Hi Christian. Good morning. Thank you for writing back. Currently in Mexico, a foreign individual can purchase the property through a trust (Fideicomiso) if the property is within the Restricted Zone (50 kilometers from the coastline or 100 kilometers from the international border) or have direct title if the property is outside of the Restricted Zone. The trust has a term of 50 years, which is renewable. The long term irrevocable bank trust is privately held in a Mexican bank authorized to act as a trustee. The property is not an asset of the bank, nor are banks allowed to take any action without written instruction from the beneficiary of the trust. The bank holds title to the real estate in trust, and the foreigner is designated as the holder of the beneficial rights of the trust, which includes the right to sell, improve, and will to heirs, or exercise any legal right under law.
