Filmed 1/29/2024. It was a nice and beautiful day in North Platte, Nebraska. It was 63 degrees and we thought what a perfect day for Railfanning. The first train we got was a monster manifest with 6 locomotives in the lead. The train came to a stop on the rail crossing and remained stopped for about 5 minutes before it started moving again. We thought it stopped because they didn’t have a clear signal to approach down the line. But they already did. About an hour later 2 UP trucks came and accused us of trespassing and asked us to leave after a manifest had passed. After we left our sight, the sight where we have been bringing you content for the last 7 months, we figured out that the first train of the video that stopped, called dispatch and ratted us out! In almost 19 years of Railfanning this has never happens to us. Does that mean we are going to stop going there, absolutely not! We will back there asap to bring you more great AronKings content! I’m a retired Locomotive Engineer with 38 yrs service. I didn’t mind rail fans taking pictures or video. I always blew the whistle going by them because I knew it made their day especially kids. I’ve even got to know a few of the fans and actually got permission to take them for a ride. I’ve seen a lot over my 38 years of service I know things have changed. As far as I’m concerned take all the video and pictures you like, stay safe and be respectful when it comes to railway property.

The issue wasn’t him taking pictures. He was on the service road; Those service roads are for railroad personnel only.

@@rc391995 I worked for CP Rail then we were short lined and then called Ottawa Valley railway. I worked my last 14 yrs with them. I loved that job right to my very last shift. We had some nice long curves where you could see your whole train, I’d look back and think wow, I’m in control of this long train, it was a good feeling.

I too am a retired engineer with over 50 years of service. Had my photos taken of me 1000s of times. Agree that railfans are fine but when they walk on the right of way or climb onto the locomotives or cars then bets are off.

I got a question what are the rules about letting non RR employees / foamers on the locomotive for a ride . You do that stuff on the NS and get caught they will put you on vacation permanently .

He was on the service road. He was trespassing. And he knew he was too because he’s done this 50,000 times. He gets *ZERO* sympathy from me and nobody else should feel sorry for him either. He’s scapegoating the UP workers when they were in the right and he was in the wrong. Fuck this guy

@@rc391995 with in board cameras and outboard cameras all the fun has stopped. The RR officials can access any camera from a laptop remotely. This ended the fun. Plus a few foamers have come up on engines and have injured themselves suing the RR. Just be cool and take your photos off of the right of way.

@@rc391995 with inboard and outboard cameras everything is recorded and lasts for 15 days. A few railfans over time had injuries and sued the RRs.. post 911 also curtailed rides. The only way would be for an individual to write the PR Department of a RR and ask for permission. If accepted then there is a mountain of paperwork to sign to eliminate any liability. Good luck.

I used to railfan CSX along "The West End" a year or two either side of 1990. I usually went out after 3pm. Never had any problems, although on a couple of occasions I stopped in at one of the towers and the operator I knew alerted me that officials were around so I thanked him and got out fast before either one of us got in any trouble. I had guys on the engine throw off "Crew Paks" to me (usually missing the paper cup). I stayed off access roads as a general rule and off bridges. Nearly all of the tower operators were glad for some company and I gave most of them copies of pictures I took. Sad to say, all but two or three of them are long gone and those exceptions are past 80 now. Has it really been over thirty years?

I like the fact that this pissed of crew had the gall to call it in as a Trespassing incident to get the track inspectors to show up, since UP probably can't keep any UP POs around anymore, like us employees. Everyone is quitting and running away from Jim Vena 80 million dollar bonus to destroy

Where is the proof the crew called anybody Foamers ? It's MOW and a high rail waiting there turn for track time. Nothing went on here other than he was standing on RR property . It was nothing left for the guys to do. If the foamers got a leg cut off from dragging equipment then what. Hell you guys try anything walking up in tunnels out across bridges where there is no place for them to go. And that is why they use signs stating no trespassing. I've seen it mire than once for myself. Oh absolutely lets see how far we can wander off out there to see if we can beat the train or just drive around the gate you can maker it. Happens everyday !

The main reason this happened is if an accident happened, you had a camera to take a picture and prove in court the railroad was at fault. Come on everyone, think about it. Its simple why this happened!

*As a retired LEO I'd suggest getting an APP on your phone that shows property lines so when morons like them go out of their way to make your life miserable you'll have evidence to prove them wrong. Not sure if you railfan with a scanner but you should always have one with all the RR frequencies punched in so you'll hear callouts like that and when you do just move along until the next day. It's easy to dodge their crap and have defenses like the property line application. Also, you should ALWAYS record encounters with RR employees who are challenging you in case they do or say something they shouldn't. Never get into a situation where it's your word vs. their word, record everything.*

Always carry a scanner on you to monitor the railroad's frequencies. That way if a crew calls you in to dispatch you can get out of there before authorities show up. Access roads along the right of way are usually railroad property. The farmers property is up next to the access road, so you would have to get his permission to be on his property. Ask first before doing it. Problem is now that you have been reported there, they will be watching unfortunately.

