We are urging everyone to contact their Senator by going to Senate.gov (top left of the page: ‘Find Your Senators’). Or you can call your Senator at (202) 224-3121. That’s the number to the Capitol Switchboard that can transfer the call to any Senate office.

The FAA NEVER loses when a case goes up to the NTSB. There IS NO DUE PROCESS for pilots.

The problem is, the FAA proved their case. He is now appealing it. Have you been the subject of an FAA investigation? While they don’t need proof “beyond a reasonable doubt”, the just need to prove it by “preponderance of evidence”. A much easier burden….but it’s still their burden. Don’t be so quick to hop on the pity party here.

We are taught to ALWAYS do an inspection pass when landing off field. Eric’s comment was surprising, both Mike and I gasped. Clearing up the language in the rules will be helpful for the FAA and pilots alike and hopefully will help avoid future issues. Nice work! And thanks to Sen Budd 👍 . I’ll be writing and calling my senators.

I hope the FAA takes your opinion and others like Mike and Mark, who have a great deal of experience with inspection passes, into account. The FAA bad ruling on this issue will make flying less safe and that is not in anyone's best interest.

I have flown within a few hundred feet of boats, buildings, and people without landing many times! I fly an amphibian and if I see too much seaweed, waves too high, excessive crosswind, floating obstructions, etc, on inspection pass, I don't land. So sue me.

Shout out to Sen Budd for taking up the fight and coming on your channel. I make an inspection pass every time I land at the house due to hogs and deer here in east Tx. By your ruling my house is only 80 feet off of my runway in my pasture so I've been a criminal for the last 27 years

@@reason6835but your point goes both ways. One is it could add to buzzing. Which these guys don’t do…so a moot point. Or it could add to more hardships for a pilot that does an inspection pass and determines not to land. So you seem to have a one sided opinion. Obviously you don’t fly backcountry and certainly are a by the rulebook tricycle pilot that wouldn’t be able to land there if you wanted to. So you should stay away from that for sure. But maybe you armchair typed your comment not understanding how naive your comment was. And I’m a Tailwheel pilot as well. How about you gain some knowledge of the potential precedent as your outcome of thinking everyone will just buzz…is so generic. Not many pilots would do such a thing. If you are a pilot…you should focus more on your own skillset

So you feel you know with 100% certainty what he was thinking and planning to do? You are the clairvoyant guy that knows what everyone thinks and actually…know why everyone does what they do? Well of course. Obviously there are registered airports we fly over to land at where we’re right at and often below that 500 foot mark and within the grey area of the infractions that get under your sensibilities. Can we not go around there too or say…I’m going somewhere else? My point is about intent. Who do you believe can say what someone else’s intent is? Well besides you as you seem to have such a self proclaimed skill. We wrongfully imprison people every day. Do you truly trust government courts and agencies that much? You frighten me with your blinders

It's interesting, I am a Australian pilot and sometimes fly in the US. The aussie government are releasing KZfaq videos about pilot safety, one of them is the heights you need to be at above population. They are explicitly including "there are exemptions for landings, inspection passes, and missed approaches". So they want you to be able to feel like you can always go around and I'm guessing due to the FAA dragging their heals why they included it in the video.

@@reason6835you have to have permission to land at a strip is my understanding. So if they were deliberately directly overhead a house there would be still recourse.

@@RetreadPhoto that’s generally what an inspection pass is for.. to decide if it’s right or not. You can go to a field and it be perfectly fine then fly there and wind could change, you might see other obstacles you can’t see from the ground Inspection passes are necessary without the pressure to have to land there.

Trent, I have sent letters to both of the senators in Wisconsin. We appreciate everything you are doing and the community is behind you. I am not a Back Country pilot but love your videos and others of the Flying Cowboys as well. As you noted this would have a effect on all pilots so think you for all of your efforts and I hope the work of Senator Budd will end up helping to relieve you of the burden of this issue. concerning your issue and the FAA what happens to the small residential airparks that have homes on both sides that are less than 500' from the runway. I landed at one and it took me three passes to land so I would technically be in your same predicament, so I am in this as well!!!

This should not be a "Back Country Pilots" bill, this should be a much needed correction to FAA over broad power and a manufacture of violation. Trent re-cap: Little man FSDO employee gets FAA legal to support his wild claim to fame, (I hung a famous guy) NTSB single judge supports FAA, Trent appeals to NTSB and they support their judge. Folks! Nothing happened here! There was no crime, no damage, no one was in any danger, and no one got hurt. You want to waste $650,000 of gov money on this case when you (FAA) can certify a 737 without even ever hearing about MCAS?!?!? I think they should pay more attention to the stuff that actually matters. This isn't one of them.

