I believe that National Cemeteries are sacred ground and hold the remains of heroes from all walks of life that have ever put on the uniform. They are places of honor and they reflect the best of what this nation has to offer. Anyone that has a burial within our National Cemeteries should be honored and cherished forever. But on rare occasions there are some that should not have been placed within those grounds.

You're right this is ridiculous! In 1997, after Army veteran Timothy McVeigh was sentenced to death for his role in the Oklahoma City bombings, Congress barred veterans convicted of capital murder and sentenced to death or life in prison from being buried with full military honors. Veterans convicted of rape or any other violent crime, however, encounter no such restrictions.

Someone made a post saying the law covered that as well but if so how did he slip thru the system? I want to make sure that something is in place that will never allow this to happen again.

Under 38 U.S.C. § 2411, interment or memorialization in a VA national cemetery or in Arlington National Cemetery is prohibited if a person is convicted of a Federal or State capital crime, for which a sentence of imprisonment for life or the death penalty may be imposed and the conviction is final. That’s how they state the law at this time since the lawsuit in 2005 so he wouldn’t have able to if he died after that because his crimes fits under capital crimes. Crimes that are punishable by death are known as capital crimes, capital offences or capital felonies, and vary depending on the jurisdiction, but commonly include serious crimes against the person such as murder, mass murder, aggravated cases of rape, child rape, child sexual abuse, terrorism, war crimes, crimes

So it sounds ike it does include what he got in trouble for but it sounds like it changed right after him. I wonder if he had a little something to do with the law change. Thank you for searching that up.

i am on my wifes site,but i am 100 percent with you rhett,i was in for 6 years back in the sixtys.many of my friends lost their lives during that time,they were the heros,and those of us that came home will never forget them.we somehow need to start a campaign to purge the filth from are national cemeteries.they need to be re-intered somewhere else for the dishonorable.they have no standing among the honorable. c.t. hall

I often think of people like you and other Vietnam veterans. They faced the atrocities and horrors of war and then came home and were rejected by their country. But for the most part life went on and people became good members of society. Thank you for sharing your thoughts on this subject matter.

It's sad in many ways. I feel for him in that he needed some help in some way. I feel extremely bad for the victims in this case. Every year several times a year his memorial marker is gazed upon and he is honored and people really have no clue about the destruction he caused after the service. And I have to wonder if he did those sort of things while in or before service. Thank you for sharing how you feel.

There is a law the prohibits this, 10 USC 985; Persons convicted of capital crimes; certain other persons: denial of specified burial-related benefits

Thank you for pointing this out. I'm wondering if this was updated after he was interred? II'm wondering how he went thru the loop hole? Was it only defined as murder when he was buried?

@@RhettyforHistory I believe it was around the time he was convicted. Although, there was another murderer in Texas who was a veteran that prompted the proposal.

@@RhettyforHistory he robbed and murdered an elderly couple. The perpetrator was a veteran, who wanted burial in the VA cemetery. It happens more than you think. VA cemetery do have veterans who have committed crimes, but again where do you draw the line?

I think it is one think when they are violent crimes where they are hurting people or killing them. Although I do not agree with it money laundering, drugs grand theft auto, arson etc is another.

I agree with you. As a member of a military family this is horrible, should not be allowed nor should they have the right to a military marker. I have seen military markers given to people that have been executed by the prison system. All of that should be stripped away. No one should be able walk up to their grave and thank them for their service. Or put a flag on their grave.

I do agree with what you are saying. It is a misleading thing to have on anyone like that. Were the grave that you have seen prior to 1995? I was just curious with what happened with Timothy McVeigh.

Rhetty, 2nd posting on this. I went to Netflix and watched the story on this. If anyone is interested, it is on Cold Case Files, Season 1, and the episode is called Manhunt. The women involved were very brave to speak out. The episode did discuss his military background. I also went to Find a Grave. His photos appeared to be mug shots. It then referred the reader to an article that detailed his offenses. Here is a statement from that article: “His suicide put a fine point on how little he had left to live for in the wake of his conviction. But his death also granted this serial rapist a moral reprieve that the civilian legal system couldn’t. Selby was a Persian Gulf War veteran and so, in accordance with Pentagon policy, was buried with full military honors at Ft. Sill National Cemetery in Oklahoma.” This policy needs to be changed. If quoting articles is not allowed on your site, I understand and you may delete this.

