There are two parts to a title insurance policy: 1) the owner part is optional. this portion protect you as longs as you own the house from error in the title. 2) the lender part, not optional, unless you paid cash 4 house, protect the lender (aka. Bank). Neither protect from tax liens. that is why lenders require an escrow account to pay for taxes and home insurance.

Dave, You are absolutely right. I myself have used trusts and placed all of my individual properties in separate trusts! I even have one loan on a property and in that state, because I wanted to leave that lien on the property while I retain the property for the sake of the ability to possibly collect should there ever be any kind of our redemption by the attorneys or future action by the attorneys that were going against my borrower. I filed a deed in lieu of foreclosure without merger interest! Title law is something that's not simple that relatively straightforward. With regard to my deed in lieu of foreclosure without merger interest, I did this, simply because in the event later during my ownership, anyone associated with that lender who wanted to try to cause action against this property would be obligated, to pay me a default interest from the time they assumed title to the property. Currently this property is rented, and I've held in my portfolio. I will say that with the insurance company, it's been quite an exercise explaining to them. Why title is held in the mannerisms that I'm holding it., But understanding exactly what it could give me in protection as well worthwhile. I have bought and sold a number of properties and also done a number of private money loans, and very comfortable with where this property and my others are at. Thank you for your answer.

I got title insurance when I bought my home for $200 and glad I did. Also homestead exemption. Have no idea what title lock is.

I'm tired of seeing that commercial for this " home title lock insurance". They put a " perpetrator" on here that claims that it's easy "all I have to do is file one document and by the time the homeowner finds out it's too late".. Then even more disturbing is they then put a " county clerk" on that says " by law we have to accept the "document" "even if we suspect it is a fraud". Why not deny it and let the fraudster complain to the appropriate authority if he dares?. IF this is true this should be a top story on prime time news.

If someone steals my home title and gets a loan against it...it would be the loan company that would be the one scammed not me...just because the loan company did not do a perfect identity check of the true ownership of the deed, title etc.

Does anyone know why title fees are so expensive on a refinance when title insurance is not necessary? I understand the title company drafts the settlement documents, but this is a pretty simple task as they use boiler plate templates. Or perhaps title insurance is required on a refinance.

Title fees don't solely apply to title insurance; they also include reviewing and modifying the title. Fees are how the companies make money and fees are negotiable. Usually title insurance is not required for a refi, but that doesn't mean it's not useful to have.

@@jaketyler7088 Thank you. From my experience, it is pretty difficult to negotiate title fees. And it can be difficult to chose a different company than the bank recommends. Modifying the title makes sense. But if you are refinancing with the same bank, this doesn't seem necessary. Compared to real estate agent fees and the value they bring, title insurance is a really good deal.

Hello, I'm interested in attending a sheriff sale in New Jersey. However, I read on county websites that all sheriff sales are sold subject to a first mortgage and any outstanding liens. So, my question is: If I'm the winning bidder at a sheriff sale and I become the new owner of the property, does getting title insurance protect me and, more importantly, wipe off the mortgage, any liens, and judgments from a property?

You can get a title search for the property to be aware of what liens and clouds on title are present but an insurance company will not insure the property’s title because you are unable to remove clouds and clear title prior to sale, which is what the title company does prior to issuing the title policy for a conventional sale.

Purple Heart Iraq Veteran here with a major problem please advise. So here’s the story. I bought a Home in May 2021 and it’s now October 2022. When I got my property tax statement in the mail I noticed a direct charge from "Hero Pace Program” in the amount of $1443. Called my county and was like, why is this charge on my account? They said previous owners took out a loan with “HPP” and there is a balance payable each year for $1443 until 2028. Called my real estate agent, Mortage Company “(Veterans United), and checked my closing title docs, nothing in my contract states anything about this “ Hero Pace Program”. When I bought my home I bought title insurance so I filled a claim and now it’s under review. I guess my question is, does my purchased title insurance cover me on this matter? Are they now responsible for this “HPP” balance? They never reported it to my VA loan Officer and once again it is not on my signed title closing docs.

Yes you need title insurance. When you buy a home most lenders require some form of title insurance. Source: I’m an attorney and handle many closings.

​@unknownbrokie not in every state. North Carolina has separated law firms from doing the closing and insurance companies that issue the policies. We get $0 from insurance companies, and the bar makes sure of that.

It's a scam. I have a claim for lack of access, denied, what a surprise. It only pays out up to 3k in my case, lol. 15k is the most it will cover.

