Hello, I was in a car accident. A uhaul truck, hit me. The driver was insured by uhaul and totaled my vehicle. I was taken to the hospital. And I was in therapy and chiropractor for 5 months total. I had a minor tear in my shoulder. And still have stiffness. Do you know ball park minimum in situations like this?

My daughter had a fender bender in October of 2021. She was at a red light, and when it went green, the car in front of her began to go but stopped abrubtly, causing my daughter to hit them in the back. Our insurance finally paid their vehicle damages, which came out to be 700 dollars. I'm guessing just a paint job on the rear bumper. The passenger left on an ambulance, and the man at first said he was okay, but after receiving a citation for no DL, he began to say he was feeling pain also. My daughter was served today that she is being sued for medical, pain, and suffering. I'm not saying they aren't hurt or injured, but it's hard to believe they are seeking up to 250,000 dollars in damages. It's scary, you know. My daughter is 19 now. Luckily, I have a double amount of coverage on my insurance. Up to 100,000 for bodily injuries. But it's scary knowing it's going before a jury and they could get up to 250,000.

Here's what I'll tell you from someone usually on the other side of the "V." From what you've said, the likelyhood of a jury awarding that amount of money is quite low. Most of the time, the insurance company will be able to settle for within your policy limits. My suggestion is to take a deep breath, and contact your insurance company. They will most likely be able to come to your defense, and any damages will likely be paid out of your policy limits. On the off chance they don't, you will want to find a good defense personal injury lawyer in your area.

Thank you for your feedback. Your comment gives me a sigh of relief. Our insurance is already taking up the case and is coming to our defense. I dont know how much, but our insurance did try to settle out of court, and the plaintiffs refused. Thank you again for your feedback. We will pray about it and put our trust in the Lord, and be honest in court. It's really all we can do.

Don't stress, remember this is exactly why you have insurance in the first place. Just be patient with the process...it may feel like it is taking longer than it has any business taking, but cases like this can settle any time up to the moment you walk in the doors at trial. I mentioned in a video I filmed today that over 90% of cases settle before trial. So, just trust the process, and you'll be just fine. Best of luck to you in your case!

There's a ton of variables at play here, the biggest one being your state's laws on the matter. You may have underinsured coverage on your own insurance policy that can help as well. Long story short, it depends, and it varies according to your law firm's policies and procedures. If everything already seemed said and done, I would probably check with my lawyer to find out if there's a delay (and, if so, why), and when I should expect my check. You never know, there could be a perfectly reasonable answer, but the only way to know is to ask.

If I get rear ended by driver in a rental car that causes severe injuries (say neck/spinal) and that car has rental insurance, can I go after the insurance and the rental car company?

It's never a bad idea to go after whatever insurance is available. That's why it's there. So, if they have a policy on the car and/or driver, look into it--it may or may not have personal injury coverage. If that motorist carried coverage on their personal vehicle, it likely will still apply in their rental vehicle as well--also worth looking into. Hello, I was rear ended .. I had 12 therapy sections with chiropractor for back, neck pain and had a scratch on my neck and bruise in chest from seat belt.. car damages were 4000 . About How much should I receive ? Insurance says accident occurred at low speed..

You know, insurance will say a lot of things...it's basically the adjuster's job to settle your claim as cheaply as possible, and from the sounds of things, that's exactly what they are trying to do. So we were hit by an 18 wheeler from the rear, it was 4 of us in a crew cab. i was in the back seat. Is this a more difficult procedure?

Hi I was wondering how much I should settle for my case.Insurance found him liable the moment they seen footage as well as I have witnesses. Had physical therapy for about 4 months for shoulder pain as well as pre strengthening prior too an acl reconstruction and a meniscusectomy. Out of work and not looking to get back into it for atleast another 3 months now I’m just doing physical therapy which they estimate for about another 8 months. Painful but getting through it. I did have prior knee sprain on that knee but no tears or nothing like this before. When should I settle the case? Should I wait for treatment to be over?

If you don’t need the money now, continue your pt and settle later. You don’t want to settle and then find out you need surgery. Find out what the policy limits are if the defendant. @@BurgerLaw I did have surgery on my left acl and had a meniscus torn which they just snipped I believe, I did hire a lawyer and thanks for the recommendation, I will continue with my therapy at the moment and see how things go.