No that is fully allowed and thank you for sharing what you found. I wonder if the government did this for him or if some family member requested it thru the VA? I have pinned a post above where someone shared a law that was modified the next year after he was buried and this changed things so that these type of criminals will not be interred in National Cemeteries again. Hopefully that hasn't happened since. Looks like someone else shared the law was changed because of some criminal down in Texas. I don't know who it was or what they did.

Hey Rhett, thank you putting this to our attention. Yes, he may have served and who knows why he did those crimes. But as stated in one of these threads, there is a Federal law prohibiting this. Even if the family filled out the paperwork or not. He DOES NOT belong in that sacred ground. Thank you for yours and the other vets service who have written on this site. Semper Fi!!

I saw someone shared a law that should have prevented this. I'm not sure if what he did was covered by that or if it was amended and passed after. Somehow it seems like he slipped thru the cracks whether was a law or not. We need to ensure that this never happens again. Thank you for watching and sharing how you feel.

Who applied to have him buried here ? You would think his family knew better. Totally agree he should be removed and any other who have disgraced the honor. My father and my husband are both Veterans.

Good that you took this on. Something that all sides of the political and social spectrum can agree on. There should be a higher standard than just an honorable discharge to be buried in a national cemetery.

Both my husband and idea fully support the idea that anyone, who has been convicted of murder or rape, NOT being allowed a burial in a Veterans cemetery. My husband served for 10 years in the Air Force. It seems a petition should be started and I cannot see it NOT passing. It would have huge support from all sides of the political spectrum!

This is beyond disgusting. He should be removed and shame on whoever arranged for and approved his burial in a National Cemetery. I wonder if a Congressman, tv station, or newspaper would take this on? Thank you for bringing this to our attention. Thank you for serving our country.

Thank you. It is disgusting. He was from Illinois and died in AZ. I assumed a family member made those arrangements especially with that epitaph that was listed there. I don't know why the VA thought that was a good idea but I guess they didn't have all the other information. Or at least I hope not. I am hoping that things are in place to where this never happens again.

Someone found a law that was modified and hopefully this will prevent this from happening again. Sure would be nice to get official word on this. It appears that it changed the very next year after he was buried there but I'm sure it wasn't because of him. I can't believe they ever thought this was a good idea. I'm hoping the VA just didn't have all the information and somehow he slipped thru the cracks. It is disgusting though.

No one wants to do anything to that grave unless they want some jail time. Those cemeteries have a different level of protection. Not that I would do this in any cemetery but I wouldn't even take the flowers off of a grave in a National Cemetery. It's highly unlikely he will ever be moved although I think that is the right things to do or to have something designating what he is so that Wreaths and other ceremonies are not honoring him. The main thing is we need to make sure that no one else like him is placed in these sacred grounds anywhere in the U.S.

I agree! He should not be buried there. Who gave him the clearance to be buried there? Only true heroes should be buried in a military cemetery.

Fully agree with you Rhett. My Dad was in WW2. Our Son did his Service for our Country, & made 2nd Lieutenant. I can't understand why he was buried there. Thanks for letting people know.

We do. It would maybe be different if they had changed or turned their life around. But he simply did not. Should he be buried sure if he wanted or the family wanted. Just not in a national cemetery where honors are still rendered to him a few times each year.

Supposedly the law that came about in 1997 from Timothy McVeigh is supposed to cover this but clearly it doesn't. I have also heard from some in the comments that the law was changed to cover this a year after this one was buried here. I think we need to write all of our public officials on the U.S. level plus the VA to make sure this does not happen again. Somehow he slipped thru the cracks but it was a Crack that was split open with lawyers getting him in here. If enough people are saying something then we can ensure that something is done to prevent this. Thank you got watching and sharing how you feel.

I believe you are right on that. It's a cowardly act. It's going to take a lot of people standing up to get something done on this. Of all places if he was going to be in a national cemetery why back in Oklahoma where his first known victim was? So sad and disgusting.

Good video and very good points, in Fort Huachuca AZ their are two soldiers who fit your description in the cemetery that were executed. They were buried out of formation and at an angle to separate them from the rest of the buried soldiers.

