My husband was a 24 yr veteran and he passed away last Nov 2021 at 55 yrs old from Pulmonary Cardiac arrest and secondary pneumonia. He was service connected for hypertension and was diagnosed at 27 yrs old. I was denied by the VA for DIC saying the hypertension did not contribute to at least 50% cause of death. I appealed and was denied again. He had a stroke in 2011 due to hypertension being uncontrolled although he was on medication for that. I am sure that hypertension caused his heart among other things to become weaker over time and it did contribute to this death. I am very disappointed that the VA has denied me. I just feel lost and abandon. My husband served honorably for 24 years and this is how the VA responds to the widow. I am just hurt.

Did you go through every appeal that was available to you? My heart goes out to you because I lost my husband in 2011 due to a cancer that I believe was caused by his service. I'm currently in my final appeal and I don't have a lot of supporting evidence but I do have one doctor's letter. I'm hoping to hear the final Verdict by the end of the year. Really hard when we know that they serve their country and suffered physically so badly and there isn't always a compensation for that I hope you can appeal again.

@@Savannah-ed4rv I am so sorry for what you are going through. And yes I did appeal and I was denied again and was told in writing that this was a final decision and that I could not appeal again. I know the hypertension my husband was diagnosed with early in his career contributed to his death but unfortunately I have no say. I hope and pray you get approved for DIC. As widows of these service members I believe we deserve at least that much.

The Hypertension diagnosis MUST be in the death certificate, as a co mobility or contributing factor on the second line, since it was not his cause of this. This is how we got our Hospice patients the DIC benefit upon death.

@@maxruiz187 The ICU doc had no idea of m husbands history AND I was in shock watching all this fold so I have very little memory of that day. I was very ignorant of the process that would follow. I reached out out to the doc that signed his death certificate to show him my husbands medical records and he won't even talk to me. I am so disappointed.

I would recommend that the surviving spouse get a VSO(Veteran Service Officer) to help them fill out the DIC form and gather all the necessary history/info. Get it right the first time, even if it's a straight forward claim.

Aloha, THANK you for your dedication to this cause. my best friend's VET. spouse, who had already been acknowledged as totally disabled, with a valid marriage of over 50 years, is currently battling with the VA DIC over his "questionable" disability..after he had been diagnosed with agent orange related kidney failure. He had been on dialysis for years. He was on active duty in Vietnam when exposed to A.O. He also had a history of PTSS, and partial dementia, hearing loss, and a number of conditions, all related to the original cause. All documentation of marriage is available. He just died early this month. please address this concern in your next video.

I can sympathize with your friend. We went through all the hoops trying to prove stuff. Kidney cancer then Prostate Cancer then Kidney cancer in his lung then Prostate cancer in his bones. The Prostate cancer is stage 4 and A.O. related. He was Coast Guard and thank God he is a pack rat. It truly helped to have some of the stuff. It takes a lot to satisfy their requirements but it is worth it. Tell your friend to hang in there. It should get better. This video might be from 2020 and a lot has changed. Get someone from Veteran's Services to see if they can help. They were awesome for us.

You would think a disability connected to agent orange would cover just about any cause of death because of it's toxicity. I believe there's a list of 7 or 8 presumptive conditions related to agent orange and the list keeps getting longer every year, or so it seems.

I don’t think they discussed “added amounts for surviving spouses.” The monthly payment rate of $1340.14 non-taxable is not the end of it. Added amount will be given to the spouse of a totally disabled veteran (rated 100%) falls to a certain condition as unemployability for at least 8 full years leading up to the veterans death and you were married to the veteran for those 8 years. Added amount will be $284.57 . If all is true to you as a spouse, you will get a total of $1624.71 . That even goes higher up to $332 of added amount if you as a spouse have a disability and need help with regular daily activities (Maybe to help with caregiving expense)

Yes you are correct about everything you stated. I am a %100 percent disabled Vietnam vet for over 30 years and my wife had a massive stroke in 2005 and is in constant need to take baths and to have a cook and housekeeper and I was told by the VA themselves that she will qualify for everything that you state in your comment

Yes my father served in the Air Force from 1970 to 1976 and he passed away in 2023 and we filed for a dic and we still have not gotten nothing at all from you from the VA

I do not know what dic application applied to me and my minor child since my husband was honorable discharge year 1992. I'm in my 50s my son is 8 not sure if I'm eligible . Thanks

My husband died suddenly with a brain bleed.Contributing diagnosis of hypertension was on the death certificate and service related .I filed right after he passed last year but denied as "it wasn't service related" I received a letter in Nov 22 about changes President Biden extended in Aug I filed a second claim Jan 11,the specialist who helped me file again ,expressed surprise the claim wasn't approved when clearly hypertension was on both documents as listed above .It was fast tracked to be looked at again,decision pending .4 months now .Does this mean I will get the benefit??

