@@Jimmycrackenbush perhaps she did... she was too polite. She probably shouldn't have warned him ahead of time of what was going to happen. In hindsight she should have just have waited until her partner arrived and they could have quickly surprised the person and taken them out of the car by quick overwhelming force and placed them in handcuffs then searched them. Policy policies due to current social climate are "handcuffing officers" to take every possible action to not offend or hurt someone...even if suspected of criminal actions and refusal to obey lawful orders. They even tried less than lethal force by what was allowed by law... and it got one killed. Not saying they should have just shot a person for not getting out of a car. Where is the balance to protect a person and the officers? Do we allow cops to ask 1 time for them to get out of the car or we just let LOE rip them out of the car and throw them to the ground and handcuff them? No one will go for that. Even if it could have saved a life in that situation. The officer tried to be compassionate and she asked him, then told and commanded him many times. The perp failed to comply, and it was obvious he wasn't going to. The male officer should have been more cautious... the use of the taser after the 1st attempt didn't work and it killed him ultimately. Do we let LOE try a taser once, if they still won't comply then go to next step up? Hard to be a cop. No respect anymore and lots of blame towards the one catching a criminal, instead of on the criminal.

His, the fallen officers family and friends, etc. Just comply, let them do their business and carry on. (I know, we all heard the “legally blind” comment.) He has read and heard the statements and evidence over and over. (If he hasn’t, he should have been disbarred before he got out of that courthouse the same day.) He’s either being disgustingly disingenuous, OR absurdly ineffective as counsel. (The defendant is without a shadow of a doubt, don’t misconstrue my comment.) Without argument…ONE OF THOSE TWO STATEMENTS ARE 100% factual. I am shocked that I just heard that.

She may have made a mistake, because well, shes a human being. The murderer made the choice to pull out a gun and fire it. Her pausing or stepping away didnt kill the cop. Him firing the gun did. Seriously, these LEOs face life & death situations every day. The stress, the snap decisions they have to make. Yeah, some are a**holes, but not all of them are. I cant imagine doing their job. Everyone saying the legally blind defense lawyer is going to cause a mistrial Maybe. Except the huge amount of evidence against the suspect might be enough despite the poor defense. Worse case scenario i will be retried but unlikely. Poor legal council is only legally defensible in the absence of outstanding evidence against the client. That's not the case here. His case is already legally boned due to the body cam footage. Any defense lawyer at this point is primarily going to try to negotiate down from the death penalty, but he is practically guaranteed to be spending jail time. They're not going to let someone who is clearly guilty due to indisputable evidence walk free on a legal technicality.

In this country, every person on trial for a crime is entitled to competent and effective defense, regardless of the evidence against them. This cross fell FAR short of that standard. For instance, the defendant may argue that the use of force was unnecessary and excessive, and this was therefore self-defense. Or that it is unclear who fired the fatal shots. Or that the defendant was unable to think clearly or rationally after being tased. Please understand, I think this guy is guilty as hell and should get the chair for cold-blooded murder. But he should also have competent counsel to defend him, and that's not what happened here.

I'm curious as to what strategy(ies) a defense attorney would use to win this case being that there is dash and body cam footage. Years ago I'd think you just sit there and let the defendant accept his fate. One of my professors made me realize even if a person is "dead to rights," you want to ensure that the trial and punishment are administered properly. With that being said, outside of ensuring that everything is done correct procedurally, are there strategies that one can use or am I there physically but mentally I'm elsewhere?

Under the law, if police use excessive, unnecessary, or illegal force, and a person fears for their life or great bodily injury, they are entitled to defend themselves - up to and including use of deadly force. There are several other lines of defense that may be available; I won't go into them here. But a good defense attorney could raise any or all of these arguments before a jury to (possibly) get an acquittal, a reduction of charges down to manslaughter, or a plea deal. As clueless said above, a last line of defense would be to avoid the death penalty.