This is great, Trent! This is what's great about this country. For every lazy schmuck we have in the government, there is somebody like Senator Budd who can actually think logically and is all for protecting the rights of his constituents. This is just a microcosm of the broader system in general where people are prosecuted by the law and the only goal is to win a case against them rather than making sure the person is actually innocent or not._* 😠😡🤬

There is nothing new in that - the adversarial law system in the "major western countries" is structured that way ie: You have a prosecutor (in this case the government and more usually the Police) and a defender. It is not the prosecutor job to prove you innocent they uphold the law by building a case with enough evidence, getting you off is the defender's job. Incompetence of the prosecution is another issue entirely. Two sides to every story that's why we have courts to make the decision.

@@zorbakaput8537 Hey buttercup. The prosecutor investigates cases to see if there is enough evidence to see if they can get a conviction and they purposefully ignore evidence that proves innocence. That's WRONG! A lot of people who can't afford a decent attorney are basically shafted into pleading when they are in fact innocent. Not one thing the OP said is wrong and what you assert doesn't make anything ok either. ITs WRONG! Also has nothing to do with 2 sides to every story. There are no stories here. Obviously in trents case he is innocent and the FAA doesn't care, they just want to win. Seeing how you hate trent so much you should find another channel to watch....

I've sent a letter to my Senator, Jack Reed D-RI. I don't have much hope that he will react in any way but to dismiss my email. But I tried! The FAA's overreach is truly monumental and unacceptable. Fingers crossed!

Just FYI no actual governor , congressman, senator etc actually reads any emails from the public. There are not receivers now that take your keywords and group your email into a larger group of emails where your email contained the same type verbiage keywords as others where after so many hundreds if not thousands they will THEN be read here and there and if not appears the public have an issue with something a memo to that legislature MAY be notified of what their office has been contacted over. I give you my word no one will actually read your email. You’ll receive an automated response by bot that will make you think someone’s read it by the response the computer will give you. Trust me whatever you’ve done has already fell on deaf ears.

First time in my 58 years that I’ve actually written (e-mail) a senator or congressman. But, i just sent one to each of Alaska’s senators on the behalf of this act. I hope it passes…i hope it isn’t too late to stop any adverse action against your ticket… & good luck with your appeal.

Trent - you're tenacious, and we all appreciate it. I fly for a living, occasionally go missed in LIFR conditions, have gone-around because we weren't cleared to land on a busy VFR day with lots of students in the pattern, because of animals on runways, etc., and the risk of receiving a pilot deviation based on your case law is absolutely insane. Thank you so much for continuing to fight this. I know the representation is expensive, and the time spent is costly in other ways, but we're all lucky you're fighting the good fight. Keep it up.

Sen Ted Budd is a great asset to the aviation community and a really good guy. His family has a grass strip here in NC. Both of his older brothers flew helicopters with my Dad in the military. Excellent folks. This case is so much bigger than, "lets help Trent win his case" , this is about ensuring the validity of our decisions as pilots to conduct safe flight operations for current and future aviators alike. IMO this is a case of gov misinterpretation of the rules to drive their opinion based agenda, instead of letting the laws determine the outcome, as they should.

Interesting that if you DO land, you often come a lot closer to everything than 500 feet. The rule needs to be changed to reflect the reality of flying. The FAA and the NTSB are populated with bureaucrats who have little knowledge of GA or even aviation in general. They’re good politicians though. The complaint against Trent should have been settled with a phone call to Trent, followed by another to the neighbour explaining the situation, and informing him that his complaint was unfounded.

How dare you shame the NTSB.😋 The head of the NTSB has a license to ride a moped.🤭 She doesn't have a commercial pilots license or a private pilots license or much training in aviation in general and yet she was appointed to be the head of the NTSB. Also, continuing on with your logic, you touch ground when you land at an airport, so you should be able to touch ground anywhere. You could crash anywhere, so you should be able to land anywhere.

Hey Trent, Keep up the fight! My Concern is the FAA's draconian ruling process, they seem to have too much power and not enough oversite! Outside of taking your case FAR FAR to wide and forcing litigation ( Which it's self seems to specifically be targeting you) this should never have been escalated to the levels it's currently at! You have more support then you realize, stay the course Trent, this WILL change for the better!

Trent, keep at it man. Of all the people that this situation could have happened to, I'm glad it's you (and sorry it's you). You have a wide audience and with that, probably a lot more power and influence than the average pilot to make some positive change here. Trent, I’ve always enjoyed your videos…I’m not an expert on your recent encounters with the FAA but historically the FAA’s obligations, as I understand it were to stimulate aviation and oversee a safe, efficient flying environment for participants, especially for the public…One reason the FAA has the authority to ticket and possibly ground pilots is to protect the public. In this endeavor the Government has the upper hand.

Excellent. While you're at it, can you have them look into those ridiculous 2,000 feet NOAA altitude restrictions over the northern part of the Washington coast? They have similar NOAA restrictions in California but they are only 1,000 feet. Why is Washington being treated differently?

