@@natthekiwi7074 And even then when you believe your rights have been put aside in that situation, you're supposed to take this up by talking to a lawyer when brought up to whatever charges or reasons for detention, AFTER you are detained or arrested. These things are settled in an order. What you don't do is try to argue or flee *during* an arrest or questioning, as that can and will be construed as resisting arrest or gives the presumption you're acting noncompliant and being detained (at minimum) was necessary (when brought up in court recounting alongside cam footage). It's all about a combination of interpretation and cooperation; if you are mistreated, you need to bring that up *later*, not always in that moment. That lady jumping in and yelling at them, for no reason, almost got herself detained for nothing other than butting in something she wasn't involved in or aware of lol

@@Whazzupie Every situation differs. If the police are trying to Kill you, if you don't defend yourself or flee successfully then court doesn't matter. Once you've been cuffed and disarmed your at the mercy of police to care for you. Even if the arrest is lawful, but you know your innocent it can be terrifying to be helpless and not many people think clearly either by trying to pursue the police to believe them ,(which police are trained to ignore, since most criminals do this) or resisting. If the system wants you, they have you. Innocent or guilty.

All they had to do was listen to what the cops were there for, instead completely escalated things for no reason. The family seems like they were antagonized by who called the cops on them and threatened. Instead of talking and figuring shit out nothing got taken care of. Kid was worried about the other dude getting in trouble but won't let things progress. Cops were told a situation happened, a guy waved a fire arm. He runs back into the house and don't tell me nobody has ever run back in for a weapon before. I don't agree with how the cops handled it, but the dad didn't handle it like an adult either. Kid and dad couldn't shut the fuck up long enough for the cops to explain anything.

@babo118 they just got a call regarding a threat and a possible gun involvement. And when the cops only have that info and the guy, after being asked to come over to talk, decides to back up and try to run into his house the cops will want to stop that from happening. It's like being pulled over because they had a call about a car that matched yours. You aren't in trouble, unless you decide after pulling over that you are going to speed off before the cop can come to your window, now you are in trouble. Word of advice, if a cop says "hey come over here and talk for a second" the worst thing you can do is run away. You don't need to talk to them, you could ask if you are being detained or say you don't want to talk, but to turn around and run away is the worst option to take.

Moron wasn't even correct about the "reckless burning" charge. THAT should be more of a concern rather than somebody simply sitting down on a damn bench. The second officer even addresses what the candles were there for, because he is obviously mourning the passing of his friend Katrina, paying his respects to her, and has said so even before the second officer arrived on the scene. She understood what was going on within 10 seconds of being there, while Mora was too busy escalating it for four minutes.

I have mixed feelings on this one as they both could have handled it way differently, guy could have simply said "I'm having a vigil for my friend" and then maybe him and cop could have talked about it, at the same time the cop could have said "it looks like your having some kind of vigil" because that's what it looked like, (however with people nowadays you just don't know what they might be doing, sadly its turned into a crazy world) and then once again they could have talked about it. Just because residents of the neighborhood know him and other officers might know him that cop obviously did not. So he did what he was trained to do which was approach with his lights to light up the person to be able to see what they might be doing just as the other cop confirmed, but both of them could have handled it way differently with a different outcome.

Sovereign citizens believe their above the law. Recording police is just a 1st amendment right, and demanding badge number is just a way of holding them accountable. Neither of which constitute being above the law. Also, you should look up the context of this situation. The police are the ones in the wrong in this situation. No warrant, no exigent circumstances, and no permission. It's a 4th amendment violation and an 8th amendment violation.

The guy instead turns tail and flees inside his house, where he could have a gun ready to shoot at the police for all they know. He was actively resisting arrest. The cops wanted back inside the house because the one officer dropped his bodycamera in the struggle with the dad. They didn't search the house, all they were doing was retrieving their property. The kid is allowed to record from a distance, but the kid was actively trying to invade the scene, causing problems.

