Just found your channel today and i want to say thank you for the great tips and for being honest about those. I´m getting started to create my websites and pages to sell my music and i have been wondering if i should create several accounts in various sites like soundclick, myflashstore, beatstars etc to sell my music or should i focus on one page along with my itunes, youtube etc? im low on money and at the moment i can´t invest on several monthly or year payments. I did in the past for my members at producerminds.com great video advice too! However, facebook has recently changed much of their marketing. I spend tons on facebook ads for all my companies but notice facebook lies and tells you they are advertising to your “crowd” in reality they are far from it. Be careful on facebook, they scam you and there is no support. Money can’t be refunded.

If you copyright the song (master recording) then you are the owner of the master recording. It can't be in a businesses name though unless you're the sole owner of the business (i.e. a record label you founded)

KING KEL i heard u do NOT have to delete it, unless u go past ur limit. If u never go past ur 2500 downloads and Young Thug brought da Exclusive, u do NOT have to delete ur version. But if u go past ur limit, u have to take ur track off itunes, KZfaq etc... cuz somebody brought da exclusive. If u never hit over 2500 downloads, u can brag and say u and Young Thug have da same beat😎

Great information, one question what would you say you make the most income, beat leasing or selling exclusives? To me it seems you need to think alot more about quality than "quantity thinking" when selling exclusives..

The most income from a beat will always be from whichever artist that purchased a license making the song a hit. The difference between a lease and an exclusive is that the upfront costs associated with an exclusive is typically higher than a lease and the amount of rights granted to you is also higher under an exclusive license.

Waddup bro, I got a quick quest... So when someone leases a beat how can we track down what the artist is doing with it? Like how do we know how many singles or sales he's making off of it??? ASCAP and BMI do that but I think only for radio plays Thanks in advance

The short answer is you can't. The long answer is you can't...easily track them. If you've made it a requirement for an artist to submit a letter of direction to songtrust so that any time a song is streamed you get paid a portion of the digital streaming royalties then you will be able to see some data about how much the artist is streamed. Still it's very hard to tell what artist you're looking at.

Good information because I'm a songwriter and shop around for beats i usually get exclusive rights so what if the song i right does good and i purchase exclusive rights for beat if i sell it on amazon, or any other websites that makes income i don't have to split it with the producer who made the beat

So if you buy exclusive rights for an online beat, can the producer still lease that beat to other people? Does the exclusive option get taken down? And what happens with the people that leased it before you bought the exclusive rights? Can they not use the beat anymore? And how does this play into copyrights and publishing and royalties? Thank you for your content. I have a doubt. If I sell my beat by exclusive or non-exclusive contract, do I still collect copyright through ISRC and UPC? If the singer recorded his voice on my beat, should I generate another ISRC even selling on the exclusive, non-exclusive model? I ask this because I want to know if this market allows me to earn royalties through spotify, deezer, etc., in the exclusive and non exclusive models.

You need to read about "Artist Letter Of Direction". As the producer of the musical portion of the composition you're entitled to royalties from digital streaming but Songtrust will not pay them you without a letter of direction from the artist stating that they have to pay you as well. If you don't put that an artist has to submit a letter of direction into your contract when you sell the lease then the artist doesn't have to. It's a little known fact.

Also let me pose another question. There's a premium trackout lease with no cap on how many copies can be sold, unlimited commercial use, it's royalty free, and for an unlimited duration. What's the difference between that and exclusive full rights?

Because the big $ isn't in leasing. It's in exclusives with well known, established artists where the potential for significant royalty streams is higher. Limiting the time a license is good for ensures that the amount of licenses at any given time for the beat is limited and will eventually run out. The producer is also betting on the fact that anyone that has leased the beat will not take the song as far as the buyer of the exclusive is going to. As a leasee you're just paying the producer's bills for a bit while they wait on that fat check.

And what if I give someone a free beat and they rap over it and it blows up could they put a copyright over it and try to claim it as there's and then that affects my video on KZfaq and I get a strike ?