There are a ton of factors at play in any settlement, so it's always so hard to answer these questions without being familiar with the claim; however, it does sound like, assuming he's at fault, and sufficient insurance is at play, you shouldn't have any problem getting fully compensated for your injuries. Hi I was wondering if someone hit me on a light when I was stopped and they came right at me , I did go in a ambulance to check my neck I had neck arm and back pain. They told me I had cervical spams can i get a settlement for this? The car was a rental so they told me insurance will take care of this.

My loaned car got hit while i was parked eating in a parking lot and my insurance was lapsed at the time due to my mom not paying her portion of the bill but the driver that hit me was insured and clearly at fault, is there any way there insurance company would deny my settlement if it’s totaled or repair cost if it’s fixable

Another question I have… if I have tickets for not having tags on a car and I want to decide to sell the car… would I still have to fix the tags for a car no longer in my possession? Or just show to court?

Generally speaking, if I understand the question correctly, you've already committed the crime of driving without current tags, so that doesn't matter. Some jurisdictions may grant you leniency if you get it corrected shortly thereafter. Some won't. I'd suggest seeking advice from a local traffic lawyer as to what the smartest play would be.

Hey so ive been in a accident recently and my car was totaled. I wasnt at fault and ive done the steps you spoke about in the video. My question is.. is there a deductible from the compensation i should be getting for my injuries? Theoretically, they should be compensating you for your medical bills, lost wages, pain and suffering, etc. Typically, they would not be directly paying your provider. If you had attorneys like us managing your claim, and you're treating on a lien, your attorney would likely handle the payments for you. That is really tough to say. If you didn't have any injuries, you are probably looking at compensation for the damages you can prove on your own such as the cost of repairs or replacement for your vehicle. I do have a personal injury settlement calculator on my website at burgerlaw.com/personal-injury-calculator/ if you'd like to see what it says, but this is for cases with injuries and is specifically designed to estimate for certain states like Missouri and Illinois. The good news is that if you were injured, the tow truck should be covered by high limits corporate policies. We regularly get $100-250k settlements in truck crash cases, or even a million, but this is when the injuries are severe or people were killed.

I’m a 1099 worker. I been to the hospital 2x. They said my back pain will subside and also I have bad whiplash. My neck was the main reason for missing work as I climb roofs for a living. I was in a wreck 3 months ago.. I was out of work for a month I’m an owner operator truck driver.. my wage lost alone is over 20k plus pain and suffering but the insurance company telling me they can’t pay over 15k cause that’s all they covers minus my medical bills… is this true? That depends on your insurance policy. You may want to read over the terms of your plan first. Is this your personal liability insurance? I don't know enough about your circumstances to directly answer your questions, but there are policy limits, and if your medical bills eats up the majority of that, then it's possible that you may not be able to recover as much for your other damages from that policy. But there may be other forms of coverage that could apply as well. Seems like a situation you should run by a lawyer in a free consultation before you agree to anything from the insurance company. i have an attorney but after 1 3/4 years all theyre offering is a 75 thousand settlement which means after medical and attorney's fees, all i get for my suffering bowels and bladder tears, 3 herniated disks in my neck, #11 disk herniated plus 2-3 lower back disk plus tennitis from the seat belt injuring my left side, carpal tunnel, injury to my left arm, is $21 thousand? what can I do, what are my options?

A couple of things to consider. First, some of these cases take a long time. Depending on where you are in the process, your attorney may believe it wise to continue fighting. I have had many cases that settle with great offers even up to a day before the scheduled trial! I would confirm the attorney's rate and the liens on your case. Ask your lawyer to reduce your liens or, depending on your situation, they might be able to file with other parties such as your own insurance policy for underinsured motorist coverage as well. You can always reach out to and consult another attorney to get another opinion. If you aren't happy with your lawyer's work, you can fire them and hire someone else. Just make sure you're doing it for the right reasons and have considered the pros and cons and how that may affect your case. Before anything else, talk to your attorney. Let them know your concerns and ask them to explain what's up with your case - where any resistance may be coming from, what they believe the value of your case is, what would happen from here if you accept or decline this offer, etc.

I got hit at a intersection someone ran a red light while I was doing uber. Just finished chiropractic stuff up a few months back, they paid for the vehicle damage pretty quick, they sent me info for the bills of medical expenses already pretty much a break down. The driver took full responsibility. Just waiting to hear from the new people my attorney told me would message me about the numbers I guess settlement… this is the second wreck I’ve been in within 4 years first time I was a passenger. The first time I waited bout 4 years for a settlement of 3900.