Well done, Trent, I don't even see this as an erosion of freedom so much as an erosion of safety, both for people flying and people on the ground. To argue that inspection passes or the pilots decision to go around is a violation is just plain nuts and acts against the fundamental goals of all aircraft regulation. Edit: have emailed both of my Colorado Senators, and they ALWAYS listen to me 🙂

That was interresting "RC on a String !" ... 100% correct ... but we called it Contol Line !! I guess wired TV remotes would then be called ControlLines too LOL ... Cheers. Good to know your Senator is an actual Pilot !! (he said that right !? 3:48 )

Thank you Trent, and Senator Budd. I wish you luck! Here in Canada we have to deal with Transport Canada. The rules are broadly similar, and TC often follows FAA's lead, though being a bureaucracy they are also subject to the whims on non-flying pencil pushers.

I’m a NC resident based at Howie Franklin Field KSUT Southport and glad to see (1) that Senator Budd is taking up the challenge and (2) that he working across the aisle. I’ll drop him an email. Trent, he suggested calling your Senator, it would be good to hear his comments on the impact from a letter or email. You might bring it up next time you talk with him.

Kudos to you for being constructive and engaging legislators. It would be easy just be bitter and one more anti-FAA whiner. I certainly hope those who take the time to complain also make the minimal effort necessary to reach out to their senators. Go fly outside of the US and you’ll quickly realize how great we have it here. This is actual exceptionalism. Let’s make it even better.

I called both of our Virginia Senators and spoke with their aides and transportation aides. Both reported having already received multiple calls today regarding this. Keep it up!

This is good news, I hope that bill is passed. I live over the other side of the world in Australia, currently work as a police officer and find it ridiculous that the onus provides supporting evidence is on the person getting charged with the offence! I also own my own light sport aircraft maintenance company called Scrub Pilots Maintenance, and do a lot of backcountry flying myself, we are under the exact same pressures too where they are trying to phase-out recreational pilots and having the ability to maintain the aircraft yourself, I’m hoping that we get a movement started soon before it is too late.

Here in North Carolina Ted Budd is one of my Senators. I'll call his office tomorrow to register my support for this. I will also call Senator Thom Tillis and ask to speak with his staffer handling the Aviation Portfolio and discuss Senator Budd's "Back Country Aviation Act. Thanks so much Trent for handling this in such a reasoned manner, and spreading this information so we fellow pilots can step in to be of help as well.

Thank you Trent for spreading the word to support our aviation freedoms. I called my Colorado Senators and will also send them a letter urging them to support the bill. I fly for a major airline but am also passionate about GA and backcountry aviation. I fly a KitFox too and want to make sure my three young boys have the same freedom in aviation that I have enjoyed. Reduce the Karens & Richards in government by voting them out in primaries & in November. Due Process seems to be a battle across the board, not just one issue. Keep us posted, Trent!

Contacted my senator. This shouldn't even be a problem still, but we don't live in a perfect world. Both sides of the aisle should align on this. Hoping for the best!

Hi Trent. Followed your adventures up to a couple of years ago, busy with other things. Heard of trouble with FAA but was not sure what it was. You have to be kidding me!!. As a fellow aviator you did nothing wrong and I've always felt you were a very safe and confident pilot. Unfortunately this is the government we have now but hopefully it turns out well for you. To think that we have to consider the issues mentioned, before we make that decision of go around or land or can I make a low inspection pass before I land is totally absurd. Think you will come out ahead on this one. Lot of people backing you up.

Can we also talk about med … I am now 7 months waiting for my 3rd class med to be approved over a gram of weed I disclosed I was pulled over with from 15 years ago. I’m 37 years old, no medical issues no other issues with the law. And I’ve been at a standstill in my license and my training frankly, being “in review” for well over 200 days. I check multiple times a day every weekday and I’m at the point where I’m just exhausted over it.

I totally agree medicals are a total MESS. Professional pilots don’t take care of their health out of fear and if you have any little discrepancy, even from stupid doctors in childhood/childhood specific issues, you can’t even fly yourself around solo. And the waiting is unheard of. Years and years, just to be denied? I personally don’t believe I’ll ever hold a medical ever again. I do have some significant illnesses but even if I were to find myself in a pretty healthy place in the future, there’s no way they’d ever have changed policies enough for there to be any hope.

Thank you for your tenacity on this. 99% would take the suspension and move on knowing that when it comes to the FAA, it's not about right or wrong, innocent or guilty, it's about who knows who and who's feelings are hurt. Once the original inspector made the wrong call, they stuck with it without a thought of the unintended consequences.

He should also look into the farse that Remote ID is for RC aircraft. It's a solution to something that is not a problem.

Thank you Trent for providing us with this info. I hope to start my pilot training this summer and am 100% in support of TB's Backcountry Aviation Protection Act now that you have informed me about it. I also shared your video with a CFI I know here in Boise Idaho by the name of Trent Dyrsmid (Fly with Trent) and hope that he will share it with the people he knows as well. His circle of influence is much bigger than mine. I still did my part though. I called my Senator here in Idaho today and left a message with a secretary stating my support for the Protection Act. God knows that an inspection pass or a go around is safer than a crash landing even if the FAA doesn't.
