Wisconsin man Zachariah Anderson faces trial for charges in connection with the disappearance and death of Rosalio Gutierrez, Jr. in May 2020. Anderson is charged with first-degree intentional homicide, hiding a corpse, and stalking. Prosecutors allege Anderson stalked his ex-girlfriend and killed her new love interest, Gutierrez, at his Kenosha apartment. Anderson is back on trial after a judge declared a mistrial last year after only two days of testimony. Gutierrez's body has never been found.

The cruel n heartless defense attorney is NICOLE MULLER. I must agree with all hundreds of others, flirting with her own client in open court is not only disgraceful, but nauseating! What a detestable pair!

Long time watcher of trials. This is the first time i have to listen om 1.25 and 1.5 to get through this trial. Reminds me of a college lecture that never ends. Keeping the jurors attention will be difficult

Yes... I'm just now watching this trial and I'm listening at 1.75!!! I've never listened to anything like that before. A few of them sound fast but I can definitely still understand them. This trial could've ended a week ago!

He’s already explained his reasoning for long winded explanations. It’s to prevent appeals being granted because the appellate court doesn’t have to speculate as to WHY he ruled the way he did and wether it was fair or correct when they review the trial.

He acts like he's teaching law school going off on meandering topics and seems to make up new laws as he goes along. Geez usually it's just "Object" "overrulled" or "sustained" and that's that. Not going into an hour long explanation of his ruling every time.

Day 5 I'm still not convinced this guy is guilty. Aside from the fact that there is no body, no murder weapon, no confession and no proof that he was even in Kenosha that specific day. I see no evidence of a murder beyond a reasonable doubt. Stalking yes, murder no. A spec of a stain that appeared to be blood but was do tiny it couldn't even be tested to confirm it was blood does not convince me. No proof that the remnants of clothing found in the fire pit even belonged to the defendant or victim. Nothing is concrete here it's all circumstantial and a lot of hearsay. Nothing at all that makes me say without a doubt that the defendant committed this crime. If he's found guilty which I suspect he will be because of everything the judge has allowed the prosecution to ask, do, and say that I don't believe any other judge would have allowed I hope he can get it overturned or get an appeal.

I completely agree with you. So far, if I was a juror on this case, I would say not guilty. As a female who has been through a horrible relationship with an obsessive and very controlling man, which relationship has changed me as a person, I can sit here and immediately say the guy is guilty. But putting my personal feelings towards men aside and just listening to the trial thus far, it's a not guilty from me.

How is his bank account not relevant? If he's not using money then it's another indication he's dead. It's one of the indicators police use when investigating missing persons. This judge needs to be firmer in his decisions.

Yes and they found NOTHING of evidentiary value. So they wasted all that man power, all those resources, and all that money on absolutely nothing. Her point was they managed to use all the people and resources and money for this burn pit search but couldn't test more things for DNA or blood because they claim they don't have the money or resources for that.

This is actually a strategy the prosecution is using to make the defense look insensitive. They are purposefully asking questions in a way they know will be objected- in a sense they are using the defenses own strategy against them with this witness. And it’s working - because we all see the defense council as heartless now. Pretty clever huh

That's not the purpose of trials. She should not be allowed to talk about those things. It has nothing to do with whether or not the defendant killed the son. Whether they have shared bank accounts or whether he was the biggest momma's boy in the world have nothing to do with whether or not he was killed by the defendant. That's why we have the objection of relevance.

@@legalvices his mother is a criminal lawyer herself- I believe the prosecution team and she both knew if asked certain questions that the defense would object repeatedly- using their own strategy against them in a sense. They already knew they were “objection happy” and in this situation they knew it would make them appear insensitive and disrespectful towards the mother. It’s a brilliant plan honestly. Kudos to the prosecution team.

Some of them are, some of them aren’t. I cannot wrap my head around “I collected evidence because I thought it was relevant” calls for speculation, as an objection indicated. But defense did win several objections.