I don't know what their problem is but I didn't see you trespassing or anything like that. But next time, film it and report them to Union Pacific for harassment as there is no need for them to be idiots and if they don't like being filmed then maybe they should get another job off the railway. As an ex-railwayman myself. I encourage you to continue to enjoy your hobby and please don't let these morons stop you from doing what you love. When I start filming trains again for real, I will record all incidents and any abuse will be reported to the railroad company. Keep up the great videos and I have subbed. All the best Peter.

Absolutely ! And wonder why they got run off. We wasn't doing nothing just filming a train while they trespasses totally oblivious to anything dragging or bein pelt by loose coal hanging over the edge of the car as it's running 50 mph or however fast he was running . no proof of an encounter they don't intentionally stop after getting by a signal then it gets to the point you have to run restricted speed to the next signal. That's another PIA .

Nice video, thanks for sharing. AMTRAK 318 Lincoln Service Missouri River Runner, depart from Independence Station (IDP) awhile back. I could barely make out a guy in the locomotive vigorously pointing and me as if to say "GET OUT! GET BACK!" Normally, I have positive interactions with conductors that recognize we film because we envy conductors while appreciating and sharing train videos. Somewhere in my subconscious, I knew I trespass each time I film from the rocks, so I've always known what he meant. But it was the first and ONLY encounter like that. Nobody showed up to arrest me because I was out of there as soon as I lost sight of the train's ass. I target AMTRAK rather than freight - just so long! However, there is a LOT of train activity at Union Station in Kansas City, which is situated near a regional train hub, from what I gather. I am not sure what these are called but its like a train roundabout. AMTRAK uses is after the 2nd train in to KC to turn around and prepare for the 1st run the next day. From this vantage point, I will film Big Boy 4014 in this yard when the 4014 comes through. I bet they will stop at Independence station so I can get video of the coming and going. Yay!

Having worked at North Platte the gravel road next to the track ballast is railroad property. That is a railroad service road. Railroad property is 100 feet on both sides of the center line of the railroad roadbed.

Oh man - that engineer must have been having a very bad day. When I would watch the trains in the Cajon Pass, they would wave, honk and understand that we loved everything about them. Maybe they'd had problems with people hitching rides, but you were clearly not doing that.

When I railfan the Triple Track, I never stop at this crossing other than a stop to get pics of the detector & the signals, I always try to hit towns along the line & safe public crossings and at a safe distance from the tracks either end. I still consider UP is a railfan friendly railroad, just depends on where you end up at, I have a few friends who work the UP & they always enjoy the presence of railfans.

And then when he finally got caught, instead of accepting he messed up, he played the victim and scapegoated the UP workers. He knew *EXACTLY* what he was getting into, and he did it anyway. And he knows what he’s doing by posting this video. Your luck will run out eventually guys, and this video is living proof of that.

Nice to see the eastbound coal train which should be headed for Weston WI. They talked about closing three plants this year and it won't happen since the amount of renewable energies coming online is very low. The 56 Frac sand cars will go to at least Butler yard or Adams WI for a regular Freight to take the rest of the way. Hope you have no further problems up there as Major hubs bring out the best locomotive sets and freight car consists

Definitely not worth arguing over. I've had a crew or two that weren't thrilled with being filmed. Most of the time get a nice wave, horns, bells etc.. im guessing you ran into one of the grumpier crews at the end of their run.

Please explain what it is that gives you the impression they are grumpy. And just because it don't fit your lunacy don't count. A train stopped nobody go off and said anything to anybody nobody shouts at them a couple of maintenance of way people pull up they get accused of running him off but you see absolutely no indication of any such action first it was they stopped to run him off he was braking very hard before he got to him he got by the road crossing he clams he stopped at he got by a clear intermediate signal by half an engine length . you just don't stop with that much effort to rat on a kid. You have no earthly idea of lateral pressure placed upon the rail with something that heavy that's something you try to avoid at all cost . Their is risk involved to set one down like that there is a risk to the crew and risk to the foamer you have absolutely no idea . could be the track dept showed up to inspect the rail after such an aggressive stop. You know nothing about operating RR equipment you can quit pretending like you do . Drama Queens.