The va will look at what was the cause of the death , and if that veteran was serviced connected for the condition he died from , so the death certificate plays a big difference for paying a spouse DIC benefits

We can not use our grandchildren yet we have “guardianship”!granted from Courts as they were put into foster care so we started with kinship care. We have them for last 10 years and I don’t understand

What if the spouse was not aware of TDIU (Va) benefit but was declared disabled at age 57 due to cardiac issues. He obtained 60% rating for cardiac in 2019 plus 100% for deafness. The VA rated him too low for his cardiac issues but I was discouraged to appeal (don’t rock the boat)! He is 81 yrs old , & not in good health, I doubt that he might live to the 10 year disability mark. What can I the spouse do? Do I have a recourse to challenge. I will need DIC benefits should he not live up to 10 years!

My husband served for over 30 years of service, after he retired he recieved 90% disability pay. Then we found out he has Leukemia and he has refiled his disability pay and they said he will more then likely get 100% now. But the leukemia will probably take him before ten years, so does that mean that I will not qualify for DIC when he passes away? We have been married for 30 years.

My dad passed away a couple years ago and was recieving benefits, and had been disabled for 10 plus years. He did go to prison and died while in there so is there a way for my mom to be able to recieve those benefits. I know she is recieving widows benefits through social security but it's so little that my mom is barely getting by. My dad didn't even get a proper burial.

I am a Widow, my husband passed away in December 2017 ,they only send me 50,000 for back paid and I waited 4 1/2 years, I am disabled plus I take care of my two adult children

Social security uses a rate that estimates the amount of money you would have made by the time you reach 67 years of age. So if you're 100 percent permanent and total you should file for SSDI immediately.

It was sad, in my case. My husband file 6 years before he died and he got nothing but the run aroung... then I realized after he died and they told me - He only served only 19 and 4 mo and he was not in long enough for me to get any benefits... and He had lung ,back , hearing, seeing problems.. ended up with a massive heart attack before his cancer e en showed up.. The military just brushed Tom under the rug.... and me now with him because I only get 50% of his pension and it's not enough....

ok, it does not matter how long a vet served, as i served just under 3 years and got 100% military connected disability, ok it sounds like you need to hire a attorney most will do like you do not pay unless they win and i think most will get paid thru what you get ok, but you will need to provide them with the paper work and stuff to help them get started ok, so all and any thing you have on your husband is what you need to provide to the attorneys ok.

I am disabled with IU at 80 percent but I am paid at 100 percent for over 20 years I never have a CP Exsam I was sprayed with A/O in Vietnam I have had 5 Bypasses 7 stents, and two strokes , and two strokes and PTSD. I could never understand why the said I could not get 100 percent I have been told that I am the same as 100 percent but not P&T on my paper work.

Can you guys talk about how SBP (survivor benefit program) intersects with DIC. For example, I'm paying for SBP and I'm realizing I'm qualified for DIC (over 10 years post 100% PT rating). I hear they're are offset to DIC if a veteran was paying for SBP but in that case, why pay for SBP. Is there a greater benefit to continue paying into this program?

Hi Elizabeth, our website states "The disabled veteran must be rated totally and permanently disabled, have died in active duty or the line of duty, or died from a service-connected condition for their family to be eligible for these benefits. They may also have been rated permanently and totally disabled at the time of death due to a service-connected condition." 100% SC but did not die of the SC condition(s) is generally a denial. However, 100% SC 10+ years or IU 10+ years is automatic grant (unless the spouse murdered him/her).

Nobody addresses that the pension for widows of 💯 per cent disabled veterans receive a miserly pension against the cost of living

I am trying to get DIC for my grandpa who doesn't understand this whole process. His wife (my grandma) served USN in the late 1950s. She lived with the effects of MST all her life (but never put in a claim for it) Nevertheless my grandpa was loyal until she passed of leukemia in 2015. could I help him put in a claim for DIC? How can I prove that the leukemia is connected to her time in the Navy?

How do I get my Benefits started when he was 100% P&T & we were Common Law Married in DC & now live in Kentucky (they don't have Common Law Marriage but do recognize it from another State or Territory)? Please someone help he was our only source of income & I need some serious help!

When it comes to the VSO will they actually help or automatically tell me no I can't draw because KY doesn't recognize Common Law Marriage? Somebody from the VA answered a question like that w/ that answer however that answer was correct b/c of the DOMA of 1993!

@@patreaedison1059 I am sorry, I do not have any recommendations for you in your area. There are very strict rules when it comes to receiving DIC and common law marriage. A VSO should be able to give you accurate information about your specific circumstance.

My husband passed away on July 10 1991 at the VA hospital inwest Roxbury Massachusetts! The only benefit Ireceived was the VA paid for his burial! I received no benefit from the Va and after reading all of theninformation regarding DICmi feel that I should have received a benefit! Does the vet have to be 100% PT for 10 years or only 100% (without PT) for 10 years in order for the spouse to qualify? Reason I ask is I am 100% PT but have only been PT for 1 year however, I was 100% without PT for 9 years prior to the PT upgrade last year. Thanks

Vet has to be either rated 100% service-connected and die of that service-connected condition in order for the spouse to be eligible for DIC payments. On the other hand, if the Vet is rated IU (not PT) for 10+ years then the spouse would be eligible for DIC payments (under USC 1318). 100% PT is different than 100% SC or IU. If none of those apply, then the spouse may be eligible for survivors pension.