They committed murder. One during calvary days. The other in the 40's or 50's. As the plots get closer to them the are to be moved farther away.

He could have been buried in practically any public cemetery. I don't think that is the issue at all.

I'm sure the full expense had a little to do with it. They would have paid a portion in another if not all depending on where it is. His mother was here in Oklahoma and that was the cemetery she hired lawyers to fight to get him in. Perhaps because it was new but I think it was close to where she was. I would felt the same no matter what national cemetery it was.

Rhett, I totally agree with you that certain people who commit horrific crimes shouldn't be buried in military cemeteries. My late father was a veteran of the Korean Conflict War, VFW and American Legion member, who is buried in a military cemetery in Virginia. It is despicable how they would even be considered to be buried among our military "heroes." Take care 🐎

I came home on leave a couple months after the OKC bombing and it was a sight I will never forget I had a friend who was working security for the area so I got an up close tour of the area. Thank you for watching.

Excellent video, Rhetty! And I agree with you 100%!!! In fact, I don't think he should be in ANY cemetery since all cemeteries are considered hallowed ground, aren't they??? That S-O-B should've been discarded in a dumpster and totally forgotten about! And, I don't know, maybe it's just me but... I'm also having a problem with the fact that his family actually put "Always in our hearts" on the headstone. I gotta be honest here, if I had a relative that was a convicted pedophile/serial rapist, that's definitely NOT the epitaph I would've chosen, that's for damn sure!

Thank you for sharing your thoughts and feelings on this subject. There is no way I could place an epitaph like that either. I also never would have requested a burial in a National Cemetery either. I'm not sure who did that. His father died a few years prior and he had a half sister that died when she was 18 and he was about 13 or so. Makes me wonder what happened to her. We really don't know when he started doing all this. I feel bad for the victims and them knowing he has been honored in here and then after that I think he shouldn't in this cemetery. Something about that bothers me. As you know I cover a bunch of criminals and it just seems different when they are in other cemeteries.

Hi Rhetty, How are u doing? I hope u are doing fine & well. I would like to say thank you for this video it was really good. My parents are also buried there at the Ft. Sill National Cemetery. I have to agree with what u said in this video u are more than a million % right. They don't deserve to be laying in a national cemetery & even the other people that have done REALLY BAD things. I don't think it's fair to the soldiers or their families. I only live a couple of miles from the cemetery in the next town going east. I grew up at Lake Ellsworth. After reading the title and hearing you say it was Oklahoma, I dreaded the name you said. Certain felony convictions, particularly crimes related to terrorism, violence, and sexual assault should disqualify veterans from being buried with honors. It's disgusting. Veterans like yourself should never be laid to rest beside those who violated the Constitution and the lives of those they were sworn to uphold, protect, and defend. Thanks for sharing this video. It's not supposed to be possible but as you can see somehow people slip through. In 1997 that law was changed to keep these people out. But it doesn't quite work if this one got in. Someone said the law was updated in 2005 thanks to another case with a veteran in Texas. This should have never happened. And with this case it was all done with lawyers that his mother hired. If someone has to get lawyers then it probably isn't right. For sure not in a National Cemetery. I'm hoping that with enough contact with elected officials we can make sure this is something that will never happen again. I think it all has to do with free funerals and not putting the burden on the family to pay for a funeral or even suing the Military if they deny the family of the free funerals for veterans Having saying that, I couldn't agree more, these people should not be buried in these cemeteries.

There is a different level of what is paid for in these cemeteries. Perhaps that is what the mother was going for. I'm not sure. I know they cover a portion in other cemeteries. Perhaps that needs to be looked into as an alternative.

I have to agree with you Rhetty. I have always had a great respect for veterans My Grandpa enlisted in the Army in February 1942. The first week of February if I'm recollecting right. After he heard about Pearl harbor bombing was what made him enlist. But he had to wait until after he was 18. He served through the war. And after in the Japanese occupation force and Asian Pacific Theater. He never talked much about his time in the service. He passed away at the age of 92 in 2016. Since you served yourself, I was wondering if could help me out with something that I was curious about? My grandpa and grandma share a Tombstone, my grandpa never got a foot stone, not sure if that is what they are actually called, placed at his grave showing what war he was in and what branch of service. I was wondering why? I wonder if it was something that he didn't want or what. He had made his own funeral arrangements himself about 20 years before he passed away.