I used to live near a line with only one road train both ways daily that was class 2 (25mph freight). There was some time that I had a work schedule that allowed me to photograph the trains regularly (Often with good power and good lighting). The 25mph made it easy for keeping up and shooting multiple locations. I knew the crews were starting to get sick of me when they started trailing toilet paper out the window when they would see me - my shots would end up with toilet paper down the entire side of the locomotive, LOL. But OTOH, I was around so much that I ended up being helpful a couple of times by offering a warm ride back up to the head of the train in frigid winter weather. IIRC, there were some other fans that used to put EVERYTHING on youtube, and there had been an incident where higher ups nitpicked all the videos until they found a fault to reprimand a crew over. I railfan because I love trains - growing up, my grandparents lived right next to a Conrail ROW, and I have been fascinated ever since. One of the reasons that I purposely don't put any of my pictures and videos online is so that I don't end up being the reason for someone getting in trouble. This is a hobby for me - but a career for the very people that I shoot.

I railfanned on lots of UP and BNSF right of way and never had any trouble. I'd listen to my scanner with three Nikon cameras around my neck and my tripod to the side. Occasionally I'd hear a track inspector say " smile that guys down there at mile post such and such takin' pictures. I got lots of good stuff and an from time to time an Amtrak woul come through!

I never had a problem with railfans, unless they are where they're not supposed to be. That access road is railroad property. Unless there is clearly a good spot off railroad property, find a small town or secondary road to railfan from. Nice videos.

Sorry to hear but if you're not on their property and on public property they cannot tell you to do anything! It's simple, we the people have the right to be free and do as we please as long as it's not illegal! Love seeing some of the older cars on these trains, still miss trains with cabooses. SO, stay on public property and keep those great videos coming.

And you also earn the right to be asked to get off the property. Just like you can't just walk in anywhere and deerhunt without permission . So what's the problem walk back 60 ft from the rail and go about your business you've complied ..Can't do that huh not close enough right ? I bet he don't own a zoom lens. Claiming to get runoff and no evidence of it says something here. If want to hear what exactly was said . he could have told him to go pound sand or jyst maybe he was asked to get off the ROW . What is it you foamers like to say ? Something about there goes the walk of shame.

I just noticed the RFID readers along the tracks. I don't see those often in videos. It's a good catch.

Great video you shared with us of the UP trains passing through! I think it's a little ridiculous for them to stop the train to report you guys. From the camera view you were more than far enough from the tracks. Apparently the Engineer had someone shit in his corn flakes or he was on the rag. Lkke others have mentioned abt a handheld radio to have to save yourself the BS from the other RR employees acting like the FBI. Cheers from Laurel, Delaware USA.

That first train with the tanker cars: I can understand why the engineer called-it-in about those civilians being close to the track, as he may have had concerns about [ahem!] 'mischievous activity' being done to those tanker cars; as tanker cars can create a lot of issues.

Don't know the reason for the hostile reply. I was a conductor for Southern Pacific. I saw people filming and taking pictures all the time. Again if these people were at the side of railroad crossings or in other areas not blocking vehicle tracking or blocking rail operations then I do not see the reason for the issue. Now granted, I worked for SP from 1994 until 1996 when I became injured and could no longer work for the railroad and rules may have changed, but based on past experience, I stand by my opinion.. @@rc391995

That road is probably part of the ROW so you may have actually been tresspassing. Be lucky you didn't get an unfriendly encounter with the local sheriff's deputies. This is a common problem with people railfanning up on Sherman Hill because there's only a few spots that are not either private land or ROW.

Some few crew members are bitter and angry about their employer, and so cannot fathom why anyone would enjoy trains. Have had a couple of run ins with such men over the years. But, that is their problem. Being at a gated crossing, no trespass is involved! Keep up the foamer video's!

According to a special agent I talked to , the railroad ownes 50 feet on both sides of the tracks . So they probably count that road as there property

That's weird. When I've railfanned the UP lines around CO they usually give me wave or a horn blast. I suppose post-9/11 everyone assumes the worst nowadays.

find public spots such as public crossings and other places to catch some cars. I did see one spot that might been rr property during the video, but the crossing had a good chance to be on a public road.

The guys in the trucks are most likely "track" or signal maintainers, maintenance of way, communications, etc. If you are too close to the tracks the crew may call you in. If you look like you are tampering with the equipment or other nefarious activities then yes they are somewhat obligated to notify the dispatcher. I think most crews really aren't out to get rail enthusiasts. Stay out of the gauge and a reasonable safe distance from the ROW. Be friendly and respectful and they will return the same.

They had a clear signal. There was definitely something else going on and I’m about 100% sure it’s because the engineer had to use the bathroom because they were slowing down way before they saw you. They took the clear and stopped. I never saw a crew get out. Yes I saw the trucks. One may have been a manager but the the other was section or track rider. I was a UP conductor for 20yrs. I didn’t see a problem unless your down the road standing by a signal mast.

Oh and that detector on the other side of the crossing is one of the most expensive and sensitive detectors on UPRR's system And they probably are sensitive to you being ON the property and so close to it. 50ft back from the center line of the closest track your next to is where UPRR property ends so take a tape measure out 50ft and if your beyond that theres nothing they can say to you.

