point of your relationship. And not only for yourself, also for your children. So what is the harm? I compare it to having full car insurance (living in Europe, not obligated). Is my fiance accusing me of being a bad driver for suggesting I have one? No. Will I get in a car crash soon? Not planing on in. Could it still happen? Yeah. I think most people would not take a suggestion to have a full car insurance personally, because buying a car is obviously in no way a romantic event. So yeah, it is just a cultural stigma, that unfortunately leads to broken families be more broken after a long process of who gets the grandmas toaster. Just get the "marriage insurance" guys. Ok, rant over. P.S. Before anyone starts with assumptions, my parents are divorced, my spouses parents are still married, he suggested the prenup, I gladly accepted. Also English is not my 1st language. Try not to be nasty I have a cold. On a different note - Valeria and Gary, you seem very smart and considerate, have a beautiful family and seem to have a good base for not needing to use your prenup; wishing you all the best in the future. xo

I think is a matter of culture and personal beliefs is about how do you understamd marridge and life... there isn't a "right" or "wrong" choice, there is the right or wrong choice for each kind of cuople. What you are describing is what is know in Spain a " separación de bienes" ("separated properties") witch means what you create while during the marrige is split between both partners. And not having a prenup is not bad, If you and your partner have the same way of looking at at marrige... that is , if you truly believe in the bows " whats yours is mine and whats mine is yours".... the same goes with " in sickness and health"... Again, is not about what you have (money, properties etc) is about what you believe in and what kind of marridge you want . Solía pensar igual, pero ahora estoy a favor de la separación de bienes porque aunque confíes en tu pareja, si un día se va a la quiebra y empieza a tener deudas tener esta separación haría que tanto tu pareja como tú pudierais vivir con tu dinero. porque tú no debes nada a nadie. no solo sirve para un divorcio y aunque tengas una separación de bienes se puede usar el dinero de la otra persona igual, pero entiendo que la separación de bienes no es para todo el mundo

Wow! Thank you so much for sharing. This is such an amazing insight on what a "prenup" looks like for different cultures and beliefs. I completely agree that there is no right or wrong, it works for us which may not work for everyone else. 🙌🏻

A prenup can be a very useful way for the partner who has less to protect themselves. Not all states have the same laws and people should not just assume that the courts will give them 50% of everything. Especially if the other person can claim that they got the bulk of their wealth prior to the marriage. If you marry someone who is a lot wealthier and they offer you (and your children) a certain lifestyle then a prenup can really protect you if things go bad. I would get really specific around the level of income and assets you would expect if you separate. Without a prenup the wealthier person can really lawyer up and/or hide assets, or god knows what else. Its really nice to believe that the person you are in love with today will always have your back, but statistics say otherwise. Protect yourself and don't naively believe that yours is the perfect relationship that will stay perfect forever.