GREAT ADVICE!!! I was rear ended, and I got offered a check and a recommended shop from the other person's car insurance company. I have a friend who is a mechanic and said he could do it cheaper. Can I keep the money and pay a friend to fix my car instead of going to a recommended shop?

It depends on the arrangement. If you're handing this outside of the courts and insurance companies completely and the at-fault driver's is offering you a sum out of their own pocket, then once they hand you the check, it should be yours to do with what you wish, and their involvement ends there. You're being compensated for your property damage losses, and how you use that money is up to you. Cautionary note: I don't know the details of your collision, but before you accept or sign anything, it would be wise to get a medical evaluation even if you don't believe you have any injuries. If it was only a light tap and you feel that the amount they are offering you is fair, it is your decision to accept it, but taking the check now will prevent you from being able to recover more compensation in the future if you discover that the repairs are more extensive than originally estimated or you suffer from new physical symptoms like neck pain or a brain injury.

Assuming you have insurance, you will likely just need to pay your deductible through them: This is the reason we get insurance! For such a minor accident, that will likely be all that happens. You have to be careful to protect your SSI benefits if you win a large settlement. This can include spending down settlement proceeds on exempt resources and/or setting up a special needs trust. Either way, you should consult with your attorney to make sure this is done correctly, so it doesn't impact your SSI benefits.

Assuming you and/or your husband had insurance at the time of the collision, you can ask your (or your husband's) insurance company if the policy includes UIM coverage (many states require policies to include UM coverage). You can also request that the insurer provide you with the declaration page of the insurance policy (which they are required to do). If there is UIM (Under-Insured Motorist) coverage on your policy, you may be able to make a claim if the other driver's policy doesn't cover the full extent of your damages. Additionally, if the other driver did not have insurance coverage, you could use your policy's UM (Uninsured Motorist) coverage. UM/UIM is somewhat complicated to navigate, and can vary wildly from state to state, so while I can give you generalizations here, I'd strongly recommend you consult a personal injury lawyer with strong experience in UM/UIM cases, that is local to your area, for actual legal advice. Out of curiosity, do you have multiple cars on that same policy? If you do, you may be able to stack UM benefits from all of the cars on the policy if need be. It depends. On things like state laws, insurance policies, and being able to show negligence. In many states, the insurance follows the vehicle, and it sounds like they are already going after your insurance carrier. IF they exhaust your insurance coverage by receiving the policy limit, there may be additional avenues of compensation available for them to pursue, such as your daughter's insurance policy as secondary coverage, the claimant's own underinsured motorist coverage if they have it, etc. If they are going to go after private individuals to collect the rest of their recovery, that also depends. Generally, the driver would be liable, and the injured party would demonstrate how the driver's negligence led to their injuries. However, they could also try to build a case against the person who lent their vehicle to the driver (if the owner should have known that the driver would likely be unsafe on the road, such as if the driver was drinking or had a history of multiple at-fault collisions). Talking to your insurance company might help too. Depending on where you are in the process, new developments can arise and the course of the case can change. And if $145k is their first demand, you and your insurance company may be able to work with them to come to a fair outcome.

Somebody hit our car and totaled it. My daughter ended up with a broken bone in her lower leg she had to have a cast on for a month and I had a couple injuries my tooth went through lip and I had head neck and back injury they said they got everything they needed as far as all my bills and that they were going to send it straight to state farm I was curious to what my medical bill was only at the hospital and it was 34000 alone that's just the hospital bill aside from the chiropractor bill and my Attorney said the want 27% so I'm wondering more than likely how much ill get and how long it will take.

That question is a lot more complex than it seems on the surface, but I'll try to help. Disclaimer: I don't know the intricacies of your case, so these are all just educated guesses. For a more concrete answer, consult your lawyer. -As for how much you'll get, it largely depends on the amount of insurance money at play. How good was the policy carried by the driver--was it enough? If not, did you have underinsured coverage on your own policy? Are they able to reduce your medical liens? Either way, assuming your attorney is worth their salt, they're most likely confident they can get you enough to at least pay for everything before their fee, or they wouldn't be working this case. -As for how long this will take, that again varies widely. I've found that the average car crash case takes around 12-18 months here. With that said, recently I've settled one such case in about 4 months, and another recent settlement took about 5 years from start to finish, so there really can be a range, depending on the situation. And unfortunately, that may be hard to predict in your case. Good plaintiff Personal Injury lawyers like the ones we have here know how to push all the right buttons to turn up the pressure on opposing council and make them want to settle quicker, but it's much more of an art than a science. I'm sure those weren't the short, concrete, simple answers you wanted, but hopefully that at least sheds some light on the process for you. Best of luck in your case!