If they object to every little thing then it won’t reflect so badly on them when it’s significant. It’ll be less obvious to the jury that they’re worried about a particular bit getting through. They also repeatedly upset the flow of the presentation of the case and might put the jury into a state of annoyance reducing their ability to absorb information well. Also sometimes they have a valid objection.

The defense knew from prior days the defense was “objection happy” so I believe they purposefully asked questions of this witness in a way they knew the defense would object and I also believe the mother knew about this strategy as she is a criminal lawyer herself. The prosecution used the defense’s own strategy against them and it was extremely effective in making the defense look insensitive in the eyes of the jury. It was a no win situation for the defense- either let her testify to everything relevant or not or object every time a question elicited a response and make them look heartless. It was a clever move.

This courtroom need to spring for better quality witness stand microphones. It’s as important for jurors to hear unmuffled witness testimony as it is to hear crystal clear questions from attorneys.

I can’t remember the last trial I saw where each table had multiple attorneys and one attorney did all the questioning (except one state witness on direct got a chick instead of the guy). And at the start defense said one of the guys would be handling all objections… so much for that

Okay wait ✋️.... Sadie was supposedly so worried and scared for her children after going to the apartment and discovering the bloody scene that she told officers she needed to go and get her children to take them somewhere safe. Oh Ms. Sadie no no honey. If you was so very concerned and worried for you're children's safety and well being you would not let them go to they're fathers home for any amount of time let alone 3 to 4 days a week. That house is a huge safety hazard!! I don't buy it Sadie.

Check out Burgos-aviles case. His defense attorney shamelessly flirts-gives him eyes and then at one point during testimony she rests her hand on his arm and leaves it there for moments. I think they need to do psych evaluation on these defense ladies before they are matched up with narcissists as clients. They clearly love their attention. Gross!!!! Wonder if she will write him in prison!😊

So he’s adhering to the strict rule about the murdered victims mother not wearing a remembrance ribbon - yet he flat out *TOLD THE JURY* he has let in alot of evidence that shouldn’t have been, things that would normally be inadmissible but he figured it was ok. *WHAT?!?!*🤔🤨 How does that makes sense?!?! (Except for the fact that 1- this judge often doesn’t make any sense & 2- MARK JENSEN… there’s the real answer. 🙄😒 )

In her defense, the DA does it just as much if not more. The judge loves it, he even called it "spirited discussions". This needs to be retried and judge needed to retire at least 10 years ago.

​@@beeslikesteve it may not be proper, but who is going to know?? These are regular people that can easily develop a bias over something like that and then let it color their view on the rest of the trial. Many many things can have an effect on jurors. Doesn't make it right, but it is what it is.

The prosecution knew from prior testimony the defense was “objection happy” so I believe they decided to use it against them with this witness. Also, the victims mother is a criminal attorney so I believe she knew ahead of time that this was a strategy and agreed to it. The prosecution would purposely ask her questions to illicit “objectionable” responses. This puts the defense in a no win situation- if they don’t object, she gets to testify about every little detail of her son (relevant or not) and if they do object- it makes them look insensitive and heartless. It’s really a brilliant move on the prosecutions part - even forcing the judge to have to sustain many of the objections making him to appear insensitive. At first I asked myself - why is the prosecution asking questions they know the defense will object to - then I realized it was purposeful. Court is like a game of chess - there is alot more to it than meets the eye. These people are extremely smart.

this judge puts too much of his own personal interpretation of the law up rather than the actual objective law. letting certain things slide while also letting other thing be let through because of "blahblah " is unjust.

Not that the trial needs to be slowed down anymore than it already is by objections, and the police witnesses seem to struggle…but to me it looks like the prosecution gets away with basically testifying for his witnesses…. Long drawn out scenario questions that makes his point that can be answered yes or no… is leading not a thing In Wisconsin?

I noticed the same thing from the very beginning of the trial. I also see a lot of people in the comment section who has a problem with the defense attorney objecting, but she’s doing her job. You have to understand. We may feel a certain way about a case but what we’re watching is the operation of the American justice system on full display she would be doing her client a disservice if she didn’t raise objections, or if she allowed the state to lead a witness which is against the parole rules of evidence and Testimony can’t be elicited from a witness by either side, leading or suggesting testimonial evidence

The prosecutor asking whether the door was open or closed when the impact occurred is not creating a sequence of events. She had the jury sent out because apparently she lacks basic listening skills.