My husband had a sore throat in 2014 so he went to the VA and they scoped him and that’s all they did and they said oh it’s just inflamed go home and drink water well this went on for two years. I finally got disgusted with the VA and I took him to an ear nose and throat doctor in 2016 when the specialist examined him, he said why didn’t they ask for a biopsy because he definitely has cancer so he got the hundred percent enduring. He died in 2018 at home and I had to watch him bleed out because it was cancer of the special all the specialist looked at him and he said we need to take a biopsy which the VA never did because if they would have done a biopsy, they would’ve known that he had cancer and I have all the paperwork and on his death certificate, it says he died of agent orange and this went on for four years and now I have PTSD from all the stress that I had to do because Feet he became a monster yelling at me screaming at me for four years, but I wasn’t going to leave him because I had been on disability since I was 15 and the Social Security took me off at 65 so I’m only making 800 a month there and I’m making a little over 1400. The total amount is 2100 a month and I hate getting nightmares every day I wake up screaming they took him to seven. He was only 71 and if they would exit, examine him the VA and gave him a biopsy they would’ve caught it sooner and I have documentation on all of it, can you help me under malpractice because they were god awful. Please let me know my number is 760-447-1014 and my husband was army Vietnam first calf and he served for two years and we were together for 35 years and it just devastate it was horrific, watching him dwindle away, when there was nothing I could do if the VA would’ve just given him a biopsy the day that he went in. He could’ve been cancer free but now they told him to go home and drink water. I finally took him to a specialist and he was diagnosed with stage four cancer which last 2016 and he died in 2018 so would this be considered malpractice because they didn’t do what they were supposed to do the doctors were like 80 years old. It was absolutely horrifying if they would’ve done the biopsy my husband my been alive today with the cancer in if they treated him sooner and now I’ve been diagnosed with PTSD because I watched him die in front of me downstairs in my house because he wanted to die in the house, and I had to watch him die, and I do have all the paperwork of what the other doctor said said, so can you help me on the malpractice suit? I have all the documentation.

And I’m going to be 70 years old and I just am living on 2100 a month through the VA and Social Security so I had no choice but to take my horses out and do rides with them and I just had a hip replacement. It’s not very fun. I’ve been sicker than him for 15 years I always thought I was gonna die first but no he did and he never been sick a day in his life because he always went to the doctor the VA doctor.😊😊😊😊😊o L m I’m I’m N N

I heard if the veteran was married to his spouse for at least 8 yrs it doesn’t matter what he died from. The spouse can still get DIC ? Is that true ? Gary

Their death has to be caused by their service and you need to prove it to the VA.

My husband had ptsd he was abusive,I took he to courth for that he took my Doughter to live with hi an used to play with mi mind making el biliebd some thing wAs going on between the m. I divorced because he was making my life miserable! It was so unfair we were married for five years he was 100% disable and died on 2011 since then I am trining to get same help please help me

Seems to me you didn't care for him when you were married "he made my life miserable" and you DIVORCED him. Therefore you don't deserve one damn dime. Go to work, stand on your own two feet. End of story.

What if my terminally ill (Throat Cancer) veteran husband has never made a claim- can I file now? He has never filed or gotten a cent from VA- tells me they will bury him- I say not without filing- how can I go forward to get his benefits for his son and I?

@ruth thomas In the tragic event of his passing, you may be able to file a DIC Claim (Dependency and Indemnity Compensation) if he passes from a condition related to or attributed to his time in service. You don’t need to prove a service connected death if you were rated a 100 percent for at least 8 years and your spouse was married to you for those 8 years prior to death.

So.....i am 70% for 7 year's. I guess my wife will get nothing....since I'm not 100% and over 10 year's. We got married while i was in the Army....still married at 53 years.

My husband was honorable discharge he had 10 years in my entitled to something he had a flag at his funeral had the gun shooting he had a son that was 13 years old at the time 12 years ago he passed away are we inside of something I just found the paper like a year ago almost a year

No, if he had no VA related disability that contributed to his death then you won't qualify unless you have evidence that can show that he "should" have had a service connected disability that contributed to his death.

I recently started collecting my Ex- husband of 16 years n hv 3 children which are all grown up. I never knew dat I cud collect as a divorce n never remarried. I was wondering if I can maybe a payback for all the years dat he was deceased. Not tryna b greedy here, jst info I never rele tjot about or looked into till o e of my son's told me to mk a claim. Allison can you collect on your ex-husband if you were married for 11years,And he die and he was in the army.years ago in the Vietnam War, He was shot in Vietnam on his back for several months. And you could no longer live together for medical reason.your life was threatened, And he was abusive,in many ways.He was service connected condition. Heart problems,Kinney problems,Diabetes, acholic.Can I receive any kind of benifits.unable to work and disable unmarried.