@@jocd3321 Pain and suffering is only one of the pieces of the puzzle. You're looking at medical expenses and lost wages as well. Ultimately, you're going to be at the mercy of how much insurance money is at play. If the driver either was uninsured or underinsured, you might have coverage for that on your own policy (UM/UIM respectively). I'd consult with a reputable lawyer down there in Georgia at this point, since it sounds like your damages are going to be significant enough.

Way too many variables at play for me to give you a number, but it sounds like a high damages case. I'm so sorry you had that experience and dealing with such pain and limitations. That is so hard and I hope the best for you and your recovery. It depends on where the accident took place (what state), how much insurance the liable party (or parties) has, the amount of your damages and how effectively you can demonstrate them, whether or not you have a lawyer, whether the other party accepts liability and negotiates in good faith or not, and so on. The amount of time it takes (a few months up to a few years) depends on a lot as well. Namely, if the other side is cooperative and communicative, it could be resolved more quickly. If I were in this situation, I would start with where the accident took place. That will tell you a lot based on the laws and limits in that state. I suggest at least speaking to a couple of lawyers in your area. I may practice or know someone who practices in your area if you let me know where.

You know, soft tissue injuries get played down a lot. It's one of the insurance companies' favorite ways to try to undervalue your claim. But you know what soft tissue includes? Your internal organs. And those are kind of important to--ya know--living. I guess that's a round-about way to justifying my point here: while yes, I've seen some small settlements off of simple soft tissue injuries, I've seen some big ones too. The trick is finding an attorney who will fight the insurance companies for fair compensation, and won't just take the easy settlement.

Hi, So we were involved in an accident in November. The other insured, proven on police report at fault driver ran the stop sign. There were four of us. I was the front passenger. We all except my 10 year old son did treatment. I did 4-5 weeks of therapy, saw a neurologist who has done biofeedback (EVOKE) for mild memory loss as well as a nerve block for occiptial neuro-something, a brain wave study that came back irregular and a EKG nerve study. I possibly will have to do therapy for dizziness to regain balance. I am also seeing a spine specialist. I've one no treatment with that specialist yet. I believe my mom has 30k for passengers on her insurance. Am I doing too much medical? Also, I do know that a nerve block is a temporary relief. What if I need medical in the future?

Good but complicated questions. You want to get the medical care you need but I understand the worry since the at-fault party's insurance policy could be limited to a certain amount per accident. You can use your own insurance to help cover the care you need to recover and a lawyer could help you treat on a lien basis and then work to reduce those liens. Unfortunately, your claim is probably blocked by the statute of limitations. At present, the time limit for a personal injury claim after the date of the car accident is no more than 6 years in any US state. Now there are sometimes exceptions made for extraordinary circumstances, but at 19 years, it would be fairly unlikely. If you feel like there might be a compelling reason for an exception, consult a local personal injury attorney. Best of luck to you in your claim.

So, there are a lot of variables to this case that we can't go through in a simple youtube comment, but the short, generic answer is that if nothing else, Uber is going to have insurance coverage that should be able to compensate you fairly for your injuries. If you have not done so yet, make sure to report the accident to Uber. Based on what I'm finding online, you should be able to do so from the help section on their app or by contacting Customer Support. Also, if AAA was at fault in the accident, they would also have significant coverage through their own corporate insurance. I would strongly suggest consulting a reputable personal injury attorney, as successfully battling big companies like Uber or AAA is really hard to do on your own. Unfortunately, it's hard to give you a concrete answer here, as it's very dependent on the details of your case. Your lawyer's fee should remain constant, based on your initial agreement. If your medical liens are high, if we need to hire expert witnesses, that could raise expenses, etc. We do our best to keep expenses low, and negotiate your liens down whenever possible. Short answer, that's a great question for your lawyer. They should be open and transparent about your case file and finances.

I haven’t been able to find any help , I was in a major car accident at the age of 2. Hit by a truck after my mother’s friend ran a red light. I suffered a cracked head , had to do rehab , learn how to walk again , and still have issues due to this injury. I also recently was given information that at the time a family member lied and stated I was his son but I am not. I am 33 years old now finding out new information and I need help!

