The Delhi High Court in this judgement said that merely because the wife is earning does not automatically operate as an absolute bar for awarding maintenance by the husband.
The spouse with a reasonable capacity for earning but who chooses to remain unemployed and idle without any sufficient explanation or indicating sincere efforts to gain employment should not be permitted to saddle the other party with the one-sided responsibility of meeting the expenses.
The court further said, "The equivalence does not have to be with mathematical precision but to provide relief to the spouse by way of maintenance pendente lite and litigation expenses, who is unable to maintain and support during the pendency of proceedings and to ensure that the party should not suffer due to lack of source of income. The provision is gender neutral and the provisions of Sections 24 & 25 of HMA provide for the rights, liabilities, and obligations arising from marriage between the parties under HMA

मजे की बात ये है दोस्तों की पति ने झगड़े के बाद केस किया लेकिन भारत के कानून के हिसाब से पति अपना केस लड़ने के लिए तो पैसा देगा ही लेकिन साथ मे पत्नी को भी पैसा देगा खुद के विरुद्ध लड़ने के लिए 😂🤣 वाह क्या कानून है? 😂, तब तो जो नहीं कमा रहा उसके तो दोनों हाथो मे लड्डू है 😂🤣, क्युकी जब खर्चा सामने वाला दे रहा है खुद के विरुद्ध लड़ने के लिए तब तो मजा ही है, ये एक नया बिजनेस बन सकता है 😂

मतलब मजबूर मजदूरी कर कर्त्तव्य भरण-पोषण देना ही है लेकिन पत्नी स्वास्थ्य होने पर भी ज्यादा भरण-पोषण पति को देना पड़ेगा नही तो जैल भेजा जाना प्रैक्टिस चल रही प्रैक्टिकल ऐसा हो रहा है और किसी वकील या किसी को न्याय से मतलब नही पैसा पैसा चल रहा है 99 %तो

Wife abandoned her wife and stays with parents and after one year she files DV without any sufficient grounds and she does not like to have any family relations,she files false allegations and the lower court passes order without verifying true facts.She is a physiotherapist ,studied for 6 years ,joined for graduation,did ITA ,and presently a BSC nurse .Even with all her qualifications she wants maintenance though no relationship from the date of marriage.very sad .Favoring women ,I feel our law should change.I am also a lady living with my hard earned money.

1995 mai mere FIL ne ek property kharidi thi..paise pura de diya the..but samne se seller ne sign karne se mana kardiya and paise bhi return nhi diya....extra paise mange...than uske baad 2015 mai wo goons leke aaye and property ko claim karne k koshish kiya...meri family yaha kafi salon se recti hai....kya app iss mater mai koi case study suggest kar sakte hai...meri hasiyat nhi k mai paid advice apse le Pau...please help ...case dispose ho chuka hai koi verdict nhi Arya hai...should I refile or let it go....
