Your first rant clearly details the inherent problems with real estate past practices. Co-broke language in listing agreements (previously forced by MLSs in order to list on their respective platforms) and commission sharing in general are at best problematic, and at worst, unethical and illegal. The listing agent should never share any percentage of their commission with the opposing representation in any deal. Why? Well many reasons including blurring lines of fiduciary duties and possible co-mingling of funds in your “cut one check at the closing” scenario. Real estate agents that say lawyers don’t know how the real estate industry works to the betterment of buyers and sellers and that these lawsuits have no merit are blinded by their own self interests and don’t understand legal principles with regard to antitrust violations and uncompetitive practices. The more lawyers learn and understand these past real estate practices the more they realize they are ripe for litigation. When it is all said and done, there will be no commission sharing between agents and if the seller wants to offer buyer agent commission contribution they will do so directly to the buyer through the negotiation of the terms of the purchase and sale agreement. Sorry not sorry but that’s how it will be.

Awesome, Well said. Thank you for sharing your thoughts. Both Rants are SPOT ON! Regarding the Team rant, YES!!! You nailed it. That is exactly how teams work in my area and its such a lie. The community thinks the Rainmaker is a Rockstar and they are not. And the team members I have noticed are fairly new agents that haven't been trained and the team members don't realize they are hurting themselves ultimately. I'm now a new Subscriber.