Yes, title insurance is a one-time fee when you purchase a house. If you are buying in cash you can request that the seller purchase the owner's policy which protects you against any legal claims to title. If you are buying using a loan you will be required to purchase a lender's policy to protect your lender and you will still want to request the seller's policy be provided by the seller. If you refinance or take out a second mortgage or HELOC your new lender may require you to purchase a new lender's policy to protect them in addition to the original lender. If you then sell that house you will purchase an owners policy for your purchaser (if that's what you agree to in your REPC), and they will pay for their lender's policy. When you go to close you will get an itemized list of all fees and closing costs. In there will be the purchase price of your policy, a settlement fee (the cost to sit down with a title officer/notary public and have them walk you through the docouments and the closing process), deed prep fee, recording fees, etc. After closing the only recurring fees for you will be your PITI (principle, interest, property taxes, and homeowners insurance), and HOA dues if applicable, if you take out a loan....or...if you purchase in cash you will have to renew your homeowners insurance and pay your property taxes once a year, and pay HOA dues if applicable. You do not renew your title insurance policies year after year like an auto or homeowners policy. Laws about property transfer differ from state to state, so call a local title agency that has been around for a while and understands the requirements. Stay away from fly-by-night or brand new agencies because they may close up shop and leave you high and dry. I grew up working in my family's title insurance company in Utah. My great-grandfather started it as an abstract company (predecessor to modern title insurance) in 1904. I've seen many title companies come and go because the profit margins on this business are so shallow and it can be a boom or bust industry, because it is so closely tied to the boom or bust nature of the real estate industry. Title insurance is a pretty specialized business and it's not something you can really go to college to learn, so going to establish, reputable companies who have been in the business for a long time ensures that you are getting knowledge, expertise, and specialized experts who can help you with everything from water rights, canal shares, doing a quiet-title process, transferring property as part of probate of an estate, quit claiming yourself off a property, doing a PR to see if you want to purchase an investment, updating title after a divorce, etc. The companies that have weathered the financial storms over the last 20 years are the companies that are going to be there for you if a claim crops up in the future. One example of why you ALWAYS require an owner's policy regardless of how you are purchasing or from whom is as follows. A family in my hometown purchased a stately old home to turn into a B&B. As the B&B rose in popularity they wanted to expand and talked to a neighbor who owned the two homed behind and next to the B&B. They'd known the neighbor for years, trusted them when they said both homes were "free and clear" (meaning no loans or liens, and wanted to keep closing costs to a minimum. They approached my family's business and asked us to prepare and notarize the warranty deeds to transfer properties into their names but refused title insurance against or strenuous advice. Both parties came in and the seller signed the deed in front of one of our notaries, they gave the seller a cashier's check for the purchase price of both homes, then the buyer took the deeds to the county recorder's office and recorded them and paid the county fees themselves. 2 months after purchase they went to start renovating the first house and they needed to take out a HELOC to purchase supplies and pay subcontractors. Their new lender required a lender's policy, when they received the preliminary title report they found the previous owners had large HELOCs on both properties, had maxed them out before signing the warranty deeds, then moved out of the country. The family that purchased the property had been forwarding the previous owners mail to a PO Box and had no good way of getting a hold of them. They were now on the hook for over $200,000 in loans that they previous owner had taken out...which would have been caught and would have had to have been paid off and closed before transfer if they had paid for a preliminary report and owners policy before purchasing. Moral of the story? Don't trust anyone when it comes to "their word" on real estate deals, and always hire a title agency to make sure you don't get a nasty surprise when you buy property.

This is terrible advice especially if you own your home outright. Your amount of loss from a title defect is equal to your equity in the home - 100%. You can still get title insurance after acquiring the property, a la carte, but it will be more expensive. He's conflating identity theft with title claims and they are completely opposite problems. Identity theft arises during your ownership, and title claims arise prior to ownership.

How about each county provide a process to FREEZE the deed so that the owner has to appear in-person at the county Recorder office, present valid picture ID, and hopefully a fingerprint verification process as well. A valuable document such as a deed should have space provided on it for a few fingerprints, not only a simple signature. If the true owner has died, there should be a death certificate with ink fingerprints on it, which could be compared to the deed's fingerprints. The USA is not in the modern world, with only a simple signature for many transactions. Fake picture ID has been a problem for decades. Criminals and illegal aliens have had a fake identity ID industry for decades. Its time FINGERPRINTS and fingerprint readers be utilized. There could be a few photo-printed on the reverse side of a driver's license (or state ID card). These could be used for comparison. An electronics magazine 50+ years ago said some USA military installations had WHOLE-HANDPRINT readers. Concerning average citizens, this nation is setup for fraud. Email accounts get hacked, online communications do get interrupted or forwarded to another (hacker).