Wow, that is awful. Where did the accident occur? Unfortunately, statutes of limitations limit the amount of time we have to file a claim after being injured. It's state by state, but is typically in the 2-5 year range for car accidents. There are exceptions to this, including extending the deadline for children. Still, in most normal circumstances, if you don't file a claim within the statute of limitations window after your accident, you have no legal claim to recover damages from the plaintiff...and it's extremely unlikely that the defendant or their insurance company will be willing to compensate you of their own volition. I'm sorry I don't have better news. However, it might be a good idea to contact a couple of firms that practice where your car crash occurred to find out if you have any legal options here. I hope you are able to get the treatment and recovery you need.

If it's just property damage, and there is no police, insurance, or other legal involvement, there's really not a "settlement" at play by definition. There's not a "settlement" if the two parties are just taking care of everything themselves. With that said, if the only damages are paint and a sensor, realistically, all you'd need to worry about is the repair bills for them. As for how much, that I couldn't tell you. You'd have to contact their body shop for an estimate. Also, worth noting: if the two of you had agreed to settle this between yourself without involving other parties, and they are throwing around legal terms like "settlement", you might want to double check with them, and make sure that's still the case. They should be able to represent you in this case, but if they decline to for whatever reason, you'll want to find a good local Defense Personal Injury lawyer. I got into a car accident back in 2020. I was hit by a construction tow truck. The truck was about the size of a ford truck with something similar of a bull bar on the front. I was told I have a herniated disc, bulging disc, and offered injections. My car wasn’t totaled, my bumper was replaced. Therapy racked in about $12000 dollars, not including doctor bills as I stopped going to therapy due to the unprofessional treatment I was receiving. I am being offered 10k but I’m wanting 25k so I could pay for more therapy. Is this possible?

The highest amount you could recover will depend on a lot of factors, like the insurance policy limit, the value of your damages and how well you are able to demonstrate this and a lot of other things. In cases where the injuries are significant and treatment is required, a good personal injury lawyer will usually be able to add value to your case and get you a higher settlement. But just because/if the towing company has a $1M policy limit, that does not necessarily mean the plaintiff will recover that much. Based on the injuries and treatment described though, I agree that this settlement could be worth much more than $25k with a lawyer (I would be surprised if the insurance company offers a fair amount without some tactful negotiating).

Honestly, that depends on a number of things, including local laws, but what you might want to look into is whether your own policy has uninsured/underinsured coverage (often labeled UIC on your insurance paperwork). If you have that, you can go after your own insurance to claim that coverage. Generally speaking, there's not a ton a lawyer could do about that issue. You may want to double check your credit report, and make sure that these collection claims are for valid debts. Assuming the debts are valid, the best way to keep them at bay is probably to talk to them, and set up a payment plan, even a good-faith plan if you can't afford much, just to keep them off your phone. Beyond that, you might try seeking advice from a lawyer that handles bankruptcy cases, as that's going to be a lot closer to their area of expertise than mine.

Honestly, any answer here would be a blind guess, and not helpful in the grand scheme of things. The easy answer here is to ask your attorney. If you don't want to do that, subtract your agreed-upon attorney fees and take out money for expenses, and you should have a rough estimate.

To clarify, your case has already settled? Is your attorney giving you a ballpark figure for the actual check you're getting? Assuming that's all true, if there is a large difference between the two numbers, it's likely because your attorney was working on a contingency basis (often presented as "you don't pay until we win" or something like that). Basically, they don't charge a retainer or hourly fees, but they take a percentage of the winnings (industry standard is between 25-40%, although sometimes situations warrant a push outside of that range). They may also be deducting expenses (records, expert witness fees, deposition costs, etc), and could also be deducting medical liens owed on your case. But to answer your original question more completely, the full settlement amount can usually be found in the release document (which you will most likely have to sign). From there, your attorney should give you a breakdown of their fees, expenses, and liens, along with your final take-home pay. If something doesn't seem right on the latter, ask your attorney for clarification. Hope this helps!