Also, they were being incredibly standoffish, and aggressive towards officers, but not violent. They could have gotten an additional charge of obstruction, for obstructing an investigation and disobeying a lawful command (which they did get arrested for), also the investigation was about a firearm, and when the guy suddenly fled inside, he could have been retrieving said firearm or a weapon, to harm the officers with, which is why things escalated. Also he wouldn't have retreated inside if he had nothing to hide. Furthermore, sovereign citizen-type people usually just hate the law, law enforcement and are just general nuisances for the public in general.

Even states about the 1st amendment right to free press to record the police. What I'm talking about is government accountability, not about the civilians actions or lack there of (That you keep referring to). Most people seem to either not care or not know that even criminals proved guilty have rights. These individuals didn't even break the law. It's sad when the government has to confirm your rights, which are designed to protect you from them. Police cannot detain just anyone they want. That would be dangerous. You should know that a lawful command, has a law that backs it. Cite me the source that would give info as to how their commands were lawful.

Second guy's story is peak irony. He definitely didn't trust police and they gave him every reason to continue not trusting them in the future. How can you get hit with failure to comply when there's no reason or even cause for a situation to comply with, they refused to give badge numbers and names and expect the guy to feel good walking into handcuffs when no crime has been commited on his end? Ridiculous. I hope he sued and rinced that department. I swear this is what has changed with most cops they’ll take any question and twist it into something that then justifies them to be more “intimidating” with their conversation. What are you talking about, the cops had a probable cause to enter the home. The man resisted and tried to run. And the kid was getting too close. He received an order to step back and he refused. The kid is talking about people intruding the house but they had a reason, are you supposed to let a guy just run because he can’t enter his house because it’s his property? He was constantly told to step back and he refused. The cop told him to step back and he was fine if he recorded and he still didn’t step back. He also refused identifacion.

Mora has a chip on his shoulder where his first priority is to establish that HE’s the tough guy, but secretly fears he’s not. The female officer approached the situation perfectly in that she first expressed sympathy for the deceased friend and used her name. I would think that calling a person or “suspect” a dumb ass is probably almost NEVER helpful in dealing with anyone and his repeated use of it demonstrates that Mora lacks the emotional maturity to be an effective police officer. The first thing any counsellor will teach a person about communication is that if you resort to name calling the other person will shut down,or become defensive and respond in kind. Either way they will stop hearing anything that you have to say. It destroys any hope of effective communication/deescalation/resolution.

I love the clip with jack and his dad for all the misunderstandings of the law they have. He thinks he's the only one filming, that you need a search warrant to even enter the house, that the dad thinks he didn't flee, the constant "what's your badge number" and borderline obstructing an arrest lmfao.

Well, your not that wrong, but neither are they. Im a german so i dont know your guyses laws over there that good so teach me better if im wrong. As far no one is in danger or there is evidence in your home that relates to a serious offence theyre not allowed to get in your home without consent or a warrant. Dont know how far the rights of private prop are but the fact he wantet him to get down of his ground looks for me like theyre actually right in that case.

@tmplaygame4liveki400 at least in most US states, police are allowed to enter the house, walk through generally, without consent or a warrant as long as there's probable cause (allowing em to do anything basically) but not a full on search eg. a forensics team and photographs for evidence. A search warrant would be needed for that.

​@@lune7220Its not probable cause, but exigent circumstances such as an emergency requiring immediate intervention where they do not have the time to get a warrant like a hostage situation, or medical emergency.

seems like a bunch of bullies harrassing people to practice their rights like those auditors who go around harrassing people and talking in a threatening way then screaming and crying when people don't like it and their rights are being voilated. The way this dad and son talks it sounds a lot like they are used to bullying people and abusing their rights by harrassing people. The thing is, they think they are protecting our rights but all they are doing is risking having those rights taken away.

I don't like how both the dad and son were acting like d*ks, but unfortunately they were in the right. I can see why the police officer went into his house briefly(the call stated a firearm was present), but being arrested without due process is still unconstitutional. I could see why the father would be detained after such a circumstance, but straight to the prison?
