Medical bills can be paid in numerous ways depending on your specific situation. Some are initially paid by health insurance, Medicaid, Medicare, Tricare, or even worker's compensation insurance. Depending on which laws control the payor's right to reimbursement, you may or may not have to pay back the amount paid by the payor when you obtain a recovery in the injury case. Medical bills might also be paid under automobile policy coverage called PIP or medical payments coverage (this also varies by state). Some medical providers will treat the injured party on a lien which means that they will hold their bill until the injured party obtains a recovery in exchange for the injured party agreeing to pay the bill from any recovery. Lastly, medical bills must be taken into consideration when negotiating a settlement with the person (or their insurer) that caused the injury.

There a several kinds of motions a litigant can file asking the court to enter a judgment in his or her favor. The most common is a motion for summary judgment. We usually see those filed near the end of discovery.