Its Sharlele you should go through a company that can mark your beats and background music so that if anyone uploads and monetized the song, it gets removed. Or, if you upload the song first you may then provide that proof to KZfaq. I have done this before and I won.

wassup! I have a question that I have seen in contract templates. When you sell a beat exclusive rights do you as the producer still own 100% of the copyright?

If you copyright your beats then yes you still own the copyright. If you don't state somewhere in the contract that you still own or don't own that copyright regardless of the licensing deal you've created then you are in a grey area and I'd change this immediately.

Hi, I have a quick question. This is what i keep seeing on producer websites: ****** “Revenue” means income actually received by or credited to Licensee that is derived solely from the exploitation of the Content less mechanical royalties, if any. Licensee shall pay Licensor the following percentage of “Revenue” as defined in the Agreement: For Revenue received for full Master downloads and for “Streaming” of Masters: Eighty Percent (80%) ******** This seems a little unfair and implausible as well. The beat will not be streamed alone, but will rather be streamed as my composition, with my lyrics and melody. Also i'm the one who will fund the recording, marketing, e.t.c So i cant really understand what the terms above mean. 80% of what? Producers cant really expect to take 80% of my song revenue can they? Thank you so much.

Mooneater DK if you intend to make money get a lease. If it’s free and just promo use or mixtape and soundcloud you don’t need anything. Always nice to give producer credits in name title though. If he has a soundcloud tag him.

Owner of what? No, I would never buy a beat lease without a contract. I not only produce but I also have been leasing beats as an artist as well since the early days of online beat stores. I made many mistakes early on in my music career not securing contracts before making purchases and am now paying for it because I'm sitting on song I can't release commercially because I have no license paperwork. I've reached out to these producers several time and they're horrible at responding. It's never a good choice. Don't do it bro

It depends on the beat for me. I sometimes will knock down exclusive and unlimited rights on beats that have a crappy performance. Those tracks that I lease a ton of, I keep a higher exclusive price. This is a great question and I am going to make a video on pricing in the LONG RUN, to display how you should price your stuff to not short yourself. I'm going to assume you meant "i can't use my work". The issue is going to come if the artist that bought the exclusive decides to register it with royalty collection societies. Those collection societies have software that scours the internet looking for people using music in their catalogs illegally and you may be flagged inadvertently because the software doesn't distinguish between non profit and for profit uses of the beat.

With a lease, does it expire when a certain time frame passes? Or when the agreed upon amount of views/sales have been reached? And when that happens, is renewal possible without the seller suing? Who should be initiating contact when it’s time to renew?? I have soo many questions 😩

So when u lease a track they can get 2500 hard copies pressed for sale, then would need to renew the lease before getting more. Do they? Hell no lol. I wouldnt worry about this, focus on leasing a ton of beats, once to that customer. If it blows up major placement etc. then yea sue the hell out of the label.

When you sell "leasing rights" legally speaking are you selling a mechanical license? Or a synchronization license? Or both? When you sell "exclusive" rights, same question. I see you use beatclick to sell your beats, do you still use them? Why do you use them as opposed to their competitors?

I will answer this question as directed towards how I sell: -Leasing rights (limited sync. license) leasee is okay to monetize up to 25,000 views on youtube only. A mechanical license allows them to copyright their material and sell units, this does not pertain to a sync. license as that would be used over video etc. For me, majority of leases out are from artists who simply make mixtapes and albums and a few music videos that is it. So for them, they just want a leased track. Now, they need to have knowledge if they do choose to copyright the track, and they do not own the composition only lyrics listing the producer as well...Basically this is similar to copyrighting something with a large sample and needs permission from producer. To make it more simple > nobody ever copyrights anything unless they own that material. Focus on advertising Exclusive Rights = Full ownership and copyright protection, that is what I do.