We live in WA state: fiancee, 2yo and 4yo kid were in an accident recently. Front end collision totalling our car. Property damage was paid out but we recently got an injury settlement offer that our lawyer said was low. They said they wanted to pursue the max policy limits of the other driver's insurance policy and also utilize the underinsured driver coverage in our policy. The lawyer was confident that we would be successful in litigation. I haven't gone through all the details but I wanted to ask a few questions. 1. What would happen if we lose the case? Worst case scenario? Would it entail having to pay all the court fees and a much lower settlement payout or even cause us to have to pay out of pocket? 2. Would a lawyer profit more from going to court in general? I would imagine it's much easier work wise to recommend us to settle and be done. Could it be that we would have more risk than our lawyer or is it about the same? 3. Typically insurance companies will offer the lowest settlement possible. Would it be worth it to sue the company for example 20k more? I know it's a lot of questions, I do trust my attorney but wanted more opinions on the matter. Honestly, it's hard to say without knowing all the facts in the case, but on the surface at least, it sounds like your attorney has the right idea. I can't speak for your attorney on those questions, but I can speak for me, so here's how I look at it. 1) There is always a risk of losing completely, or getting less than what you would have in settlement. I only push cases to trial that I am confident we will win, and will be worth our time. 2) Short answer: yes and no. While yes, I do charge my clients a little more if we have to push to trial, I'm not necessarily making more money, since that forces my expenses way up. The only way I really make more is if my client makes more, which often happens at trial, but it's really a win-win. 3) An insurance agent's job is to settle cases for as little as they can get away with. I don't know the particulars of your damages, but don't stop until you have been fully--and fairly--compensated! 4) (bonus) it's worth remembering that just because I file a lawsuit doesn't mean we're going to trial. It sends a message to the other side that we mean business, and it's going to be cheaper for them to settle on our terms. Over 90 percent (I've heard numbers as high as 96%) of all injury cases settle, and we're able to settle up until the judge bangs that gavel. So, again, while I can't give direct advice here, here's what it sounds like to me: Assuming your lawyer is worth his salt (and it sounds like he probably is), I'd probably go with his advice on this one. Me and My Wife and 3 kids got into an accident and our car was totaled. My wife at the time was pregnant and as the result of the accident she had contractions and gave birth 2 days later. She was already scheduled to be induced a week later but due to accident gave birth just a few days early. Our lawyer said the insurance company offered 50k each to me and my wife which she also said was their cap based off the car insurance the at fault driver had. Still waiting to hear back from lawyer after she negotiates medical bills with the hospital.

Yikes! I hope everyone is ok now. Unfortunately, policy limits are a thing, and they can usually cap what you can get in a settlement. One thing to ask your lawyer about, especially if the coverage the at-fault driver had wasn't sufficient to pay your bills, is to look into whether you can go after underinsured motorist coverage on your own policy. Generally speaking, gap insurance makes sure your car gets paid off when it gets totaled in a car crash. Generally speaking, the idea is that then, now that you no longer have a car payment for that car, you can just go get another car. Typically, it won't pay you extra to go buy a new car. In the context of this video, we're not really talking about property damage--you typically don't get extra money on property damage--however, we're talking about personal injury damages. If you were hurt in that crash, you should be compensated for any and all injuires, pain and suffering, lost wages, etc. That's the money people are talking about.

I have the same question I recently got into a accident in my 2023 Camaro ss, someone smacked my rear end hard while I was driving cause me to spin out of the road and totaled my car. His car was also messed up he did try to flee the scene but came back 5 minutes later after he hit some containers he had in his car. That's....interesting. Being an outside party to this claim, I'm not privy to the facts, so I can't tell you why that number changed. There could be several legitimate reasons, or it could be that this lawyer was just pulling numbers out of the air and not keeping track of what he told you. Hard to say from my vantage point. Anyways, here's what I can tell you. The claims process is designed to make you whole again after the crash. If that means getting knee surgery, it means knee surgery. Don't stop until you have full compensation for your injuries. I would probably ask your lawyer for clarification as to why the offer has changed so much. Also, you're going to want to make sure the settlement you're getting fully compensates you for medical costs, lost wages, and any future damages/disability that may arise as a direct result. Also, we generally don't settle cases in my firm while our client is still treating, as we don't have a complete picture of the extent of the damages yet. Hey I was hit by a guy in his company suburban.Hr was actually the CEO lol.Front driver side got hit the hood was destroyed,also the side panel.I went to the chiropractor for 7 months,got two MRIs and 4 injections.One on my shoulder,and 3 on my lower back.I was out of work for two weeks.How much is a ball park range this could be worth.Its been about a year now.I asked my attorney,and they said they're not sure,but I did asked a while ago.