Men like your grandfather are true heroes. He may have wanted his marker that way although it's difficult to say if he never communicated that with anyone. I do know that any honorably discharged veteran is invited to a government marker or medallion. It may be something you could request thru the VA. I know they have had a link on their website but I'm not sure how that's been going with the Pandemic and they could be a little back logged. It will help if you have additional information like his dates of service, branch, service number and if any of his children are alive and willing to submit that request it will help out a lot.

Ok that should help a lot. Just include a copy with the request. You can always have a small one and that can be in your garden if not on his final resting place.

@@RhettyforHistory A copy of his DD-214 would expedite things. My niece and her husband recently had to get a copy of her father-in-law's DD-214. I keep mine in a safe place and my brothers and sisters know its location.

The DD-214 is key for everything but if they do not have it there are still ways of getting different things from the VA for older veterans or their families.

My Dad is a Korean War Veteran and he passed in California was cremated and ashes in San Joaquin River. He is an Okie born and raised I contacted VA and they set a Stone for my Dad at Ft. Gibson and he was not a criminal. We have most of Our Veteran Family in our local Cemetery. VA is just awesome with Our Veterans and setting their plaques and headstones in our City Cemetery. No that man lost his rights to be buried with Our Hero's in a National Cemetery. Who is responsible for his burial? I don't think the VA looks at Police Records after Vet is discharged? They just look at their service records.

Thank you for giving sharing your feelings as well as telling about your father and family. Those are the people that deserve these burials and not someone like this man. This was all done at the request of his mother who got lawyers to make it happen. The VA did make it happen once it was deemed that he had those rights. That's what I would like to see changed. After McVeigh and how they wrote that law it should have changed for good. Someone mentioned in the comments that it changed in 2005. I'm not sure it really has but I sure want to get answers and ensure it doesn't happen again.

This is a lesson in citizenship. I am a staunch constitutionalist. The likes of McVeigh claiming they’re constitutionalist is false. They renounced their citizenship the instant they chose to use those rights to violate others citizens rights and it should not be tolerated in any shape form or fashion. We must be fair and just above all else. Throwing fits and acting immorally reduces us and should be held in the forefront to keep us from acting as tyrants. This should be our backbone. Thank you for shedding light on this subject.

This person does not belong in anybodies cemetery. Certainly not a military cemetery that is designed to honor all the brave individuals that served honorably and lived honorable lives.

It is a touchy subject I know. Many of these offenders are in cemeteries all over the place. Eventually they are forgotten unless they are some famous criminal. But I always think of Wreaths Across America coming there every year and rendering honors. It also looks like they just cleaned his headstone fairly recently. Veterans in regular cemeteries do not get those same things. I understand that and it's a matter of choice. But I'm not sure who made this choice for this person or who thought it was ok to allow it. I'm hoping that somehow this can be stopped for future burials nationwide.

@@RhettyforHistory Yes, I agree. Some welling meaning volunteer thinking he's honoring a vet by cleaning and maintaining his stone. My father was a WWII vet with the 548th Night Fighters and he's in a plain old cemetery with the only cleaning and honoring coming from family.

I know an employee does the stone but the Wreaths are most likely a volunteer. You're Grandfather is certainly a hero in my book. I've always admired the men who served during WW2.

I'm not sure if anything can be done to get him out of there. Certainly you can contact representatives and senators as well as the VA. It's going to take a lot of public outcry to get something like that done. But surely all of that could prevent this sort of thing happening again with future criminals.

@@RhettyforHistory Rhett: One of the saddest and most un-understandable situations that all the men and women of the Dallas Police Department encountered about 15 years ago involved an officer that recently retired. He and his wife of over 40 years had just built a new home in a retirement/resort type development and were in the process of moving in. He shot and killed his wife, then himself. He was a veteran and was buried along with his wife (stacked burial) in the Dallas Fort Worth National Cemetery. A lot of veterans and myself included were troubled by this. The Operations Managers explained that he would have been barred from burial if he had been CONVICTED of Murder, as he committed suicide, he was not convicted.

That is horrible and it still seems like something should be done on that too. I could see the loophole with the conviction part. In the case of this one he was convicted in CO and sentenced and then convicted in AZ but not sentenced. It is sad to see this and what you mentioned happen and then see them in National Cemeteries. It really seems disgraceful that his wife was buried with him. You know she qouldn't have wanted that knowing what he did to her.

