"We're Not Allowed To Record The Staff...Okay?"

For this video I collaborated with @sidewalks2269 to do a First Amendment audit along the public sidewalk outside this In n Out drive thru location.
As most all locations are, the drive thru line was wrapped around the building & continued down the parking lot within the strip mall. We were met with multiple encounters from both customers & employees of the restaurant. The main encounter from the line was a woman who got our attention & then went on to claim we were aggressive. One of the employees made contact with us as well, stating we we weren't allowed to record the staff. Eventually police were dispatched . When they arrived on scene , they parked in front & went inside to speak with the calling party. After some time inside, they returned outside , got in the vehicle & proceeded towards the exit of the parking lot. Before the patrol car got to the driveway, I was already walking across the driveway on the sidewalk & as police approached the driver honked the horn at me. I asked why he honked at me & his response was that I was blocking the driveway , so I had a few choice words for him along with reminding him that pedestrians have the right of way.

I find it is odd that the staff do not tell their customers to stop recording on their premises, but come out to tell someone on the sidewalk to stop recording, now if they have any ANY authority it is what is happening on the property and definitely not on the sidewalk.

Normally the line movies pretty fast. They have people out there taking orders and they are cooking a lot of food at once so it goes quickly. It’s just that they have a whole lot of customers most of the time.

Auditing has been going on for years. There is no way at least one person in the corporate hierarchy of every large corporation is not aware of it. What fascinates me is they have not brought this to the attention of upper management and had every employee sent a memo stating, "If you observe people on the public streets around one of our facilities who have cameras and are behaving like tourists, do NOT approach unless it is to polite greet them and offer them something like a bottle of water or other kind gesture. If any customers complain about the tourists, tell them the tourists have every right to be doing what they are doing, and nobody is in any danger from their cameras." How hard would that be? This would greatly decrease the number of videos showing their employees acting lie idiots, and making the company look bad. A few years ago I twice wrote to the Postmaster General asking why the USPS had not made sure every USPS employee was aware of the federal law explained on the Poster 7 hanging in every USPS facility, and told them to treat anybody in the publicly-accessible areas of their facility who has a camera as if they did not have a camera because not only did they have the right to do what they were doing, but that right had been codified in federal law regarding USPS facilities as well so there would be no confusion. I never received an answer.

I respect your point of view, and have wondered the same thing about many things. The answer is, they probably DID send that memo. And, they sent the memo about the bad lettuce, and the bathroom drug policy, and the time off policy, and the slippery floor signage policy, and the tomato slicing policy, and the burger arrangement policy, etc, etc, etc. Everyone is juggling priorities, and they ignore a lot, to focus on today's problems, because there isn't enough time to do their job AND read the employee manual, which isn't followed anyway. Add in high turnover and apathy. I type this not to disagree with anything you said, but to provide you with the peace that comes with understanding.