So, one of the things I've mentioned on my channel a few times is that it's not uncommon for you to think you're fine right after the crash--you're running on a lot of adrenaline, a lot is happening at once, and you might not notice--but a couple of common crash injuries (especially whiplash/spinal injuries) often don't really start to show symptoms until a day or two after. So she may have felt fine in the moment, but had a legitimate injury start to pop up thereafter. As for the delay, it's not uncommon for people to finish treating, or even just wait a while before filing a claim. In all but a few states, you have at least a 2 year statute of limitations on personal injury claims from an accident (here in Missouri, it's 5), so this starting to come to a head for you a year or so down the line isn't out of the ordinary. The good news is, this is exactly why you have insurance. Generally speaking, your insurance company will be your defense in this, and generally speaking, they're the one on the hook for the damages. Their goal is the same as yours--reduce the amount of damages they are liable for--so if I were in your shoes, I'd probably go along with what they ask. Also, affidavits aren't something to be afraid of--it's just a chance to tell your side of the story--so don't stress. Best of luck to you in this matter!

@@hollywoodmonquez7611 There are some scenarios where that could happen, depending on a multitude of factors, such as low policy limits, willingness to settle for lower amounts to get it done quickly, and dollar amount of medical liens. Now we can't speak for all firms, but we can speak for ours. Again, everything here is on a case by case basis, but we often will hold off for the highest settlement we can get, and we will try to haggle down medical lien costs in an attempt to truly maximize the amount of the check we hand you at the end. Is it a perfect system? Of course not. But there are good people out there in the system like us who do try to help as much as possible.

I mean my foot literally was cut in half...sorry for being graphic. My lawyer at the time only got me workers comp. I was rushed to the hospital where I was immediately given a drug test while blood was still dripping from my foot. The drug test came back negative. I don't drink nor do drugs. My lawyer said I didn't have a personal injury claim.......how??????? Please explain this situation to me. Thanks in advance

I was in a Lyft accident in August. Took an ambulance to the hospital. Got pain meds. Currently finishing up PT. Ya know the exercises and adjustments. Injuries suffered included skin graze on elbow. Neck pain. Shoulder pain. Back pain. Couple of cuts too but I’m completely fine. If my attorney is atleast doing half of his job, I want to know if I should expect closer to 10K or 30K? And also how long does something like this take to wrap up? He also mentioned that he wants to go after Lyft and the insurance of the driver of the opposite car, since they were said to be at fault. Ouch! Short answer is it depends, and it depends. -Your settlement amount is fully dependent on a number of variables, including total medical bills, as well as lost wages and/or pain and suffering. It also has to do with how much insurance money is at play. With your attorney wanting to go after both Lyft and the at fault driver, it looks like he's trying to maximize the insurance money available for your settlement. Smart play. -As for how long it takes....these cases always seem to take longer than everyone thinks they should. Unfortunately, our justice system in this country isn't exactly known for its speed. I don't have actual data for this in my firm, but here's what I can tell you. Sure, some cases settle fast, within 6 months. Other cases can drag on for years. I'd say our average time for a case like yours is about a year and a half, but all of that depends on a ton of factors in your case. What I tell my clients when this conversation comes up: "I can get you fast money, or I can get you good money. I can settle your case by tomorrow, but it's most likely not going to be anywhere near what the case is worth. Or we can go through the process, show the opposition that we mean business, and get you the compensation you deserve" I hope that helps. From what it sounds like to me, it seems like your lawyer at least has the right idea. The best suggestion I can make to you is this: remember that your lawyer works for you, not the other way around. If you have concerns about how your case is being managed, speak to your attorney about it. It's ok to ask questions to your attorney about your case. Besides, they'll be able to give you more precise answers about your case than an outsider like me can. Best of luck to you in your case!

Unfortunately for me, my attorney can either settle and get me far less than what my medical bills cost, or he can take it to trial, and we have a high chance of getting nothing. Why? 2 words: Contributory Negligence. I live in 1 of 4 states that still goes by Contributory Negligence, basically if the defendant's attorney can "prove", basically pursuade the jury and/or judge I'm even 1% at fault or even the smallest decimal of 1%, basically anything that's not 0%, I can't get anything from their insurance company, and I did everything I could to avoid the accident, I'll put it to you this way, our biggest defense is the "last chance" defense. I won't say anymore than that, and my accident was back in July of 2021, it's January 2024 now!

Some states do make it more difficult for plaintiffs to recover, and Alabama, D.C., Maryland, North Carolina, and Virginia have contributory negligence laws. Some cases take years to settle, but it is possible that your attorney can negotiate for a better recovery without going to trial. We have had cases settle a day or two before the trial was scheduled to take place. Still, it depends on the facts of your case, how resistant the defense is and what techniques your lawyer can use to apply pressure and demand a recovery on your behalf. In the end, some settlements are lower than the total value of the damages suffered, and may be limited by policy limits and other factors. Your lawyer should fight to get you the maximum possible settlement based on your case, state laws and other factors. We hope you see justice and are made whole in this case.

