Again LAWS NEED TO CHANGE- if the ad stated the boat was in excellent condition, then it needs to adhere to that. The initial ad is what people go by. It's uncertain whether Judge Judy would have given the plaintiff his money back.

“Excellent” is a subjective description. We don’t need our tax dollars wasted on legislation attempting to legally define this term when we have the phrase “as is.” If you respond to an ad describing a boat as “excellent” condition and you disagree with that description, you’re under no obligation to complete the purchase. You either get a mechanic to look at the boat or you don’t, but that’s your choice and you face the ramifications.

Like Mike and Raphe said, "Excellent" is as subjective a term to describe something as "short" is to measure a person. The motor is 16 years old, the guy could have ran it countless times in the 15 years he had it, never having an issue or even getting seaweed wrapped in the propeller. So to the best of his knowledge, both the motor and boat were in excellent condition. He did not make any quantifiable guarantees like stating it was "mechanic certified" or "appraised in excellent condition", but only used the same legal rights that you employed submitting this comment; "the right to give a well thought out opinion". As for Judge Judy, she would have called him an even bigger idiot because of something the plaintiff admitted to: he winterized the motor. A quick google check shows that winterizing a boat motor involves removing any liquids that would come into contact with water and filling the lines with non-toxic antifreeze. Yet the mechanic's report states "the oil levels are low and the filter is missing" which would have caused issues when the first guy dry ran it during the sale. So what it actually comes down to it is either a) the plaintiff thought he knew best and did the mechanical work himself, leaving the blame for all mechanical problems afterwards squarely on his own shoulders, or B) he had 1 or 2 mechanic shops work on his boat between the time he got the boat home and the time he put it in the water. As Judge Judy would say, "You cannot blame your engine problems on the third last guy who worked on the engine."

Excellent is subjective and there is no way of proving the seller knew there was a problem or that the problem existed at that time. Work has been done on the boat twice before being used twice. Almost a year passed. It sucks but the plaintiff was out of gas on this one.

I agree that it’s deceptive. It’s considered “puffery” and subjective. People need to ask for a blanket warranty for a specific amount of time or dollar value. I’ve actually sold a running car for parts because I knew it might need repairs. Unfortunately, most people want top dollar.

I am still confused about the "as is" statue, because I always understood that an advertisement is evidence of the contract. If in fact the advertisement said it was in "excellent condition" condition the Judge should, seemingly, determine if in fact the boat meets what she determines to be "excellent condition". If in fact she does find the phrase just puffery (or otherwise having little weight in this case), then "as is" justification becomes the default. However, if she finds the phrase "excellent condition" to be significant but not meet by the defendant, then I feel the case should be borderline fraud, in favor of the plaintiff. To be clear, when I state that I am "still confused", I am not challenging the Judge. She understood the plaintiff's primary argument was the advertisement, so why then did she not summarize her decision clearly stating her acceptance or rejection on that point. Now I am left feeling that maybe she unintentionally made a mistake. But then again, ....I don't know. Nonetheless, outside of the scope of the advertisement, the plaintiff was definitely foolish for not having the boat checked out before the sale. P.S - Hey, Judge Marilyn Milian ....call me !

As-Is means exactly what it says "In the condition it is when you take ownership of it." With private sales, most of what is written is considered one's opinion based on their understanding and scale. In other words, though the guy has experience with the motor, he is not a mechanic, not giving a certified assessment, nore is he expertly guaranteeing his work, so what's left is to find a word who's loose definition works the best. In this case, the guy probably had no problems with the motor in 16 years, so he truly considered it in excellent condition. Another way to think about it is "how tall does someone have to be before they are short?" The answer depends on individual opinions. Another example would be if I sold my dog. I spent a lot of time with her around kids and she has always had a fondness for them, so if I put out an ad, I could say "Great around kids". However, I have seen some parents that let their kids treat dogs like disposable dolls and even my dog has her limits. So should I be held responsible for their negligence simply because my responsibility as a dog owner has not pushed my dog to the point of harming a child? The window where an As-Is clause could be broken is very small, but has to do with altering the conditions of a sold item. For instance, if someone sells a car saying "never been driven" and when you check the VIN for history, you find out it had already been in an accident that nearly totalled the car, then the ad proves that As-Is does not apply as the term "never driven" leads to an expectation of safety that cannot be guaranteed anymore. Or (another real case) you find an ad stating "twin bed for sale" and though you double checked and got it shipped to your house, what was unpacked was two identical single beds. "twin" is an actual size so it cannot be exchanged for "identical pair". Other examples would be "one bedroom basement suite" turning into "one bedroom in the basement", "mechanically certified" and you see the (forged) papers, AKC registered dog that is not, "signed copy" that was signed by their uncle, etc. Does that make more sense?

Or something like that. But don't quote me on it,just like you can only do so much fact checking with stuff from tv. It'll get you all the time. One time she rewards pain and suffering in one case and then not in the next and they were quite similar. Well I hope you the best in that she actually calls you.😉 Oh another thing, even if as is wasn't a factor here, the guy waited way to long , anything could have happened in that time.