Seems to depend on the judge but could vary in each jurisdiction. I've seen some cases that judges give strict instructions when people testifying are leaving the stand for breaks, etc. that they are still under oath and aren't allowed to speak with anyone about their testimony and I've seen others, like in this case, that do not. It's also interesting to me that some of these judges aren't asking if witnesses can be released from their subpoenas. This one is especially awful.

Maybe, maybe not. If scene wasn’t discovered until 2 days later and heavy rains still happening and possibly people walking through the area. It may be camouflaged at that point, but honestly that’s a fantastic observation.

It’s an implication that the perp most likely knocked on the door and hid, the victim would have opened the door and immediately ambushed being likely hit with something like a baseball bat and then the pushed into the apartment, closing the door behind them. This implies that there was no reason to check the bedroom window for dna because it’s clear the point of entry was the front door.

I am only an hour in so far but the defense should really rethink her strategy. I do not think the jury will take kindly to the constant objections and her tone. Tbh idk if I'm going to get through the entire trial. Between the Defense and the Judge (bless his heart), idk if I have it in me. I find myself fast forwarding quite frequently.

Defence was correct -- Officer Van Wie is no blood spatter expert. I had a simple introductory course and could do better! (Example: the best he could do when asked on number of blows was "minimum one," and "minimum two." By calculating the angles of the blood drops, you should be able to count the blows and come up with a number. Like "five," or "twenty." Example: When there is straight-on round drops, it's as often as not from a *weapon* not a person - especially when it's an attack. You or I might create such a blood stain if we cut our finger and let the blood fall. If someone is being attacked, she's likely to move. In the opposite direction.)

The only way I can watch it is if I forward when the defense attorney cross examines the witness. She has no respect for the judge and speaks to him like a spoiled child. I’m sure at some point the judge was very “with it” but at 77yo, I think it’s time to retire.

Swear to god, my nightmares are now riddled with "Ahhhhum"s. This judge is a seriously threat to justice...He has no business still on the bench. For getting basic law codes, lost as to who's doing direct n who's on cross, 2-hour ruling break-downs, talking objections, open attorney arguments in front of the jury, justification allowing talking objections in front of the jury...not to mention his audible cell alerts n frequent message checking while in session!! I'd hate to put my life in the hands of such incompetence! They need to inact some age restrictions with cognitive tests.

the detective did an excellent job in testimony, he was very clear and concise especially given his limited time with the knowledge of blood splatter, defense seemed to respect him and was less aggressive in her line of questioning, which is really important that the jury see her as humane. If a man is aggressive, society is okay with it. Just unfortunate reality that women are harshly judged.

The prosecution should be ashamed of themselves for not informing the victims’ mother that it was NOT her responsibility to clean up the crime scene. There are State-funded crime scene clean up companies that will do that for the families in Wisconsin. The fact the mother ALSO found evidence overlooked by the police, is just pathetic & sh*tty police work. Defense counsel has been on it today and it’s good to see a team taking the “vigorous defense” literally; whether the client is guilty or not, everyone should have a defense team going hard for them.

When the scene is released, chances are that the prosecutor isn't involved yet, so how could it be their responsibility? Some people choose to clean up themselves, by the way. It gives them closure.

I tried looking for the reason myself, and it seems that on the 3rd day of testimony, they called the woman to the stand who showed up to the victims apartment complex the night of the incident and she testified that she thought she was at the correct building but infact, found out that she was at the wrong building all along. Seems the prosecution was not aware she would testify to that and the defense was definitely not aware that she would testify to that, so they asked for a mistrial.

How is he allowed to say “blood stains” when at the time the photos were taken, they were a “brown substance.” I thought that saying “blood stains” was a guess because it hadn’t been tested yet. I’ve just never heard it said before.