It is impossible for me to say without looking at the details of your case. The severity of the injuries and the amount of medical treatment required is one area that can make a huge difference. And that will be different for each victim. There are also policy limits and state laws, settlement caps, etc that will dictate what you can recover. For example, if the at-fault party has an insurance policy with a $50,000 per accident limit, that means that the most the insurance company will pay out in one accident is $50k - for the 7 injured parties to potentially split. That's not much money, especially if everyone needed medical treatment. But that's also where an experienced attorney can use their skill and creativity to maximize the recovery, such as by making a claim on your own insurance, pursuing additional responsible parties if applicable, reducing liens if you have them, etc. Basically, if that many people were all hurt to the point of requiring medical care, it will be worth it to do a consultation with a car accident lawyer in your area to find out what you'll have to do to get a fair recovery. An attorney with a good reputation should only represent you if they can add value to your case, meaning they will be able to get you more money in your pocket than you would be able to get on your own.

Generally speaking, as far as property damages are concerned, if your car is totaled, you are paid back what your car is worth. If that is equal or less than what you owe on your car, you won't have any money left over to buy a new car with. If you are at a point where you owe more on your car than it's worth (this is true for a lot of people who bought cars during the car shortage around 2021), look into gap insurance. I got hit by a drunk driver at the red light and I had a whiplash and hit my head on the steering wheel having to go to chiropractor treatments but I only went for 3 days due to the pain and me not wanting to be touched anymore or cracked up I just soaked and did lite workouts. The driver was intoxicated and also hit 4 other people a d now my lawyers asst. is telling me I may only get like 2500 due to it being a multiple accident. 2500 ? No way I feel like I should at least be looking at 5000 the most. I was in a uhaul truck but I still got hurt and sometimes my neck still bothers me just not as bad as it did 3 months ago. I’ve been waiting 4 months now and I’m pretty sure the other victims are still doing treatments why I’m still waiting on my settlement. Should I seek another lawyer that can make sure I’m paid decently ?

Ouch! So sorry to hear that. I can't really give proper legal advice, since I'm not familiar with all aspects of the claim, but here are a few aspects to consider: 1) you only went to three treatments, which makes it look like your injury was less severe, so it will be harder to prove damages. Making sure you go to your treatments is one of the most important factors in maximizing a settlement. 2) Most insurance companies have policy limits, both for individual and total accident. Since there were multiple vehicles involved, that means that you get a share of that total insurance pool. Is that entirely fair? No, but that's the system we have. 3) Assuming that's the case, you may have something on your own insurance policy called Underinsured Motorist Coverage. Ask your lawyer if that's a possibility. To answer your final question, with the limited information I have in this case, I'm not sure that a change in council is the right move, as it may not make too much of a difference. Run over on the sidewalk by a hit and run 🛵. Because my Medicare card reads mentally ill, the lawyer pointed out there is a vehicular manslaughter exemption if the victim has the ♠️ so I am being billed for the out of pocket of the hit and run which was on surveillance camera. The city law enforcement on the phone as I called in anguish the next day said I was going to get a report. I tricked the lawyer into the knowledge he had for me and signed nothing. The lawyer is in chummy with the orthopedic surgeon. Even the ambulance service, explaining that 'they caught the guy who did it' hid the reason my hand was nearly severed. It is a city collective to hide hit and run now while the sidewalk slaughter machines run the sidewalks here. But the sidewalk new legal drivers enjoy the corporate 🛵 company. The driver who hit and run over me the pedestrian chanted that he didn't have insurance and many sidewalk new motorized legal drivers chanted the same thing. My family is big prestigious law people. I am a medical malpractice victim going back seven years now. The hospital emergency receiving accidentally told the truth on the release form. Reimbursement should be paid to me for legal 🛵 corporation run with their tracking. My body parts were on the bottom of that sidewalk vehicle wheel. Now zi know what it's like to get run over, my head smashed into the city sidewalk. It's the driver, the city, the corporation share blame. The lawyer I got the info out of drew a chalkboard diagram of the liability game. And big review of the emergency surgery I had to have. Word of mouth though, other victims and near misses from the machines, the sidewalks only really designed for walkers. I am falling asleep, sorry