The defense did not challenge, or even question, the legitimacy of the stop, the officer's ability to detect (by sense of smell) the proximity of illicit substances, the exit orders, escalation of force.., anything. There is a valid argument on behalf of Mr Dehart, and this attorney (public defender) agreed to make that argument; if he's unwilling/unable to do so, he should recuse himself.

Look, I am tickled to death if this guy has a bad lawyer, but not if it provides him grounds for an appeal. Did his lawyer really just start off by saying he is legally blind and therefore couldn't watch the video- the most important evidence in the case? And then he said he can't drive, so he has no frame of reference for driving offenses? COME ON NOW.....lets not just give this man an automatic appeal. Give him a fair trial- not because I'm worried about him, but so once he is sentenced he goes away forever.

Those 3 uniformed armed officer's, 1 in front of the judge & 2 directly to the left of Deputy Eggers are ALL on edge, she herself made a point of staring the accused straight in the eye's as she took her seat & gave her name & place of work to the prosecuter. The defence attorney didn't have to but he wanted to let her know how well she handled coming face to face with a man who rather than be charged with a simple DUI, shot & murdered her partner in cold blood then also shot at & tried to kill her before shooting her partner twice more (despite him not having moved since the first shot put him on his back in the dirt) before speeding off & fleeing. The motorists who came to her aid a few moments later literally drove into a sad & desperate scence, yet because she stayed clam & gave clear focused instructions they to stayed calm & were able to assist her untill a fellow officer arrived & took her in his patrol car. The whole time The poor lady who had to check the deceased officer also did a great job & stayed calm, she must have been deeply shocked at what she saw. Deputy Egger's directed everyone who came upon that scene to first check on her partner, her concern for him was as evident as her distress when the dreaded truth was confirmed. At No time during the entire incident did she disrespect the defendant, humiliate or curse him, she raised her voice only once & that was as she screamed "NO" as he needlessly fired his concealed weapon & took her partners life. Deputy Burrows arrived just as the acussed was becoming beligerent & uncooprative, this caused the deputy's 1st interaction with the suspect to become hostile almost immediately, yet even in that short time he remained respectful & professional even trying to reason with the man who just minutes later & completely without cause murderd him where he stood. I noticed the hard stares & open hostility from the defendants family as she made her way past them & into the witness box, it was a disgusting show of disrespect, arrogance & entitlement. I hope they felt a deep shame as much for that as for the defendants actions on 8th Feb 2024 after they watched what REALLY happended at around 8pm, even if they couldnt find the decency & humanity to show it. How the defendant can claim not guilty is beyound my understanding, i KNOW HE DID IT, i just WATCHED HIM do it, watched it twice 🤷🏼‍♀️, i sincerely hope & pray that the jury thinks the same, finds him guilty & locks him & the danger he presents to the rest of society.. lock him up Heartfelt condolences to the family of the slain deputy, support, good wishes & prayers for the brave & professional deputy, the members of the public who stopped to help & the fellow officers who arrived upon such a devastating scene. Best wishes also to the prosecuter for having the courtesy, good manners & humanity to praise Deputy Eggers for her bravery in coming forward to ask for justice for her fellow officer partner & probably her very good friend RIP.. Deputy Burrows 😢

I hope DeHart is expedited in his journey to meet his Maker. I hope Deputy Eggers is able to stay a law enforcement officer; she appears to me to be a great candidate to be a sheriff or chief of police in the future. I have to wonder, after watching hundreds of these video's, if the mom's and grandmas are as culpable in this sort of crime as the perpetrator. In more than half of cases like this the offender cries out for "mama". That makes me believe these women have sided with their kin no matter what they do...leading the offender to believe "mama" can get them out of this too.

You're a poor judge of character then. She let Greg just lay there and die and didn't even try to render aid. If I was on the that force I definitely would not want to work with her because of that fact. She should have rendered aid. If I were her superiors I'd have fired her as she's obviously not qualified to be a cop if she won't help her fellow officers in time of need.