are you saying if the artist wants to copyright a beat he purchased exclusively from you, he does not need to write you in as a composer or related to the beat at all? From what I understand (correct me if I'm wrong) the only thing you lease is synchronization licensing (for syncing to video on youtube only and no other place like vimeo, instagram, host website, etc.) and never a mechanical license (like for publishing your composition on audio only streaming platforms)? Or do you lease the mechanical license (which is a license from the copyright holder to use the composition, but not the master sound recording, nor public performance) on certain websites only like soundcloud? Or do you lease the reproduction right (which is the right to distribute the beat as is for profit)? Sorry for being specific, but the details matter in the contract

noreaction for me all are included in a lease, yes. They have abilities to do whatever they wish but if that beat gets purchased exclusively they may be asked to remove everything..but this is why I have beats i only LEASE and ones I sell. I only request split royalties if a record label obtains or a major artist. Anyone underground can pay $400-$1500 / beat and have 100% ASCAP or 200% BMI. All beats I list for exclusive purchases I register via BMI. Hope that clarifies things

Just curious: have you ever heard a high profile artist sending someone to buy beats exclusively for low prices and then turning around and using the beat in a project? Also (since I'm new and not familiar with PRO royalties yet) when you register a song with BMI, isn't it in your name? How do you change the name when someone buys the exclusive? Or do you just leave it and remain collecting the royalties

noreaction changing and transferring BMI names are easy. They give you a work number for each registered work. You know, I worried about artists doing that when I first started but to this day have never had anything like that happen. 9/10 times when a major artist makes a purchase they either send you the artist agreement forms or request it, they know the business. BUT, Kanye West is known for scamming producers and artists on youtube and soundclick, cause hes an asshole. So sure, it is possible.

twiss Smith theres been a ton of misconceptions of how to track units and sales etc. I made a video for BMI regarding performance tracking, now when you lease a track you offer 2,500 units etc. pressed, regardless they are limited to that. When they need to print more they renew. ITunes Sales yes people like tunecore may help, sometimes its not worth paying them unless you are working with a signed artist. You get $0.091 / purchase from itunes, so you would need a great amount to make it worth it. I honestly dont track shit, unless its a signed major artist I will get things in line, the everyday joe? He aint selling shit lol, not worth my efforts. Hope that helps.

Its Sharlele a lease will have limits on what they can do. Mine for example allow 2500 units and only 50,000 monetized video views then they must purchase a new lease for it, or get exclusives. Now, it’s impossible to track them all but if you see some song with millions of views and it’s your beat you still own, then sue away.

Based Dorian I have clients renew leases all the time. But most don’t, but I never focus on things I CANT control. The important thing to focus on, say you leased a beat and you hear this song blows up everywhere and you know the guy leased it. If done correctly, you have this persons name, contact info and date of transaction. You have tangible proof to sue in a court room, if it blows up you have rights. Now if some underground dude gets 200,000 views in KZfaq don’t go chasing him, he hasn’t made shit off it lol.

Based Dorian ah, nailed it! Exactly the idea. The selling point for you is; A lease limits your ability to market the song, and beat(s) remain for sale and leased until sold exclusively which then is no longer available for new leases. Only reason 80% buy an exclusive is because they don’t want anyone else to have their beat.

Usually a beat tag is there because the beat is free and is to be used for demo purposes. On a typical day, the artist would download a track for free to try it out and see if they can make a hit. If they like it, they will come back and buy a license so that it removes the beat tag completely and allows them to make some money back on it.

Most cases no. Beats usually arent allowed to be resold once sold. Always check with the producer.

What if I bought an exclusive rights license to a beat that gives me everything but "broadcast rights" What are broadcast rights, very hard to find information on it. I get the seperate WAV, and mp3, trackout, contract & promise not to sell the beat anymore, but I have no idea what the heck "broadcast rights" are

xabial you'd need to ask the producer. My rights / term for broadcasting rights is similar to commercial rights. I do not allow commercial use on TV or movies/ film for leased tracks. If I sell an exclusive this means you now own everything and can do what you want with me out of the picture.

You bought using beatstars but they are not the seller just the processing partner. In your contracts it will state who owned the beat, and what royalties are to be paid if any, and if you can alter anything.

So basicially I should save A tagg version and a untagg version ? Is it setup where if they lease the beat , it sends them automatically the untagg version with the leasing contract as well ?

