महोदया अपने बहुत अच्छा पढ़ाया 👍 लेंकिन जो अपने कहा कि same parties दोबारा वाद (case) नहीं कर सकते अर्थात् संस्थित नहीं कर सकते तो ये गलत है ऐसा bare act में कहीं नहीं लिखा , बल्कि ऐसा लिखा हैं ÷ कोई भी न्यायालय किसी ऐसे वाद या विवाद्यक का विचारण (try ) नहीं करेगा इसका अर्थ ये हुआ कि एक - एक बार तो वाद संस्थित (दायर) करेगा ही विचारण नहीं कर सकता 🙏🙏 बाकी शायद मैं गलत भी हो सकता हूं क्षमा पार्थी हूं

एक वाद नायाब तहसीलदार ओमकार सिंह बनाम रामचंद्र धारा 34 नामांतरण वाद 1998 में निरस्त आदेश हो चुका था लेकिन ओमकार सिंह ने न्यायालय तहसीलदार को गुमराह करके 7 वर्ष बाद मृतक रामचंद्र सिंह को प्रतिवादी बनाकर दूसरा नामांतरण वाद सन 2003 में धारा 34 योजित कर दिया तथा ओमकार सिंह वादी ने अपने पक्ष में आदेश पारित करा लिया क्या दूसरा वाद चलने योग्य था या नही