That’s not why they reported them. They reported them because they were blocking a service road that UP owns just because they wanted to get better shots. In other words, they were trespassing just to have better shots of the trains. I’d rather have a slightly shitty photo/video than risk being arrested. If they were too close to either the tracks or some equipment, they probably would’ve just blown their horn at them or get out themselves and tell them to stand farther back.

As an ex gov't employee who had a friend who was a court officer, in the N.Y. Metro area, he had stories about Lawsuits by Tri-State, YAHOO'S, who would have an Ankle Sprain, Trip & Fall, or other injuries, on M.T.A., Conrail, or Other railroad Properties, AND THEN, have their family members, Sue, for their Spouses', "Inability to perform, Bedroom Acts, to the 'Satisfaction, of their Marital, or other PARTNER !" (Sounds RIDICULOUS, but TRUE !) There are MANY '{Choose your Religion}' Lawyers, who will jump at the chance, to squeeze a buck, out of a big company !!

You know something my grandfather worked for Southern Pacific until he retired and he would be so happy to know that people were taking pictures and waving to the trains and yes times have changed but some people weren't brought up from the past times when people had true values and respect. I think this is disappointing that people think they have to go by the BOOK every time something happens like this anyway there should be nothing wrong with this so you should keep on trucking with taking loads of pictures and waving.😀

I'm a conductor for a Class 1 railroad and I can say, you were not trespassing. You are at a public crossing! You were far enough away from the tracks. If I was one of the train crews, I'd give you a wave and leave you alone. I can tell who are railfans and who are not.

They can only kick you off of their property. Stay outside the fence line and they'll have nothing to say about it. UP is a big company with a lot of clout, chances are whoever owns the land next to the tracks won't even care if you're there as long as you are not damaging anything or leaving a mess behind.

Been watching rail vids over the last few years, and this is the first one about an unfriendly rail crew and rail company there. In my part of the world, this is almost a norm, since railways are owned by the federal government, there is an overbearing restriction on the photographing and filming government property, including trains - a throw-back legacy of the colonial era, imposed on the native populace during WWII, but continues as a 'petty-bureaucratic policy', decades after Independence from our colonial masters !

Not sure they can tell you to leave a public roadway, as long as you are being safe. My guess is they might have been extra protective of the instrumentation visible in your videos. Those are something I've yet to see in railfan videos, and I'm not sure exactly what they are for.

I am not familiar with where you are, but those look like trackside detectors in that area. I suspect the first crew lied to DS saying you guys were messing with the detectors, when your clearly just filming trains. The UP responding vehicles look like a Signal Maintainer truck and a MOW hi-railer. That first crew just hates rail fans is my guess. Sorry that happened to you. 🤗

That's simply a car reader. It aligns with a plastic piece on each side of the car. Gives info of the whereabouts and destination of each car. He wouldn't have stopped to radio dispatch . what would be the point in stopping. I'd say he was likely asked to stop to be realigned . or PTC got him or a fault got him. You all make to much Drama out of things you think you know about but intact you all are totally clueless. Stopped to report him. How ridiculous ! Pfft . foamers .

These people are lucky they didn’t tell management to call the police. And you can clearly see at the beginning of the video that they were on a service road for those tracks. UP owns that, so they have a legal right to cry trespassing.

Union Pacific is the largest railroad in the US. They have their own police force. Probably worried that U R going to report them for still running rail cars that they have written off the books for taxes. Why do they have all those locomotives stored out in the desert?

Another reason as to why you were asked to leave is because there are hazardous materials in some of those tankers and boxcars. And seeing as you didn’t seem to be recognized by the crew and you were on private property they do have a right to tell you to leave

If the RR property extends 50' to each side of the rails then you were trespassing. I've read some train crews don't mind it at all, as long as you stay a safe distance away from train, while others are real jerks about it. And they'll call the sheriff etc. to chase you off. Man, I wish our P.D. & S.O. wasn't short on sworn officers and had time for low priority calls but they're about 140 short at the moment so the bad guy's kind of rule--at least till we move out of state that is...

No, *but they do own that service road he was standing on in the beginning.* In fact, I just realized he’s only doing this because he’s triggered he got caught trespassing and couldn’t baby his way out of it. So throwing UP’s workers under the bus was his way of crying to us all. NO SYMPATHY whatsoever from me. He knew he was trespassing. Its most of the time 25 ft outside the further rail. Sometimes more if needed if a train passes through a rail yard on either side you measure out 25 ft on both sides of rail farther away. If its two tracks running north and south you measure out 25 foot from the eastern most rail and also the farthest western mist rail . its at least that in some cases it's more.

There is a law concerning railroads across the continent Canada USA MEXICO that can have you removed if an employee thinks your suspicious they should call the feds or police and you will be removed. You don't have to be doing anything suspicious just look suspicious and filming can be deemed suspicious