Yes, on soundclick (if you use them) you'll tag the beat they listen to or even upload a snippet (30 seconds) so nobody can steal from you. If you use myflashstore.net or another flash beat store it tags them automatically.

hey i was looking to start buying exclusive beats or premium beats as some people call them,and i wanted to know what is the difference between the high priced exclusive beats and low priced exclusive beats because i see some on this guy page that i get beats from but he has 4 different exclusive beat prices that range from 74.99 to 200.000 and i wanted to know is the highest price exclusive beat the one that comes with the ownership rights

On our site the higher priced beats are usually the ones we never leased, and are also ones we try to place with major artists. The lower priced beats were either old and on liquidation sale, or were leased a ton of times. Cant say what the reason is for others though. 88beats.com

Still don’t understand any of this. Been trying to figure out this for at least 10 years. Had opportunity to sell my beats but not sure where these forms and what means what like the exact step by step. Because I want royalties but seems in order for me to find out I’ll have to pay someone to know how. Idk what happened to someone teaching someone else that’s willing to learn how seems everyone sells beats now even kids. They rich, I’m still stuck trying to figure it out 10 years later. It’s so annoying

so I have a question for you as an artist, if I purchase an exclusive beat can I take the sample out of the stems if that's possible, say i purchased a hip-hop beat with Michael Jackson vocals in the background, is it possible that I can just delete the sample part when I buy the exclusive?

Drew Morton there are many options you can look at, but yes I would do some sort of copyright on them. Although, many i have leased have not been copyrighted

Yes of course, we have a full design team and are capable of websites etc. We make contracts for producers, the fee is only $25 / contract. Obviously, this one being $5 seems to be the best option as photoshop offers a trial for people. The choice is yours, we are busy so that is our minimum service fee. Good luck, god bless!

Also, is a beat still available for lease after it has been purchased exclusively? If not, are the buyers who bought the beat before it was purchased exclusively allowed to renew if they exceed their agreed upon limit?

Yes I give my clients 5 years until expiration then it cannot be renewed. If they want to press 10,000 hard copies and I allow 2500 they would pay for additional renewals

You can still sell them the exclusive. I think he mentioned this already not sure. Exclusive doesn't mean you're the only one with the beat. Just means that the new owner won't have to worry about other people buying it anymore.

Hi I'm not a producer, but I have leased a couple of beats from producers on KZfaq, and my question is, I get that there's a limit of sales and KZfaq views, and all that, and you mentioned that if the licensee goes past that, the producer can sue, but how do you avoid that? I personally want to give ALL beat credit to the producer, so if it happens that the song(s) do really well and passes the set limit, isn't there something can be done? So there's no suing happening, and everyone gets what they deserve? Hope you see this. Thanks.

Fayana Gayle easy. Ask the producer for the BMI OR ASCAP works number for the beat, as well as his name registered on BMI OR ASCAP. When you upload to itunes or online distribution centers you must enter his name as COMPOSER and BMI or ASCAP will do the rest. If the song does well and he isnt listed, he can legally take your funds made from record sales so it is important with a leased beat you list him as a composer of the background music. You should have a publishing company on your side that handles this, that is best. As well for him. In his leasing contracts does it state the works number? He should have all of that there..

+zeebazu With my contracts, I give all leased clients a 5 year term. in this 5 years they have leased ownership rights - they can renew regardless if someone else owns it. But, they can't lift their commercial limits. Commercial limits and sales is why people get exclusive beats. They don't mind other people having the beat, even though using the word "exclusive" they dont care. Everyone has different rights and obligations, some are very flexible and some aren't. You run your own company, I can't tell you what is right and what is wrong, this is your choice and should be yours.

You never have to clear a sample, but if your record ends up on radio around the world you will owe a lot more money.

+88Beats If I sell a beat with a sample and the track gets gets alot of attention meaning lots of money etc. Who's responsibility is it to pay the money to the original sample holder if he sued the artist for the song? I mean most money will get in the artist pocket not mine.