Those men and women are certainly not the issue if that is all they have done. It's when they have hurt others and some of them have done it in high numbers. Those are the ones that I believe do not belong in the National Cemeteries. Do they belong in other cemeteries? Yes. My father rests in a national cemetery. He volunteered to join the army in 1953 and served his 6 years plus 4 in special forces, then special forces reserves until forced retirement at 60. Subsequently he was a police officer then as a deputy US Marshall as he neared retirement. He was also a history teacher. And one of his strongest messages was to caution against fetishizing the military as that tends to lead towards authoritarianism. He volunteered for his life’s work. No one forced him. He was not drafted. To worship the military as “heroes” as a class without regard of individual actions is to insult the nature of service while the sacrifices of others in our community go unrewarded. There are those who ACTUALLY put their lives on the line daily yet get not one word of praise while all members of the military get a free pass simply for their profession. Most go through their military career seeing no significant action -- that in and of itself is not heroic. “Don’t thank me for my service. I’d rather have you ask yourself how are YOU serving the community you’re a part of.” Miss you dad.

Most likely under current law there is no way to prevent him being buried there. The law needs to be changed. As a Vet I have always said that service does not grant permanent Saint hood.

I had no idea that was allowed. There is a flaw in the internment requirements that needs changing. I’m Disappointed in the government for allowing that. Dishonorable veterans should loose their benefits.

Of course the loophole is that he was not a dishonorable veteran. Or at least that we know of. He wasn't discharged that way. But I do feel he earned that title when he became a serial offender. It's not good for that to happen to anyone at all.

When the civilian courts get done with punishment then the veterans administration should have their turn by removing your veteran benefits. I don’t know if it’s that the veterans administration doesn’t care or they just don’t know about the despicable deeds committed by ex active duty personnel? Either way it’s wrong.

I think for a long time and even while a service member there are two different courts and the military likes to keep it within. They don't want it going to civilians and tarnishing the commands. But once you are out then the military has no jurisdiction over them. Laws just need to be put in place. I understand things happen that are horrific and that can have an affect on offenses after service. But violent crimes and serial violent crimes should be different. We aren't talking about stealing a car or burning down a house. Only a new law would ever make this change. Sad you have to have a law to do what is right.

It is a little shocking. I thought certain violent offenses would do that especially if they were convicted of more than one. It's certainly a touchy subject and I understand the difficulties one can face after serving in horrific times. But some things just need to have consequences. Military or not.

Totally agree, I am also a vet. You lose your honorable status when you're dishonorable. Ps on a side note. I was stationed at Sill 93-95. I remember hiking the Wichita mountains and also stopping at Meer's territory restaurant for a huge long horn burger. Is it still there ?

People that do things like that don't deserve any place of honor. Well, I don't even want to say what would have been done with his remains if I had my way, but I certainly agree the he doesn't deserve to be buried there.

Hello Rhett 🙋🏽. I'M in total agreement with you. He was an awful individual. With no morals or standards. I'M wondering why and who decided that it was okay to bury him there ❓🤷🏽. If you find out anything let me know. I'm not sure where the mother was. I saw his father passed away a few years prior and there was a half sister that he had who passed when she was 18. He was a young teen then. Given the circumstances I would love to know her cause of death. I could not find anything on that either. Somehow there had to be a family member who requested this burial and especially so with that epitaph. The VA was probably just looking at his service record and not his crime record. They need to have something in place for these serial offenders.

Rhett, I looked up James Selby. And I found out some interesting stuff. There was a guy who also confessed to the little girl's murder. By the name DAVID WESTERFIELD. IF YOU LOOK UP DAVID WESTERFIELD, IT TELLS YOU A LOT MORE ABOUT JAMES SELBY, WHOM LATER COMMITTED SUICIDE 🤔.

Someone who victimizes others definitely doesn't deserve to be honored. It goes against why most people choose to serve in the first place. We're making the sacrifice, not making those we're protecting make a sacrifice for us. I never really understood the whole national cemetery thing, whereas the battlefield cemeteries make a lot sense. You served and died with those people. I'd rather be buried near my family, but that doesn't even matter since I will be dead.
