I would 2nd that. Additionally authorities have to be held accountable for their actions otherwise authority becomes corrupt. Now media in collusion with the governments it is down to the individual to ask uncomfortable questions whilst risking everything. This is testament to the selfless courage of David McBride brought about by an unshakeable knowledge between right and wrong. Such people are deserving of the highest admiration and gratitude. I think anybody thinking of joining the armed services should deliberate long and hard about what this ruling could mean for them. You will be forced into helping cover up the next lot of war crimes. I guess we now know why Australia has a Kangaroo on its coat of arms, its the symbol of how our courts work.

I was under the impression from my time in the cadets years back that a soldiers duty included * provisions for the refusal of illegal orders, which would mean that when presented with evidence of such events there is a duty to act?

The disgusting thing is it appears the government sincerely believe there is one set of laws for the people, and an entirely different standard for them. If the tables were turned and it was Australian civilians being killed by an invading force, no one would accept "they were following orders" as an acceptable excuse - because it will never be an acceptable excuse under any circumstances.

David, that was so well said. That was inspiring to me. If I may, i want to share something I never talk about that your words about Duty made me think on.. I lost a dear friend in Afghanistan, Lance Corporal Leon Smith. He was a Combat Medic for the NZ SAS. His senior officer, on a night op, put him on point. He was shot in the head by a 14yr old kid who has lost his Dad the day before to a stray. In your experience in the military, where should a combat medic be in a line of soldiers? On point? Leon would never say no to an order. Except when he did to save another soldier that was his bro. He ran down an alley into direct fire, jumped a wall and somehow carried his mate back to his squad and then resuscitated him and for that he earned the New Zealand Gallantry Decoration and Charles Upham Bravery Award, yet it was following his "allegedly" corrupt and rotten to the core commanding officers orders that cost him his life. You know any rotten CO's mate? What you are doing is not just important for Aussies. It is for all soldiers and all citizens in the Commonwealth. I am sorry that puts more weight on you. I wish i could take some of the weight off your shoulders. Thank you for fighting so hard David, I can't imagine how you feel I just pray you keep finding that amazing strength you have. This has truly diminished the honour and integrity of the ADF and our legal system. I hope more young Australians see this and recognise that if they join the ADF, they are considered a tool of the Government, used to follow orders.

I have only read one high court judgment, and that is when my employer sued my colleagues (the employer sued the employees) and me; the judges seemed quite reasonable in that decision. Hopefully, they will hear your case and apply the same reasonableness.

I'll admit that most of my knowledge of military law is from American TV and Film, but I know that Australian judges can use American law as a reference point when deciding a case. But isn't there something, at least in American Military law about not following illegal orders. EG: The CO tells the soldier to kill the civilian, the soldier is allowed to refuse as the order is illegal. If the Australian judge is saying all orders must be followed, then they are saying even illegal orders. Seems very appealable, especially if we have something similar to my example on the books (not to mention all the UN conventions we have signed about human rights, Nueremberg etc).

You're right as far as I can tell (about the principle, not so much American law being applied in Australia). In the appeal judgment it's said "The notion that a soldier's “duty” could nonetheless permit acts, as the argument was openly put, in breach of a lawful order where the source of the authority to act in that way is said to come only from the terms of the oath is, in my respectful opinion, an ambitious one and certainly not one as to which it appears Mossop J's ruling is likely to be found to entail error." As you can see here, the findings presuppose a lawful order. Any example of an order that is clearly unlawful, such as those associated with the Nüremberg defence, would not be lawful orders so there would be no need to appeal to any higher principle. I did a brief search of the news relating to the history of this matter and it appears that at some early point it was accepted by the parties that the orders were lawful. This meant that later on the only argument that could be put was that there was an even higher duty, one derived from the oath to the sovereign, that permits soldiers to disobey lawful orders. That was obviously going to be a difficult argument to make. If you can disobey a lawful order on the grounds that you think it would be against the "public interest" it's difficult to imagine what lawful orders you would have a clear duty to obey. Unfortunately the public discussion of the rulings seems to omit the words "lawful" from any mention of order or orders. But there was never any dispute that unlawful orders can and must be disobeyed. This judgment in no way impacted that. The discussions on KZfaq and Twitter seem not to mention this, leading to a misunderstanding that is causing very understandable outrage. You can find the judgments online if you want to look in more detail and confirm the facts.

With the US law thing, I am sure we have some mechanism to allow for judges to cite American cases (as well as British, and perhaps other nations) in common law cases, especially when there is no Australian precedent or legislation on the particulars. It does not carry the same weight as precedent, but it can be used to inform an opinion.

A person's 'duty' is to do the right thing. It's a moral obligation as a human being. Therefore, in this sense, the judge got the definition of 'duty' wrong. It's not a justice system, it's a misjustice sideshow. Corruption hates the 'antiseptic' of sunlight, hence the cloak of darkness and mystery. This is a win in fifth gen warfare against the masses. Regardless of what they said about obeying orders... those of us that have served our nation KNOW what we were instructed at basic training. Thank you Maj McBride, you are a true Champion of this nation. Personally, i would like to know where the 'Parliament of the Commonwealth of Australia' is in all of this, afte rall, THAT is the one true 'Government' of this nation. The Governor General, BY LAW, is the the 'Commander in Chief' of our Defence Forces, not the 'prime minister', as per: Ch12, Chapter II, ss, 61:...'The Executive power of the Commonwealth is vested in the Queen (now King) and is exercisable by the Governor General as the Queens (now King's) representative, and extnds to the execution and maintenance of this Constitution, and of the Laws of the COmmonwealth' and Ch12, Chapter II, 68: 'The Command in Chief of the Naval and military forces of the Commonwealth is vested in the Governor General as the Queens (now King's) representative. You mob can work out the rest for yourselves. We are being screwed over. Start reading the Constitution people. KNOW your Laws, rights and privileges. As the popo say 'ignorance of the law is no defence', well that works both ways. Use it!

Nothing new.. look who is sitting in Belmarsh Prison for the past 5 yrs or so now.. and Martin Bryant wasn't guilty but is the scapegoat as was Lee Harvey Oswald and so many others who were used as patsies.. same old playbook.. you have to keep the public dumbed down and ignorant.. you've heard the saying being treated like mushrooms well that's how it is for we the ppl.. at least David is still free (for now 🙏) and able to speak somewhat.. unlike Edward Snowden who also is better off than many others who pulled the pin on the real guilty parties (some seen, most in the shadows) and not forever silenced.. 🙏

NOT The Commonwealth of Australia as we should be.. we are supposedly 'under' the Queen of Au (like What Queen of Au) isn't is supposed to be (was) Queen Elizabeth II ? hmmm 🤔 Aren't we 'supposed' to be a 'Common+wealth' (that which is the Wealth Common to) of Australia??!! Not Australia Inc Registered on ASIC & the US Stock Exchange? In light of that.. what is Charles III jurisdiction over Au and who 'really' runs the place? There's some inconsistency with the ruling that I dont understand. If a soldier's responsibility is to follow orders first and uphold the rule of law second, what happens if the orders are illegal? For example if a superior orders a soldier to murder a fellow Australian soldier, and said soldier refuses to follow orders, could he really be held accountable for not performing an illegal & reprehensible act?

Mate, if you cop an ICO just take it - it's a pretty good deal considering how many people have it in for you. It's usually 500-2000 hours work in the community (I did 500 hours of groundskeeping at a local church for mine), signing on every day at the local PO and obviously not racking up any further charges while the ICO is in progress. Also you'll have travel restrictions applied, most likely you'll have to stay in your home state and probably not even go interstate. Pretty easy for someone like you who is otherwise a law abiding citizen. Best of luck, you're such a quality human that has chosen to be on the right side of history despite the obvious personal cost. We need more like you !!
